Home My WebLink About011326-05.3 ADMINISTRATIVE STAFF REPORT 5.3 TO: Mayor and Town Council January 13, 2026 SUBJECT: Resolution No. 1-2026, approving the Town’s inventory of owned and leased properties pursuant to Government Code Section 50569 and identifying any surplus land pursuant to Government Code Section 54230 BACKGROUND Government Code Section 50569 requires all local government agencies to prepare an annual inventory of all real property held, owned or controlled by the agency to determine whether any of that property is “in excess of its foreseeable needs.” Government Code Section 54230, part of the Surplus Lands Act, requires agencies to make an annual inventory of “all surplus land” owned by the agency. Section 54230 then requires each agency to report to the Department of Housing and Community Development (“HCD”) all property identified as either in excess of foreseeable needs or surplus. DISCUSSION The attached inventory (Exhibit 1 to Resolution No. 1-2026) lists all properties owned by the Town as of January 13, 2026. The Town does not lease any properties. At this time, the Town does not own any property that is either “in excess of its foreseeable needs” or is surplus, as defined in the Government Code. This will be reported to HCD as part of the Housing Element Progress Report for 2025. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT None. Ewing City Attorney Attachment: Resolution No. 1-2026 -Exhibit 1 RESOLUTION NO. 1-2026 APPROVING THE TOWN’S INVENTORY OF OWNED AND LEASED PROPERTIES PURSUANT TO GOVERNMENT CODE SECTION 50569 AND IDENTIFYING ANY SURPLUS LAND PURSUANT TO GOVERNMENT CODE SECTION 54230 WHEREAS, Government Code Section 50569 requires all local government agencies in California to annually prepare an inventory of real property held, owned or leased by the agency and to further identify whether any of those properties are “in excess of its foreseeable needs”; and WHEREAS, Government Code Section 54230, part of the Surplus Lands Act, requires every local agency to identify any properties owned or leased by the agency which are “surplus” as defined in the Government Code and to report any properties identified as either in excess of foreseeable needs or surplus to the Department of Housing and Community Development; and WHEREAS, the Town has prepared the required inventory, which is attached to this resolution as Exhibit 1 and incorporated by this reference; and WHEREAS, none of the properties identified in the inventory are in excess of the Town’s foreseeable needs nor surplus; now, therefore, be it RESOLVED, that the Danville Town Council hereby approves the attached inventory of real property owned or leased by the Town and finds that the Town has no properties in excess of its foreseeable needs or surplus.
