SUBJECT: Resolution No. 69-2025, approving a Notice of Completion and construction
contract amendment for the Fiber Optic Cable Interconnect Improvements
Project, CIP No. A-620
BACKGROUND
The Town’s Capital Improvement Program includes Fiber Optic Cable Interconnect
Improvements, CIP No. A-620. This project involves the installation of a fiber optic
communication network to enhance traffic signal coordination and connectivity along key
corridors in the Town of Danville. Phase 1 of the project includes the construction of
underground fiber optic cabling, conduit systems, and associated infrastructure to support
advanced traffic management systems, and improved operational efficiency for traffic
signals and other municipal systems along the San Ramon Valley Boulevard and Hartz
Avenue Corridor. Additionally, the project scope increased to incorporate a portion of Phase
2 fiber optic connectivity upgrades to Town buildings including compatibility with modern
communication technologies - Town Offices, Town Meeting Hall, Danville Community
Center, Library, Village Theatre, and future Town Studio Arts District Maker Space.
DISCUSSION
Phase 1 of the project is now complete and ready for acceptance by the Town. All work was
performed in accordance with the approved plans and specifications.
The original contract for the Town-wide fiber project, A-620, was set at $1,194,700. Nine
change orders increased the contract by $346,627.77, resulting in a final contract amount of
$1,541,327.77. These change orders included adjustments to bid items, emergency conduit
repairs, rerouting of existing conduit, and an expanded scope to connect five downtown
buildings and the Town Offices. The final amount exceeds the original contract and its
$180,000 contingency fund by $166,627.77, necessitating an amendment to the original
contract.

FISCAL IMPACT
The proposed amendment increases St. Francis’s contract for the Fiber Optic Cable
Interconnect Improvements (CIP No. A-620) by $166,627.77, bringing the total budget for
Phase 1 to a maximum of $1,541,327.77. Funding for this amendment is fully covered by the
allocated budget in the 2025/26 Capital Improvement Program for CIP A-620.
RECOMMENDATION
Adopt Resolution No. 69-2025, approving a Notice of Completion and amendment to the
construction contract for the first phase of the Fiber Optic Cable Interconnect Improvements
Project, CIP No. A-620.

APPROVING A NOTICE OF COMPLETION AND CONSTRUCTION CONTRACT
AMENDMENT FOR THE FIBER OPTIC CABLE INTERCONNECT
IMPROVEMENTS PROJECT, CIP NO. A-620
WHEREAS, on December 17, 2024, the Town of Danville awarded a construction contract
to St. Francis for the Fiber Optic Cable Interconnect Improvements Project, CIP No. A-
620; and
WHEREAS, the project involved the installation of a fiber optic communication network
to enhance traffic signal coordination and connectivity along the San Ramon Valley
Boulevard and Hartz Avenue Corridor, including underground fiber optic cabling,
conduit systems, and additional Phase 2 connectivity upgrades to Town buildings (Town
Offices, Town Meeting Hall, Danville Community Center, Library, Village Theatre, and
future Town Studio Arts District Maker Space); and
WHEREAS, the City Engineer has determined that the work under Phase 1 of this project
has been completed as of August 15, 2025 in accordance with the approved plans and
specifications; and
WHEREAS, the original contract amount of $1,194,700 was increased by $346,627.77
through nine change orders, resulting in a final contract amount of $1,541,327.77, which
exceeds the original contract and its $180,000 contingency fund by $166,627.77,
necessitating a contract amendment; and
WHEREAS, the proposed amendment increases St. Francis’s contract by $166,627.77,
bringing the total budget for Phase 1 to a maximum of $1,541,327.77, with funding fully
covered by the allocated budget in the 2025/26 Capital Improvement Program for CIP
No. A-620; and
WHEREAS, California Civil Code section 9204 specifies the requirements for recordation
of a Notice of Completion; and
WHEREAS, not less than thirty (30) days nor more than forty-five (45) days after a Notice
of Completion is recorded, the Town must release all undisputed retention payments to
the contractor; now, therefore, be it
RESOLVED, by the Danville Town Council that said work by and with St. Francis is
hereby accepted as complete; and, be it further
RESOLVED, that the contract amendment increasing the contract amount by
$166,627.77, for a total not to exceed $1,541,327.77, is hereby approved; and, be it further

RESOLVED, that the City Clerk is hereby authorized and directed to file with the County
Recorder of the County of Contra Costa, a Notice of Completion for said project within
fifteen (15) days from the date hereof; and, be it further
RESOLVED, that undisputed retention payments be released in accordance with
Sections 8812 and 9356 of the California Civil Code.

and the Town of Danville has been completed on August 15, 2025, in accordance with plans
and specifications. I verify, under penalty of perjury, that the foregoing is true and correct.
