TO: Mayor and Town Council May 20, 2025
SUBJECT: Resolution No. 32-2025, accepting a Grant of Pedestrian Access Easement
at 301 Hartz Avenue (APN 199-350-019)
BACKGROUND AND DISCUSSION
On November 26, 2019, the Town’s Planning Commission approved Development Plan
DEV19-0011, authorizing construction of additional square footage, façade improvements
and a public plaza at 301 Hartz Avenue, commonly known as the Clocktower commercial
center. Conditions of approval required dedication of a pedestrian access easement over
the public plaza area. The property owner has executed the necessary document to
memorialize the easement being granted to the Town.

None.
RECOMMENDATION
Adopt Resolution No. 32-2025, accepting a Grant of Pedestrian Access Easement at 301
Hartz Avenue (APN 199-350-019).

RESOLUTION NO. 32-2025
ACCEPTING A GRANT OF PEDESTRIAN ACCESS EASEMENT
AT 301 HARTZ AVENUE (APN 199-350-019)
WHEREAS, on November 26, 2019, the Town’s Planning Commission approved
Development Plan DEV19-0011, authorizing construction of additional square footage,
façade improvements and a public plaza at 301 Hartz Avenue, commonly known as the
Clocktower commercial center; and
WHEREAS, conditions of approval for the project required dedication of a pedestrian
access easement over the public plaza area; and
WHEREAS, the property owner has executed a Grant of Pedestrian Access Easement to
memorialize the easement; and
WHEREAS, action by the Town Council is necessary to accept the easement; now,
therefore, be it
RESOLVED, that the Danville Town Council hereby accepts the Grant of Pedestrian
Access Easement at 301 Hartz Avenue (APN 199-350-019); and be if further
RESOLVED, that the City Clerk is hereby directed to attach a Certificate of Acceptance
to the easement document and have it recorded at the Contra Costa County Recorder’s
Office.
