SUBJECT: Resolution No. 06-2026, approving a Notice of Completion for the Diablo
Vista Park Playground Renovation Project, CIP No. B-560
BACKGROUND
The Town’s Capital Improvement Program includes Diablo Vista Park Playground
Renovation Project, CIP No. B-560. The project identified the need to renovate and
modernize the playground at Diablo Vista Park to improve safety, accessibility, and overall
user experience. The project supports the Town’s ongoing efforts to reinvest in park facilities
for the community. The following work was completed with the project: demolition and
removal of existing playground equipment/surfacing and installation of new playground
equipment and play features.
DISCUSSION
The project is now complete and ready for acceptance by the Town. All work was performed
in accordance with the approved plans and specifications.
The original contract amount of $1,824,404.00 was increased by $137,418.00 as a result of
four Contract Change Orders. The change orders consisted of the addition of bid alternative
items (boulders), additional grading and concrete flatwork to accommodate ADA
requirements, parking lot curb installation, third-party playground audit, and bid item
quantity adjustments.
The final contract amount of $1,961,822.00 (contract plus change orders) is within the
authorized construction budget for this project.

FISCAL IMPACT
None. Sufficient funds are available to complete contract closeout and process final
payment, including release of retention.

RESOLUTION NO. 06-2026
APPROVING A NOTICE OF COMPLETION FOR THE DIABLO VISTA PARK
PLAYGROUND RENOVATION PROJECT, CIP NO. B-560
WHEREAS, on March 18, 2025, the Town of Danville awarded a construction contract to
Suarez and Munoz Construction, Inc. for the Diablo Vista Park Playground Renovation
Project, CIP No. B-560; and
WHEREAS, the City Engineer has determined that the work under this project has been
completed as of January 20, 2026, in accordance with the plans and specifications thereof;
and
WHEREAS, California Civil Code section 9204 specifies the requirements for recordation
of a Notice of Completion; and
WHEREAS, not less than thirty days (30) nor more than sixty (60) days after a Notice of
Completion is recorded the Town must release all undisputed retention payments to the
contractor; now, therefore, be it
RESOLVED, by the Danville Town Council that said work by and with Suarez and
Munoz Construction, Inc. is hereby accepted as complete; and, be it further
RESOLVED, that the City Clerk is hereby authorized and directed to file with the County
Recorder of the County of Contra Costa, a Notice of Completion for said project within
fifteen (15) days from the date hereof; and, be it further
RESOLVED, that undisputed retention payments be released in accordance with
Sections 8812 and 9356 of the California Civil Code.

NOTICE IS HEREBY GIVEN PURSUANT TO SECTION 9204 OF THE CALIFORNIA CIVIL
CODE:
That on the March 18, 2025, the Town of Danville (“Owner”), a public entity in the State of

and specifications. I verify, under penalty of perjury, that the foregoing is true and correct.

ATTACHMENT B
RESOLUTION NO. 19-2025
AWARDING A CONSTRUCTION CONTRACT; AND APPROPRIATING AND
TRANSFERRING FUNDS FOR THE DIABLO VISTA PARK PLAYGROUND
RENOVATION, CIP B-560
WHEREAS, the Danville Town Council has previously included Project B-560 - Diablo
Vista Park Capital Maintenance, including the Diablo Vista Park Play Area Renovation
in the Capital Improvement Program; and
WHEREAS, the Town has determined that the project is Categorically Exempt from
requirements of the California Environmental Quality Act (CEQA); and
WHEREAS, bids were solicited from contractors for the project; and
WHEREAS, the City Clerk of this Town did, in open session on the 18th day of February,
2025, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the low responsive bid was submitted by Suarez and Munoz Construction
Inc., of Hayward, California and the City Engineer recommends awarding a construction
contract to said contractor, based upon the base bid, bid alternate 1 and bid alternate 2;
and
WHEREAS, CIP B-560 currently has $1,047,282 available for construction, including
$1,000,000 in Local Fiscal Recovery Funds from the American Rescue Plan Act; leaving
an additional $959,562 required to award this contract based upon the base bid, bid
alternate 1 and bid alternate 2; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award a construction contract
for Diablo Vista Park Play Area Renovation B-560, to Suarez and Munoz Construction
Inc., of Hayward, California; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with Suarez and Munoz
Construction Inc., of Hayward, California for $1,824,404, and authorize the use of a 10%
contingency not to-exceed $182,440 for a total construction budget of $2,006,844 for work
in connection therewith, and the City Clerk is hereby directed to attest same and affix
thereto the official seal of the Town; and, be it further
RESOLVED, that the Danville Town Council hereby appropriates and transfers $959,562
to construct this project, including appropriating $363,987 in Parkland In Lieu Fees,
transferring $330,352 from CIP Project B-616 Multi-Sport Skate Park, and transferring
$265,223 from Senior Services funds; and be it further

RESOLVED, that staff shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)
