SUBJECT: Resolution No. 25-2026, accepting a Grant of Public Utility Easement and
Landscape Maintenance Easement on Lot 4 of Subdivision 9598 along
Camino Tassajara
BACKGROUND
Subdivision 9598 included the construction of frontage improvements and associated
public improvements along Camino Tassajara. As part of the project, a Public Utility
Easement and Landscape Maintenance Easement is required on Lot 4 to allow for
construction, operation, maintenance, repair, and replacement of public utilities and
landscape improvements associated with the frontage improvements.
To memorialize these improvements, Ponderosa Homes II, Inc., owner of Lot 4, has
executed a Grant of Public Utility Easement and Landscape Maintenance Easement in
favor of the Town of Danville.
DISCUSSION
The easement is located on a portion of Lot 4 of Subdivision 9598 and consists of
approximately 277 square feet along the Camino Tassajara frontage. The easement
provides for public utilities and landscape maintenance within the easement area. The
executed Grant of Easement document is attached as Attachment B.
Action by the Town Council is required to formally accept the easement on behalf of the
Town so that it may be recorded with the Contra Costa County Recorder’s Office.

RESOLUTION NO. 25-2026
ACCEPTING A GRANT OF PUBLIC UTILITY EASEMENT AND LANDSCAPE
MAINTENANCE EASEMENT ON LOT 4 OF SUBDIVISION 9598 ALONG CAMINO
TASSAJARA
WHEREAS, Subdivision 9598 required the construction of public improvements along
Camino Tassajara; and
WHEREAS, a Public Utility Easement and Landscape Maintenance Easement is required
on a portion of Lot 4 to accommodate public utilities and landscape improvements
associated with the frontage improvements; and
WHEREAS, Ponderosa Homes II, Inc., owner of Lot 4, has executed a Grant of Public
Utility Easement and Landscape Maintenance Easement in favor of the Town of Danville;
and
WHEREAS, action by the Town Council is necessary to accept the easement; and
WHEREAS, it is in the Town’s best interest to accept the easement; now, therefore, be it
RESOLVED, that the Danville Town Council accept the Grant of Public Utility Easement
and Landscape Maintenance Easement, as executed by Ponderosa Homes II, Inc.; and, be
it further
RESOLVED, that the City Clerk is hereby directed to attach a Certificate of Acceptance to
the easement document and have it recorded at the Contra Costa County Recorder’s Office.

against any and all loss, damage, expense (including, without limitation, reasonable attorney's fees
and costs), claim or demand of whatsoever character, direct or consequential, including, but
without limiting thereby the generality of the foregoing, injury to or death of persons and damage
to or loss of property arising out of the exercise by Grantee ( or by any party claiming by or
through Grantee) of the rights granted herein, except those arising by reason of the negligence or
willful misconduct of Grantor or its agents, contractors, or employees.
Said easement shall run with the land and be binding on the owner, the owner's heirs, assigns or
successors in interest
