HomeMy WebLinkAbout071525-06.4 ADMINISTRATIVE STAFF REPORT 6.4 TO: Mayor and Town Council July 15, 2025 SUBJECT: Resolution No. 54-2025, accepting $111,521.14 from the California Highway Patrol for the Cannabis Tax Fund Grant Program, and authorizing the Town Manager to execute the Grant Program Agreement BACKGROUND In November 2016, California voters passed Proposition 64: The Adult Use of Marijuana Act. With the passage of Proposition 64, the California voters mandated the state set aside funding for the California Highway Patrol (CHP) to award grants to local governments and qualified nonprofit organizations. Per Revenue and Taxation Code Section 34019(F)(3)(B), funds will be disbursed, “To the Department of the California Highway Patrol to fund internal California Highway Patrol programs and grants to qualified nonprofit organizations and local governments for education, prevention and enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis; programs that help enforcement traffic laws, educate the public in traffic safety, provide varied and effective means of reducing fatalities, injuries and economic losses from collisions and for the purchase of equipment related to enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis.” From January 1, 2018 through December 31, 2022, Danville Police made 249 DUI arrests, 65 of which were made after an impaired driver was involved in a traffic collision. Of those 65, there were 10 that caused injuries to an involved party. In 2024, Danville Police made 83 DUI related arrests and responded to 19 DUI related traffic collisions. The Town of Danville and Danville Police Department previously participated in the Cannabis Tax Fund Grant Program for the 2023-2024, and 2024-2025 grant cycles. During those periods grant funding from this program has funded training in DUI Field Sobriety Test techniques and funded 13 DUI Saturation Patrol Events. These DUI Saturation Patrol Events resulted in 278 DUI investigative enforcement stops, 10 arrests for DUI related offenses and 1 arrest for non-DUI related offenses. The Danville Police Department has received a notice of conditional approval for the 2025- 2026 grant program funding. To be considered, the Town must adopt a Resolution accepting the award and execute the required documents. The $111,521.14 grant is a non-matching grant and no funds are required to accept and expend grant funding. Funds will be used to deploy Danville Police Department staff to reduce collisions due to impaired driving and to purchase and upfit a new traffic enforcement patrol vehicle. RECOMMENDATION Adopt Resolution No. 54-2025, accepting $111,521.14 from the California Highway Patrol for the Cannabis Tax Fund Grant Program, and authorizing the Town Manager to execute the Grant Program Agreement. Prepared by: Kevin Escover Sergeant Reviewed by: Thomas Rossberg Chief of Police Attachments: Resolution No. 54-2025 RESOLUTION NO. 54-2025 ACCEPTING $111,521.14 FROM THE CALIFORNIA HIGHWAY PATROL FOR THE CANNABIS TAX FUND GRANT PROGRAMS AND AUTHORIZING THE TOWN MANAGER TO EXECUTE THE GRANT PROGRAM AGREEMENT WHEREAS, the Town of Danville (Town) is interested in participating in the Cannabis Tax Fund Grant Program (the Grant Program), which is made available through the Control, Regulate and Tax Adult Use of Marijuana Act of 2016 (Proposition 64) and administered by the California Highway Patrol to support local law enforcement for education, prevention and enforcement of impaired driving laws in the Town; and WHEREAS, following the Town’s submittal of Grant Program application to the California Highway Patrol, the Town was awarded $111,521.14 in Grant funds; and WHEREAS, the Town is familiar with and willing and able to comply with each of the terms, conditions and limitations imposed upon the Town pursuant to the Grant in implementing education, prevention and enforcement of impaired driving laws in the Town; and WHEREAS, to be eligible to receive Grant Program funding, the Town must adopt a Resolution accepting the award and execute the required documents in relation thereto; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town Manager is hereby authorized to accept the award of Grant funds in the amount of $111,521.14 from the State of California Cannabis Tax Fund Grant Program administered by the California Highway Patrol; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager is hereby authorized to execute the Grant Fund Agreement and allocate non-matching grant funds to deploy Police Department staff to reduce collisions due to impaired driving, and to purchase and upfit a new Traffic Enforcement patrol vehicle.
