SUBJECT: Resolution No. 19-2025, awarding a construction contract; and
appropriating and transferring funds for the Diablo Vista Park
Playground Renovation, CIP B-560
BACKGROUND
The Capital Improvement Program (CIP) includes CIP Project B-560 which would replace
and upgrade the existing children’s play area at Diablo Vista Park. Originally scheduled
to be replaced during the 2022/23 fiscal year, the project was deferred pending a
determination of the overall project scope. The age and condition of the existing play
area are such that this feature warrants prompt attention.
The project improvements feature an updated play area with a variety of play features
for both older and younger children as well as those with limited mobility. The park’s
iconic elements such as the ‘snake’ feature and existing hill allowing a southern view are
preserved. CIP Project B-616, which would construct a multi-sport skate park, is a
separate project which would be located adjacent to the play area.
In 2021, CIP projects B-560 and B-616 were combined to proceed with design and
construction. This combined project approach was pursued because the children’s play
area and skate park sites are located adjacent to one another, and it presented an
opportunity to achieve economies of scale and more favorable construction bids.
Construction bids were solicited in Spring 2024. Only two bids were received. After
considering all the information presented, the Town Council rejected both bids at their
July 2, 2024, meeting.
The Town Council subsequently opted to proceed with re-bidding and constructing the
two projects separately. On January 16, 2025, the Town issued a call for bids for CIP B-
560 – Diablo Vista Park Playground Renovation.
DISCUSSION
Thirteen bids were received and opened on February 18, 2025. The lowest bid was
submitted by Suarez and Munoz Construction Inc., of Hayward, California, with a base
bid of $1,583,292. Three alternate bid items were also included as a part of the bid
package. The bid alternate items included:

Bid results are summarized in Attachment B.
The following table summarizes the engineer’s estimate, bid plus contingency costs for
the base bid and the three bid alternates:

At a special meeting held on March 5, 2025, the Senior Advisory Commission
recommended the inclusion of bid alternates 1 and 2 which would provide a shade
structure and fitness equipment for active adults and seniors. The commission further
recommended allocating previously reserved Senior Services Funds to cover the
additional cost plus contingency amounts for both bid alternates.
This report recommends awarding the construction contract to Suarez and Munoz
Construction Inc., of Hayward, California.
The cost for the base project plus bid alternate 1 and bid alternate 2 totals $1,824,404, plus
a 10% contingency amount of $182,440 yields a total construction budget of $2,006,844.
PUBLIC CONTACT
Posting of the meeting agenda serves as notice to the general public. Before construction
begins, residents within proximity to the project will be notified by the contractor in
writing. In addition, project identification signs will be posted together with changeable
message boards.
FISCAL IMPACT
The low bid amount of $1,583,292 plus bid alternate 1 and bid alternate 2 which includes
a shade structure and fitness equipment for adults and seniors in the amount of $241,112,
totals $1,824,404, plus a 10% contingency amount of $182,440 yields a total construction
budget of $2,006,844.

Diablo Vista Park Playground Renovation
CIP B-560 currently has $1,047,282 available for construction, including $1,000,000 in
Local Fiscal Recovery Funds from the American Rescue Plan Act. An additional $959,562
is required to award this contract. The following appropriations and transfers are
recommended to fully fund the project and award a contract to Suarez and Munoz
Construction Inc.

RESOLUTION NO. 19-2025
AWARDING A CONSTRUCTION CONTRACT; AND APPROPRIATING AND
TRANSFERRING FUNDS FOR THE DIABLO VISTA PARK PLAYGROUND
RENOVATION, CIP B-560
WHEREAS, the Danville Town Council has previously included Project B-560 - Diablo
Vista Park Capital Maintenance, including the Diablo Vista Park Play Area Renovation
in the Capital Improvement Program; and
WHEREAS, the Town has determined that the project is Categorically Exempt from
requirements of the California Environmental Quality Act (CEQA); and
WHEREAS, bids were solicited from contractors for the project; and
WHEREAS, the City Clerk of this Town did, in open session on the 18th day of February,
2025, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, the low responsive bid was submitted by Suarez and Munoz Construction
Inc., of Hayward, California and the City Engineer recommends awarding a construction
contract to said contractor, based upon the base bid, bid alternate 1 and bid alternate 2;
and
WHEREAS, CIP B-560 currently has $1,047,282 available for construction, including
$1,000,000 in Local Fiscal Recovery Funds from the American Rescue Plan Act; leaving
an additional $959,562 required to award this contract based upon the base bid, bid
alternate 1 and bid alternate 2; now, therefore, be it
RESOLVED, by the Danville Town Council, that the Town award a construction contract
for Diablo Vista Park Play Area Renovation B-560, to Suarez and Munoz Construction
Inc., of Hayward, California; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with Suarez and Munoz
Construction Inc., of Hayward, California for $1,824,404, and authorize the use of a 10%
contingency not to-exceed $182,440 for a total construction budget of $2,006,844 for work
in connection therewith, and the City Clerk is hereby directed to attest same and affix
thereto the official seal of the Town; and, be it further
RESOLVED, that the Danville Town Council hereby appropriates and transfers $959,562
to construct this project, including appropriating $363,987 in Parkland In Lieu Fees,
transferring $330,352 from CIP Project B-616 Multi-Sport Skate Park, and transferring
$265,223 from Senior Services funds; and be it further

RESOLVED, that staff shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)

Recreation, and Arts system.
2018/19: Study for potential locations will include search for a location
and a conceptual design. (COMPLETE)
