SUBJECT: Resolution No. 67-2025, approving a Notice of Completion for the 2024/25
Pavement Rehabilitation Project, CIP No. C-610H
BACKGROUND
This project is part of the Pavement Management Program (CIP No. C-610H). The project
completed the following work: resurfacing of aging and deteriorating pavement with an
asphalt concrete overlay, dig-out repairs, concrete curb and sidewalk repairs, installing
Americans with Disability Act (ADA) compliant sidewalk curb ramps, and traffic
striping/marking replacement in various neighborhoods throughout the Town.
DISCUSSION
The project is now complete and ready for acceptance by the Town. All work was performed
in accordance with the approved plans and specifications.
The original contract amount of $3,532,702.65 was increased by $529,999.30 as a result of 3
Contract Change Orders. The change orders consisted of bid item adjustments, additional
paving work at Woodranch Drive, installation of traffic cameras, and survey monument
restoration.
The final contract amount of $4,062,701.95 (contract plus change orders) is within the
authorized construction budget for this project.

RESOLUTION NO. 67-2025
APPROVING A NOTICE OF COMPLETION FOR THE 2024/25 PAVEMENT
REHABILITATION PROJECT, CIP NO. C-610H
WHEREAS, on March 18, 2025, the Town of Danville awarded a construction contract to
MCK Services, Inc., for the 2024/25 Pavement Rehabilitation Project, CIP No. C-610H;
and
WHEREAS, the City Engineer has determined that the work under this project has been
completed as of August 8, 2025, in accordance with the plans and specifications thereof;
and
WHEREAS, California Civil Code section 9204 specifies the requirements for recordation
of a Notice of Completion; and
WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice
of Completion is recorded the Town must release all undisputed retention payments to
the contractor; now, therefore, be it
RESOLVED, by the Danville Town Council that said work by and with MCK Services,
Inc., is hereby accepted as complete; and, be it further
RESOLVED, that the City Clerk is hereby authorized and directed to file with the County
Recorder of the County of Contra Costa, a Notice of Completion for said project within
fifteen (15) days from the date hereof; and, be it further
RESOLVED, that undisputed retention payments be released in accordance with
Sections 8812 and 9356 of the California Civil Code.

NOTICE IS HEREBY GIVEN PURSUANT TO SECTION 9204 OF THE CALIFORNIA CIVIL
CODE:
That on the March 18, 2025, the Town of Danville (“Owner”), a public entity in the State of
California, did award a construction contract to “Contractor”:

and the Town of Danville has been completed on August 8, 2025, in accordance with plans
and specifications. I verify, under penalty of perjury, that the foregoing is true and correct.

ATTACHMENT B
RESOLUTION NO. 21-2025
AWARDING A CONSTRUCTION CONTRACT FOR THE 2024/25
PAVEMENT REHABILITATION PROJECT, CONTRACT NO. C-610H
WHEREAS, the Danville Town Council has appropriated funding in the Capital
Improvement Program for the Pavement Management Program, CIP No. C-610 in the
2024/25 Capital Improvement Program; and
WHEREAS, the plans and specifications for the subject project have been reviewed and
approved by the City Engineer; and
WHEREAS, this project is categorically exempt from the requirements of the California
Environmental Quality Act, Section 15301, Class 1; and
WHEREAS, the City Clerk of this Town did, in open session on the 11 th day of March,
2025, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the lowest responsive bidder is MCK Services, Inc. of Concord, California,
and the City Engineer has recommended awarding a contract for the project to said
contractor; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award the construction
contract for the 2024/25 Pavement Rehabilitation Project, Contract No. C-610H to MCK
Services, Inc. of Concord, California; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with MCK Services, Inc.
for $3,532,702.65 and authorize use of a 15% construction contingency of $530,000 for a
total construction budget of $4,062,702.65 for work in connection therewith, and the City
Clerk is hereby directed to attest same and affix thereto the official seal of the Town; and,
be it further
RESOLVED, that the Town shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)
