HomeMy WebLinkAbout042126-06.6ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council April 21, 2026 SUBJECT: Resolution No. 28-2026, approving the Contra Costa Clean Water Program Inspection Activities Agreement BACKGROUND The Town of Danville operates a local Stormwater Pollution Control Program pursuant to the federal National Pollutant Discharge Elimination System (NPDES) requirements under the Clean Water Act and is a co-permittee under the Municipal Regional Stormwater NPDES Permit issued by the San Francisco Bay Regional Water Quality Control Board. The Municipal Regional Stormwater Permit requires municipalities to conduct inspections of certain industrial and commercial facilities and to implement illicit discharge detection and elimination activities. In Contra Costa County, these inspection activities are implemented through a coordinated countywide program administered by the Contra Costa Clean Water Program. Since 2009, the Town has participated in a group inspection program in which Central Contra Costa Sanitary District conducts municipal stormwater inspections on behalf of the Town. The existing inspection agreement is being updated and replaced to reflect current permit requirements and program administration practices. The proposed Contra Costa Clean Water Program Inspection Activities Agreement will supersede the 2009 agreement and continue inspection services beginning July 1, 2026. DISCUSSION Through this agreement, Central Contra Costa Sanitary District will continue to conduct municipal stormwater inspections on behalf of the Town, including inspections of industrial and commercial facilities, illicit discharge investigations, enforcement support, and related reporting required under the Municipal Regional Stormwater Permit. The Municipal Regional Stormwater Permit (MRP 3.0), reissued in 2022, expanded requirements for commercial and industrial facility inspections, including increased inspection frequency, enhanced documentation and reporting, and additional facility categories subject to inspection. Participation in the coordinated group inspection CCCWP Inspection Activities Agreement 2 April 21, 2026 program allows the Town to meet these requirements efficiently and cost-effectively through shared services rather than performing these inspections independently. The agreement maintains the coordinated countywide inspection program that allows stormwater inspections to be conducted concurrently with sanitary district regulatory inspections, improving efficiency and reducing program costs. Staff recommends approval of the agreement to ensure continued compliance with Municipal Regional Stormwater Permit requirements. Costs associated with inspection services are included in the Town’s annual Contra Costa Clean Water Program budget and funded through the Stormwater Utility Assessment. Friedmann Development Services Director Attachment: Resolution No. 28-2026 RESOLUTION NO. 28-2026 APPROVING THE CONTRA COSTA CLEAN WATER PROGRAM INSPECTION ACTIVITIES AGREEMENT WHEREAS, Section 402(p) of the federal Water Pollution Control Act (Clean Water Act), as amended by the Water Quality Act of 1987, requires National Pollutant Discharge Elimination System (NPDES) permits for stormwater discharges from municipal separate storm sewer systems (MS4s); and WHEREAS, in California, the NPDES permits are issued through the California State Water Resources Control Board and the Regional Water Quality Control Boards; and WHEREAS, the San Francisco Bay Regional Water Quality Control Board has issued a Municipal Regional Stormwater NPDES Permit (Permit No. CAS612008) that applies to Contra Costa County, its incorporated cities and towns, and the Contra Costa County Flood Control and Water Conservation District; and WHEREAS, the Municipal Regional Stormwater Permit requires municipalities to implement stormwater best management practices, including industrial and commercial site inspections and illicit discharge detection and elimination activities; and WHEREAS, the Town of Danville participates in the Contra Costa Clean Water Program (CCCWP), a cooperative program that provides coordinated administrative, technical, and regulatory support to assist member agencies in complying with Municipal Regional Stormwater Permit requirements; and WHEREAS, the Town of Danville has executed a Stormwater Utility Area Agreement with the Contra Costa County Flood Control and Water Conservation District, which provides funding for municipal stormwater program activities, including inspection services performed under this Agreement; and WHEREAS, through the CCCWP, the Contra Costa County Flood Control and Water Conservation District administers a coordinated countywide inspection program, and Central Contra Costa Sanitary District conducts municipal stormwater inspections on behalf of participating agencies; and WHEREAS, the Town of Danville, the Contra Costa County Flood Control and Water Conservation District, and Central Contra Costa Sanitary District previously entered into an inspection agreement dated October 26, 2009; and WHEREAS, the proposed Contra Costa Clean Water Program Inspection Activities Docusign Envelope ID: 4C6398CE-BFF3-40F5-B308-D754A2FEF689 PAGE 2 OF RESOLUTION NO. 28-2026 Agreement will supersede and replace the 2009 agreement and will continue inspection services necessary for compliance with the Municipal Regional Stormwater Permit; now, therefore, be it RESOLVED, that the Danville Town Council approves the Contra Costa Clean Water Program Inspection Activities Agreement in substantially the form presented; and, be it further RESOLVED, that the Town Manager is hereby authorized on behalf of the Town Council to execute the Contra Costa Clean Water Program Inspection Activities Agreement.
