SUBJECT: Resolution No. 70-2025, authorizing a Professional Services Agreement with
ENGEO Incorporated for environmental consulting services during
construction of the Diablo Road Pedestrian Trail, CIP No. C-055
BACKGROUND
The Diablo Road Pedestrian Trail Project, CIP No. C-055, involves the construction of a
pedestrian/bicycle trail along Diablo Road, including removal of trees, minor regrading,
installation of hot mix asphalt, drainage improvements such as concrete v-ditches, drainage
pipes, inlets, bioretention areas, traffic control, tree replacement planting, wildlife exclusion
and cattle fencing, a drinking fountain, signs, and other related work. The design and
permitting assistance for the project was performed by ENGEO Incorporated. ENGEO’s
original scope-of-work was limited to design and environmental permitting for the project.
The scope-of-work for ENGEO’s services during and after construction was deferred until
the project advanced to the construction phase.
DISCUSSION
Now that construction is underway and work anticipated to begin in October 2025, a
contract for environmental consulting services is necessary to provide environmental
oversight including, testing, inspection, biological monitoring, and post-construction
mitigation monitoring as required by the resource agency permits, including the Lake and
Streambed Alteration Agreement (LSAA) with the California Department of Fish and
Wildlife (CDFW) and the agreement with the Regional Water Quality Control Board
(RWQCB). The proposed contract also accounts for ongoing consultation, responses to
requests for information, and other minor changes that may occur during construction.
The cost of these services amounts to $623,930.

FISCAL IMPACT
The cost of environmental consulting services to be conducted by ENGEO during
construction of the Diablo Road Trail Project, CIP C-055 is $623,930. Sufficient funding has
been appropriated within CIP C-055 for this contract.
RECOMMENDATION
Adopt Resolution No. 70-2025, authorizing a Professional Services Agreement with ENGEO
Incorporated for environmental consulting services during construction of the Diablo Road
Pedestrian Trail, CIP No. C-055.

AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH ENGEO
INCORPORATED FOR ENVIRONMENTAL CONSULTING SERVICES DURING
CONSTRUCTION OF THE DIABLO ROAD PEDESTRIAN TRAIL, CIP NO. C-055
WHEREAS, the Town entered into a Professional Services Agreement with ENGEO
Incorporated on March 8, 2024, for engineering services associated with design and
permitting for the Diablo Road Pedestrian Trail, CIP C-055; and
WHEREAS, the adopted 2025/26 Capital Improvement Program allocates sufficient
funding for CIP C-055 to account for the additional compensation limit; and
WHEREAS, the total compensation limit for the Diablo Road Pedestrian Trail, CIP C-055,
must be increased in order for ENGEO Incorporated to continue providing uninterrupted
service to the Town for construction engineering, specialized inspections, and
environmental monitoring and reporting to maintain compliance with environmental
permits; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town Manager be authorized to
execute an amendment to the Professional Services Agreement with ENGEO
Incorporated for the Diablo Road Pedestrian Trail, CIP C-055, which accounts for ongoing
consultation, responses to requests for information, and other minor changes that may
occur during construction. The cost of these services amounts to $623,930.

Description:
The Diablo Road Trail from Alameda Diablo to Tank Access Road Project is part of the North East Roadway
Improvement Assessment District (NERIAD) and consists of construction of a paved 0.9-mile Class I pedestrian/
bicycle path located adjacent to the south side of Diablo Road from Fairway Drive to the west to the tank access
road (1,200 feet west of Mt. Diablo Scenic/Blackhawk intersection) to the east. Path will connect to existing 0.5-
mile Diablo Road Trail (aka Barbara Hale) to the west and a new 0.7-mile Class I path to the east, constructed as
part of the Magee Preserve Development.
