Town Council – Regular Meeting SUMMARY OF ACTIONS March 18, 2025 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Morgan at 5:00 p.m. at the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Renee Morgan, Mayor Newell Arnerich, Vice Mayor Mark Belotz, Councilmember Karen Stepper, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance was led by Beverly Lane. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 4. FOR THE GOOD OF THE TOWN Mark Shaffer expressed concern regarding operation of a police vehicle on a one- way street. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation of a proclamation to Alexandria Rubio-Talavera proclaiming March 2025 as National Disabilities Awareness Month Mayor Morgan presented the proclamation. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 18, 2025 5.2Presentation of a proclamation to Beverly Lane proclaiming March 2025 as Women’s History Month Mayor Morgan presented the proclamation. 6. CONSENT CALENDAR Vice Mayor Arnerich removed item 6.9 for discussion. 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of March 4, 2025 6.2Consider approval of the Register of Demands 6.3Consider acceptance of the January 2025 Month End Treasurer’s Report 6.4Consider adoption of Resolution No. 15-2025, appropriating funding for the November 2024 municipal election 6.5Consider adoption of Resolution No. 16-2025, approving out-of-state travel to attend the Annual Tri-Valley Cities Federal Advocacy Trip in Washington, D.C., April 29 - May 2, 2025 6.6Consider adoption of Resolution No. 17-2025, accepting CalRecycle Beverage Container Recycling City/County Payment Program funds and appropriating $22,185 to support activities throughout the Town 6.7Consider adoption of Resolution No. 18-2025, receiving and accepting the Housing Element Annual Progress Report and General Plan Annual Progress Report for 2024 6.8Consider adoption of Resolution No. 19-2025, awarding a construction contract; and appropriating and transferring funds for the Diablo Vista Park Playground Renovation, CIP B-560 6.9Consider adoption of Resolution No. 20-2025, awarding a construction contract for the Diablo Vista Park Multi-Sport Skate Park, CIP B-616 REMOVED FOR DISCUSSION 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 18, 2025 6.10Consider adoption of Resolution No. 21-2025, awarding a construction contract for the 2024/25 Pavement Rehabilitation Project, Contract No. C- 610H MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO APPROVE THE CONSENT CALENDAR; WITH THE EXCEPTION OF ITEM 6.9 COUNCILMEMBER STEPPER REQUESTED THAT THE MOTION BE RECONSIDERED MAYOR MORGAN ASKED IF A MEMBER OF THE MAJORITY OF THE EARLIER MOTION WOULD LIKE TO RECONSIDER RECONSIDERATION OF THE ORIGINAL MOTION FAILED DUE TO LACK OF A MOTION MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO APPROVE THE CONSENT CALENDAR; WITH THE EXCEPTION OF ITEM 6.9 MOTION CARRIED 4-1; COUNCILMEMBER STEPPER OPPOSED ITEM 6.9 – CONSIDER ADOPTION OF RESOLUTION NO. 20-2025, AWARDING A CONSTRUCTION CONTRACT FOR THE DIABLO VISTA PARK MULTI-SPORT SKATE PARK, CIP B-616 REMOVED FOR DISCUSSION The Town Council asked clarifying questions regarding the proposed skate park. Town Manager Joe Calabrigo responded to questions. Mayor Morgan opened the item to public comment. The following individuals expressed support for the skate park proposed for Diablo Vista Park: Kate Jones Sophie Meyer Bruce Bilodeau Sarah Myers 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 18, 2025 Katrina and Carter Broome Lucas Moreno Kate Larson Amber Huete The following individual submitted a speaker card in support of the skate park proposed for Diablo Vista Park and did not address the Town Council: Lee Halverson The following individuals expressed opposition to the skate park as proposed for Diablo Vista Park: Jacqui Carter Bob Esposito Jim Liu The following individual submitted a speaker card in opposition of the skate park proposed for Diablo Vista Park and did not address the Town Council: Susan Esposito Mayor Morgan closed the item to public comment. Vice Mayor Arnerich questioned if bicycles and scooters would operate in the skate park at the same time. City Attorney Rob Ewing stated that signs would need to be posted indicating the rules regarding the operation of bicycles and scooters, with possible separate timeframes. Councilmember Stepper discussed current skate park rules, activities and reasons she feels the skate park is important for the community. Vice Mayor Arnerich provided a historical evolution of proposing a skate park in Danville, including legal aspects. He stated that popularity and potential use of a skate park has waned over the years, Danville funds are needed for other projects, and he expressed opposition to the Resolution. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 18, 2025 Councilmember Storer discussed project funding, prioritization of Danville projects, and expressed opposition to the Resolution. Councilmember Belotz discussed the rise in popularity of e-bikes and e-scooters, the decrease in skateboard popularity, and expressed opposition to the Resolution. Mayor Morgan questioned the amenities planned for the play area at Diablo Vista Park. Town Manager Joe Calabrigo and Landscape Architect Bob Russell discussed the design of the play area proposed for Diablo Vista Park and the amenities and opportunities for visitors with a broad range of ages and abilities. Councilmember Stepper expressed her disappointment in the lack of Town Council support for the Resolution. MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STORER, TO ADOPT MODIFIED RESOLUTION NO. 20-2025, REJECTING ALL BIDS FOR A CONSTRUCTION CONTRACT FOR THE DIABLO VISTA PARK MULTI-SPORT SKATE PARK, CIP B-616 MOTION CARRIED 4-1; COUNCILMEMBER STEPPER OPPOSED 7. COMMUNICATIONS 7.1Quarterly Police Department Report by Danville Police Chief Tom Rossberg Chief Rossberg provided the quarterly report. 7.2Monthly Legislative update by Management Analyst Cat Bravo Cat Bravo provided the update. 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 18, 2025 8. ADMINISTRATIVE STAFF REPORTS 8.1Consider adoption of Resolution No. 22-2025, preliminarily approving the Engineer’s Report, declaring intent to form Danville Landscaping and Lighting Assessment District No. 2025-1 and levy and collect assessments for Fiscal Year 2025/26, and setting May 20, 2025, as the date for the public hearing Maintenance Services Director Dave Casteel presented the staff report and introduced Ed Espinoza, Francisco and Associates, who was attending virtually and available to answer any questions. Mayor Morgan opened the item to public comment. There were no speakers. Mayor Morgan closed the item to public comment. MOTION BY COUNCILMEMBER STORER, SECOND BY COUNCILMEMBER BELOTZ, TO ADOPT RESOLUTION NO. 22-2025, PRELIMINARILY APPROVING THE ENGINEER’S REPORT, DECLARING INTENT TO FORM DANVILLE LANDSCAPING AND LIGHTING ASSESSMENT DISTRICT NO. 2025-1 AND LEVY AND COLLECT ASSESSMENTS FOR FISCAL YEAR 2025/26, AND SETTING MAY 20, 2025, AS THE DATE FOR THE PUBLIC HEARING MOTION CARRIED 5-0 9. TOWN COUNCIL REPORTS 9.1Appoint two members to the Bicycle Advisory Commission to fulfill terms ending June 30, 2026 MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STEPPER, TO APPOINT RYAN OZIMEK AND TIMOTHY WHITE TO THE BICYCLE ADVISORY COMMISSION TO FULFILL TERMS ENDING JUNE 30, 2026 MOTION CARRIED 5-0 6 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MARCH 18, 2025 9.2Town Council updates Councilmembers provided updates on events and activities in Danville. 10.
