HomeMy WebLinkAbout052025-06.5 ADMINISTRATIVE STAFF REPORT 6.5 TO: Mayor and Town Council May 20, 2025 SUBJECT: Resolution No. 27-2025, authorizing town staff to mark the curb in front of parallel parking spaces with red paint where parking is banned under AB 413 Daylighting Law in downtown Danville BACKGROUND California recently passed Assembly Bill (AB) 413 (enacted as CA Vehicle Code section 22500 (n)(1)(A)), or the “daylighting” law, which prohibits parking within 20 feet of the vehicle approach side of any marked or unmarked crosswalk or within 15 feet of any crosswalk where a curb extension is present. California Vehicle Code Section 275 defines a crosswalk as either: (a) That portion of a roadway included within the prolongation or connection of the boundary lines of sidewalks at intersections where the intersecting roadways meet at approximately right angles, except the prolongation of such lines from an alley across a street; or (b) Any portion of a roadway distinctly indicated for pedestrian crossing by lines or other markings on the surface. Daylighting enhances traffic safety by clearing parked cars and obstructions near crosswalks, improving drivers' visibility of pedestrians. AB 413, effective January 1, 2024, allowed only warnings for violations until citations began on January 1, 2025. In downtown Danville, many previously available parking spaces at both marked and unmarked crosswalks became no-parking zones due to the new law. DISCUSSION In downtown Danville, many areas already have engineering treatments like bulb-outs or red-painted curbs defining no-parking zones in alignment with AB 413. Staff identified 17 curb sections at 12 downtown locations (Attachment B) lacking such treatments, needing red paint or signs to indicate the new no-parking rules under AB 413: 1.
