HomeMy WebLinkAbout020326-06.6 ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council February 3, 2026 SUBJECT: Resolution No. 7-2026, approving the Amended and Restated Contra Costa Clean Water Program Agreement BACKGROUND The Town of Danville operates a local Stormwater Pollution Control Program pursuant to the federal National Pollutant Discharge Elimination System requirements under the Clean Water Act. The Town is a co-permittee under the Municipal Regional Stormwater National Pollutant Discharge Elimination System Permit issued by the San Francisco Bay Regional Water Quality Control Board. The Town of Danville has participated in the Contra Costa Clean Water Program as part of its compliance with the Municipal Regional Stormwater Permit. The Program provides coordinated administrative, technical, and regulatory support that assists the Town in meeting state and federal stormwater requirements. In September 2010, the Town Council approved participation in the Contra Costa Clean Water Program through adoption of a Program Agreement covering the period from 2010 through 2025. That agreement has since expired and has been comprehensively updated and restated to reflect current regulatory requirements and program administration practices. DISCUSSION The proposed Amended and Restated Contra Costa Clean Water Program Agreement would continue the Town’s participation in the Contra Costa Clean Water Program and establish an updated governing framework for the period beginning July 1, 2026, and continuing through June 30, 2041. The Agreement maintains the overall structure and purpose of the Program, including joint administration of group permit obligations, coordinated regulatory reporting, shared technical resources, and public education efforts. Updates to the Agreement include clarification of committee structure and membership, administrative governance provisions, and removal of responsibilities that are no longer within the scope of the Program. CCCWP Agreement 2 February 3, 2026 Town staff participated in the development of the updated Agreement and recommends approval to ensure continued coordination and efficient compliance with stormwater permit requirements. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT There is no direct fiscal impact associated with approval of the Agreement. Program costs will continue to be allocated through the annual Contra Costa Clean Water Program budget process and funded through existing stormwater program revenues, consistent with prior practice. Friedmann Development Services Director Attachment: Resolution No. 7-2026 RESOLUTION NO. 7-2026 APPROVING THE AMENDED AND RESTATED CONTRA COSTA CLEAN WATER PROGRAM AGREEMENT WHEREAS, Section 402(p) of the federal Water Pollution Control Act (CWA), as amended by the Water Quality Act of 1987, requires National Pollutant Discharge Elimination System (NPDES) permits for stormwater discharges from municipal separate storm sewer systems (MS4s); and WHEREAS, in California, the NPDES permits are issued through the California State Water Resources Control Board and the nine (9) Regional Water Quality Control Boards; and WHEREAS, the San Francisco Bay Regional Water Quality Control Boards mandated Contra Costa County, all nineteen (19) of its incorporated cities/towns and the Contra Costa County Flood Control & Water Conservation District (Flood Control District) be covered under a Joint MS4 NPDES Permit; and WHEREAS, these jurisdictions are currently covered under a Joint MS4 NPDES Permit issued by the San Francisco Bay Regional Water Quality Control Board; and WHEREAS, the Joint MS4 NPDES permit requires individual municipal implementation of stormwater best management practices to prevent or reduce pollutants in stormwater; and WHEREAS, the Joint MS4 NPDES Permit allows and encourages certain mandated activities be conducted jointly; and WHEREAS, in May 1991 the agencies covered by the Joint MS4 NPDES permit entered into a Program Agreement; and WHEREAS, the Program Agreement has minimized the costs of the mandated activities to all parties; and WHEREAS, the San Francisco Bay Regional Water Quality Control Board approved a new joint Municipal Regional Stormwater NPDES Permit (CAS612008); and WHEREAS, the Program Agreement must be updated to address changes in the Joint Municipal Regional Stormwater NPDES permit relating to Program activities, structure, membership, costs and participation; now, therefore, be it Docusign Envelope ID: 33611611-CE9B-4881-873B-665FFA201667 ATTACHMENT A PAGE 2 OF RESOLUTION NO. 7-2026 RESOLVED, that the Danville Town Council supports continued participation in the implementation of the MS4 NPDES permit by agreeing to share in Program costs, provide appropriate staff support and provide detailed information necessary to implement the permit requirements; and, be it further RESOLVED, that the Town Manager is hereby authorized on behalf of the Town Council to execute the Amended and Restated Contra Costa Clean Water Program Agreement for the period beginning July 1, 2026, and continuing through June 30, 2041.
