Town Council – Regular Meeting SUMMARY OF ACTIONS June 3, 2025 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Morgan and Tanveer Bedi, Mayor for the Day, at 5:00 p.m. at the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Renee Morgan, Mayor Newell Arnerich, Vice Mayor Mark Belotz, Councilmember Karen Stepper, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Danville Scout Troop 36, Rajni Chauhan, leader. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 4. FOR THE GOOD OF THE TOWN Harriet Neely expressed concern regarding the lack of ebike safety and encouraged the Town Council to take action. Brian Hughes expressed concern regarding the lack of ebike safety and disregard for posted rules at Osage Station Park. He requested for more police patrol at the park. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 3, 2025 Rick Ochoa expressed concern regarding the lack of ebike safety in and around Osage Station Park. Chuck Preas expressed concern regarding the lack of ebike safety in Danville. Diane Preas submitted a speaker card expressing opposition to ebikes. Shelley Clark, President, SRVUSD Board, stated that the Board is working to address the safety issues surrounding the use of ebikes and stated that education and enforcement is difficult and ongoing. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation of a proclamation to Barb DeBarger proclaiming June 2025 as LGBTQ Pride Month Mayor Morgan presented the proclamations. Barb DeBarger, Danville Congregational Church, expressed appreciation for the proclamation. Angie Corritone, Assistant Principal, Monte Vista High School, expressed support for the proclamation and students. Shelley Clark, President, SRVUSD Board, expressed support for the proclamation and the students in the District. 6. CONSENT CALENDAR Item 6.3 was removed for discussion; item 6.6 was removed for public comment. 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of May 20, 2025 6.2Consider approval of the Register of Demands 6.3Consider adoption of Resolution No. 33-2025, setting the Town Council meeting dates for 2026; and Resolution No. 34-2025, setting the 2026 legal holidays to be observed by the Town REMOVED FOR DISCUSSION 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 3, 2025 6.4Consider adoption of Resolution No. 35-2025, awarding a contract for Zone A – Roadside Landscape Maintenance Services and Resolution No. 36-2025, awarding a contract for Zone B – Roadside Landscape Maintenance Services   6.5Consider adoption of Resolution No. 40-2025, approving the Fiscal Year 2025/26 project list funded by Senate Bill 1: the Road Repair and Accountability Act of 2017 (S. Jones) 6.6Consider adoption of Resolution No. 37-2025, approving the display of the Rainbow Flag during the month of June 2025 REMOVED FOR PUBLIC COMMENT 6.7Consider adoption of Resolution No. 41-2025, authorizing an extension and amendment of the Encroachment Permit/Right-of-Entry Agreement with the Pacific Coast Farmers’ Market Association MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STEPPER, TO APPROVE THE CONSENT CALENDAR, WITH THE EXCEPTION OF ITEMS 6.3 AND 6.6 MOTION CARRIED 5-0 ITEM 6.3 - CONSIDER ADOPTION OF RESOLUTION NO. 33-2025, SETTING THE TOWN COUNCIL MEETING DATES FOR 2026; AND RESOLUTION NO. 34-2025, SETTING THE 2026 LEGAL HOLIDAYS TO BE OBSERVED BY THE TOWN REMOVED FOR DISCUSSION Councilmember Stepper questioned Town Council meeting dates that may conflict with Planning Commission meetings in 2026. City Clerk Marie Sunseri stated that the Town Council first selects meeting dates, followed by Town Commissions and Boards, and ensured the Town Council that meeting dates will not conflict in 2026. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 3, 2025 MOTION BY COUNCILMEMBER STEPPER, SECOND BY VICE MAYOR ARNERICH, TO ADOPT RESOLUTION NO. 33-2025, SETTING THE TOWN COUNCIL MEETING DATES FOR 2026; AND RESOLUTION NO. 34-2025, SETTING THE 2026 LEGAL HOLIDAYS TO BE OBSERVED BY THE TOWN MOTION CARRIED 5-0 ITEM 6.6 – CONSIDER ADOPTION OF RESOLUTION NO. 37-2025, APPROVING THE DISPLAY OF THE RAINBOW FLAG DURING THE MONTH OF JUNE 2025 REMOVED FOR PUBLIC COMMENT Mayor Morgan opened the item to public comment. Angie Corritone expressed support for the Resolution. Kathy Chiverton submitted a speaker card in support of the Resolution. Mayor Morgan closed the item to public comment. MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO ADOPT RESOLUTION NO. 37-2025, APPROVING THE DISPLAY OF THE RAINBOW FLAG DURING THE MONTH OF JUNE 2025 MOTION CARRIED 5-0 7. TOWN MANAGER’S REPORT 7.1 Monthly Town Manager’s report by Joe Calabrigo Joe Calabrigo provided the report. 8. ADMINISTRATIVE STAFF REPORTS 8.1Consider adoption of Resolution No. 38-2025, declaring results of the property owner protest ballot proceedings, approving the final Engineer’s report, order the formation of Landscaping and Lighting Assessment District 2025-1, and confirming diagram and the levy of assessments for Fiscal Year 2025/26 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 3, 2025 Maintenance Services Director Dave Casteel presented the staff report. Mayor Morgan opened the item to public comment. There were no speakers. Mayor Morgan closed the item to public comment. MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO ADOPT RESOLUTION NO. 38-2025, DECLARING RESULTS OF THE PROPERTY OWNER PROTEST BALLOT PROCEEDINGS, APPROVING THE FINAL ENGINEER’S REPORT, ORDER THE FORMATION OF LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT 2025-1, AND CONFIRMING DIAGRAM AND THE LEVY OF ASSESSMENTS FOR FISCAL YEAR 2025/26 MOTION CARRIED 5-0 8.2Consider adoption of Resolution No. 39-2025, appointing Tai J. Williams as Town Manager and approving an Employment Agreement City Attorney Rob Ewing presented the staff report. Mayor Morgan stated that the Brown Act requires that, before any agreement specifying salary or compensation for the Town Manager can become effective, the Town Council must verbally summarize those changes. Resolution No. 39-2025, would approve an employment agreement for our new Town Manager, Tai Williams. The agreement contains the following terms: the term of the agreement is for two years, from July 1, 2025 until June 30, 2027; in year one of the agreement, salary would be $265,000 and fringe benefits would be equal to $83,700, which consists of $79,500 in pension contribution and an auto allowance of $4,200; in year two of the agreement, the Manager would be eligible for consideration of a performance based increase in compensation based upon her annual evaluation. Any such change would be approved by the Town Council by a resolution adopted at a publicly noticed Town Council meeting. Because the Town has a defined contribution pension plan, there are no future, unfunded liabilities associated with the agreement. 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 3, 2025 Mayor Morgan opened the item to public comment. TOWN COUNCIL REPORTS 9.1Town Council updates Councilmembers provided updates on events and activities in Danville. 10.
