SUBJECT: Adopt Resolution No. 9-2026, approving the State of California
Governor’s Office of Emergency Services Designation of Applicant’s
Agent Resolution (Cal OES Form 130)
BACKGROUND
In order for the Town to be eligible for future reimbursement from the federal or state
government, the Town Council must approve Cal OES Form 130 - Designation of
Applicant’s Agency Resolution for Non-State Agencies (Form 130). Form 130 designates
the positions the Town Council authorizes to apply for public assistance and recovery
funding on behalf of the Town, for a three-year period. The previous Form 130 approved
and submitted by the Town has now expired. Adoption of the Resolution would
designate the Emergency Services Manager, the City Engineer, and the Finance
Director/Treasurer as agents who can apply for possible reimbursement.
DISCUSSION
In order for the Town to be considered for state reimbursement funding, the Town
Council must adopt a resolution that names Authorized Agents and make a formal
request for federal financial assistance under Public Law 93-288 and or state financial
assistance under the California Disaster Assistance Act. It is appropriate to name and
authorize the Town’s Emergency Services Manager, City Engineer, and Finance
Director/Treasurer as agents to act on the Town's behalf during the application process.
If the Town Council approves Form 130, staff will submit all necessary documents to Cal
OES as required for future reimbursement requests and will continue to monitor and
apply for any reimbursement funding opportunities for potentially recoverable costs.

FISCAL IMPACT
There is no immediate financial impact associated with approving the Resolution.
However, approval of the Cal OES Form 130 is required for the Town to obtain certain
disaster cost reimbursements from FEMA and the State as well as any future disasters
over the next three years.
RECOMMENDATION
Adopt Resolution No. 9-2026, approving the State of California Governor’s Office of
Emergency Services Designation of Applicant’s Agent Resolution (Cal OES Form 130).

APPROVING THE STATE OF CALIFORNIA GOVERNOR’S
OFFICE OF EMERGENCY SERVICES DESIGNATION OF
APPLICANT’S AGENT RESOLUTION (CAL OES FORM 130)
WHEREAS, in order for the Town to be eligible for future reimbursement from the
Federal or State government for costs incurred from any disaster or emergency, the Town
Council must approve a Cal OES Form 130—Designation of Applicant’s Agency
Resolution for Non-State Agencies (Form 130) authorizing certain positions to apply for
public assistance and recover funding on behalf of the Town; now, therefore be it
RESOLVED, that the Town Council of the Town of Danville does hereby approve the
Form 130, as attached here to as Exhibit 1 to this Resolution; and, be it further
RESOLVED, the Town Council designates the Emergency Services Manager, the City
Engineer and the Finance Director/Treasurer as authorized agents to obtain certain
federal financial assistance under Public Law 93-288 as amended by the Robert T. Stafford
Disaster Relief and Emergency Assistance Act of 1988, and/or state financial assistance
under the California Disaster Assistance Act, for a period not to exceed three years.
