Town Council – Regular Meeting SUMMARY OF ACTIONS August 12, 2025 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Morgan at 5:00 p.m. at the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Renee Morgan, Mayor Newell Arnerich, Vice Mayor Mark Belotz, Councilmember Karen Stepper, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Chris Parsons. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes. 4. FOR THE GOOD OF THE TOWN Chris Parsons, San Ramon Valley Fire Protection District, discussed current and future notification systems utilized by the District to improve community safety. Alan Kalin implored the Town Council to take action to restrict and enforce the use of e-bikes in Town. Harriet Neely requested that the Town restrict e-bike use at Osage Station Park and educate riders. Sarah Zaloumis informed the Town Council of safety issues in the location of roadway manhole covers and requested that the Town work with safety advocates. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 12, 2025 2 Chuck Preas implored the Town Council to take action to restrict and enforce the use of e-bikes in Town. 5. PROCLAMATIONS 5.1 Presentation of a proclamation proclaiming August 31, 2025, as International Overdose Awareness Day Mayor Morgan presented the proclamation. 6. CONSENT CALENDAR Item 6.6 was removed for public comment. 6.1 Consider approval of the Summary of Actions from the regular Town Council meeting of July 15, 2025 6.2 Consider approval of the Register of Demands 6.3 Consider acceptance of the June 2025 Month End Treasurer’s Report 6.4 Consider adoption of Ordinance No. 2025-02, approving Zoning Text Amendment ZTA25-0001 amending the Town’s Inclusionary Housing Ordinance 6.5 Consider adoption of Ordinance No. 2025-03, approving Zoning Text Amendment ZTA25-0002 amending the Town’s Tree Preservation Ordinance 6.6 Consider adoption of Resolution No. 55-2025, awarding a construction contract for the Diablo Road Pedestrian Trail and Drainage Improvements Project No. C-055 REMOVED FOR PUBLIC COMMENT 6.7 Consider adoption of Resolution No. 58-2025, awarding a professional services agreement for construction management and inspection services during the construction of Diablo Road Trail and Drainage Improvements Project No. C-055 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 12, 2025 3 6.8 Consider adoption of Resolution No. 59-2025, approving Minor Subdivision Map and Subdivision Improvement Agreement for Minor Subdivision 854-2024, located at 910 Podva Lane 6.9 Consider adoption of Resolution No. 60-2025, approving Major Subdivision Map and Subdivision Improvement Agreement for Major Subdivision SD 9711, located at 114 El Dorado Avenue MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 ITEM 6.6 - CONSIDER ADOPTION OF RESOLUTION NO. 55-2025, AWARDING A CONSTRUCTION CONTRACT FOR THE DIABLO ROAD PEDESTRIAN TRAIL AND DRAINAGE IMPROVEMENTS PROJECT NO. C-055 REMOVED FOR PUBLIC COMMENT City Attorney Rob Ewing presented information on the bid protest received by the Town. Mayor Morgan opened the item to public comment. Marlo Manqueros, General Counsel for Bay Cities Paving and Grading, provided the details regarding the protest of the bid results. Steven Copeland, outside Counsel for Bay Cities Paving and Grading, provided information that supports not awarding the contract to the low bidder on this project. Mayor Morgan closed the item to public comment. Mr. Ewing discussed the details of the bid process, bid documents, technical complaint, and the reason the low bid was considered qualified as submitted. He responded to questions from the Town Council. Transportation Manager Allan Shields discussed the communications with the contractors and stated that there was no direction provided by the Town to the contractors outside of the bid documents. He responded to questions from the Town Council. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 12, 2025 4 MOTION BY COUNCILMEMBER STORER, SECOND BY VICE MAYOR ARNERICH, TO ADOPT RESOLUTION NO. 55-2025, AWARDING A CONSTRUCTION CONTRACT FOR THE DIABLO ROAD PEDESTRIAN TRAIL AND DRAINAGE IMPROVEMENTS PROJECT NO. C-055 MOTION CARRIED 5-0 7. COMMUNICATIONS 7.1 Monthly Town Manager’s report by Tai Williams Tai Williams provided the report. 7.2 Communications and Economic Development Department Report by Jenn Starnes Jenn Starnes provided the report. 8. CONTINUED PUBLIC HEARINGS 8.1 Consider adoption of Resolution No. 57-2025, appointing members to the Board of Directors for the Magee Ranch Geologic Hazard Abatement District CONTINUED FROM JULY 15, 2025 City Attorney Rob Ewing presented the staff report and background information and answered questions from the Council. Mayor Morgan opened the item for public comment. Cammy Ticknor requested that the Town Council reconsider the members being recommended for appointment to the GHAD Board of Directors, presented her qualifications, and encouraged the Town Council to consider appointing her to the Board. Stephen Ticknor presented information as to the qualifications of Cammy Ticknor and encouraged the Town to appoint her to the Board. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 12, 2025 5 Christopher Cross, immediate past president of the Magee Ranch HOA, provided background information, the selection process, and future plans for appointment and election to the GHAD Board. Mayor Morgan closed the item to public comment. There was Town Council consensus to appoint the individuals that are being recommended by the Magee Ranch HOA. MOTION BY COUNCILMEMBER STORER, SECOND BY VICE MAYOR ARNERICH, TO ADOPT RESOLUTION NO. 57-2025, APPOINTING MEMBERS TO THE BOARD OF DIRECTORS FOR THE MAGEE RANCH GEOLOGIC HAZARD ABATEMENT DISTRICT MOTION CARRIED 5-0 9. TOWN COUNCIL REPORTS 9.1 Tri-Valley Transportation Council report by Mayor Morgan Mayor Morgan provided the report. 9.2 Southwest Area Transportation report by Councilmember Stepper Councilmember Stepper provided the report. 9.3 Town Council updates Councilmembers provided updates on events and activities in Danville. 10. ADJOURN TO CLOSED SESSION The regular meeting of the Danville Town Council adjourned to a closed session at 7:12 p.m. 11. CALL TO ORDER CLOSED SESSION Mayor Morgan called the closed session to order at 7:15 p.m. 11.1 Public comment DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 12, 2025 6 There were no speakers. 11.2 Closed session pursuant to Government Code Section 54957, Public Employee Performance Evaluation, Title: City Attorney 11.3 Closed Session pursuant to Government code section 54957.6, conference with Labor Negotiator; Agency Designated Representative: Mayor Renee Morgan; Unrepresented Employee: City Attorney 11.4 Report on Closed Session Mayor Morgan reported out of closed session that no action was taken. 12.
