Subject: Appointment of the Magee Ranch GHAD Board of Directors
Re: Magee Ranch Letter dated 07/22/2025
Dear Mayor and Town Council Members,
After reviewing the letter from the Magee Ranch HOA dated July 22, 2025 (Attachment F) to the
Town Lawyer, I am writing to formally request reconsideration of the proposed appointments to
the Magee Ranch Geologic Hazard Abatement District (GHAD) Board and to respectfully request
reconsideration of my candidacy for one of the five positions on the GHAD Board.
Statement: Paragraph 3 of the letter from Magee Ranch HOA states:
"From March 2024 through March 2025, only two homeowners contacted Management in
writing expressing a willingness to serve on the GHAD Board (these two persons are
recommended to be appointed to the GHAD Board)."
Statements of Fact:
Fact 1: On November 7, 2024, I received an email from the HOA Property Manager, Stacey Lint,
confirming my expressed interest in serving on the GHAD Board, along with the other two
landowners, Troy Gaspar and Keith Witz.
Further, I expressed interest at every HOA Board meeting afterward and regularly asked
for updates on the GHAD appointment progress. See attached email.
Fact 2: On March 13, 2025, before the HOA Board meeting, I sent an email to Stacey Lint with
several questions since I would be missing the meeting. On Question #5, I mentioned that
there were three (3) volunteers including me. See attached email.
Fact 3: Despite my documented interest, active engagements, commitment to attend meetings
regularly, and repeated inquiries about the appointment process, I was the only individual
omitted from the final list of nominees recommended to the Town Council for approval.
The decision to exclude me from the final list was made without any clear or documented
explanation from the HOA. The nomination process was neither transparent nor inclusive,
as there was no communication regarding why my name was removed from consideration,
especially after I had actively engaged with the HOA and Property Manager as instructed,
and expressed my consistent interest in serving on the GHAD Board. I believe this lack of
transparency undermines the fairness of the process and leaves important concerns about
the impartiality of the selection.
Statement: Paragraph 4 lists the qualifications of the Board's chosen nominees
Statements of Fact:
Fact 4: Magee Ranch GHAD is lucky to have landowners with an interest in serving on the GHAD
Board. Along with the other two landowners that volunteered per the email from Stacey
Lint, I also bring significant experience in project and contract management, owned and
operated a successful business, and worked on large-scale land improvement projects
including with the Army Reserve at Ft. Hunter Liggett, CA. Additionally, I live on a street
that was impacted by the major rainstorms and flooding over the last 10 years.
Fact 5: The nomination of Andrew Rogers, the current HOA Vice President, possesses a potential
conflict of interest and major concern for the impartiality of the GHAD Board. Andrew
Rogers is not only the current HOA Vice President, but he is also on numerous committees
including the Chairman of the Landscape Committee, serves on the Architectural
Committee, and is a legal liaison. Given his substantial influence and power, the dual role
of serving on the HOA Board while also acting as a liaison between the GHAD Board and
the HOA could create conflicts of interest and potentially undermine the independence and
impartiality of the GHAD Board's decisions.
Summary
Given my documented interest, active participation, and the lack of transparency and fairness of
the nomination process, my name should be included on list of nominees for the GHAD Board. I
believe my inclusion on the Board would contribute to its effectiveness and ensure a more
representative and inclusive approach moving forward. Moreover, I urge the Town Council to
consider the potential conflict of interest surrounding the role of the HOA Vice President, Andrew
Rogers, and ensure that the GHAD Board operates impartially, free from undue influence. With
this in consideration, I respectfully request that the Town Council reconsider and direct appoint
me as one of the five GHAD Board members.
