Town Council – Regular Meeting and Closed Session SUMMARY OF ACTIONS February 4, 2025 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Morgan at 5:00 p.m. at the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Renee Morgan, Mayor Newell Arnerich, Vice Mayor Mark Belotz, Councilmember Karen Stepper, Councilmember Robert Storer, Councilmember 2.PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance was led by Dave Clark. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 4. FOR THE GOOD OF THE TOWN There were no speakers. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation of a proclamation to Shanelle Scales-Preston, Contra Costa County Supervisor District 5, proclaiming February 2025 as Black History Month Mayor Morgan presented proclamations to Dave and Lucretia Clark, and Shanelle Scales-Preston, Contra Costa County Supervisor District 5. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 4, 2025 6. CONSENT CALENDAR 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of January 14, 2025 6.2Consider approval of the Register of Demands 6.3Consider adoption of Resolution No. 3-2025, approving Minor Subdivision MS 852-2019 and accepting the public improvements and dedications for a two-lot subdivision located at 2434 Tassajara Lane 6.4Consider adoption of Resolution No. 4-2025, accepting a Grant of Public Trail Access Easement for Public Trail Access located at 2434 Tassajara Lane 6.5Consider adoption of Resolution No. 5-2025, awarding a professional services agreement for engineering design services and appropriating additional funding for Iron Horse Trail Crossing Improvements, CIP Project C-607 6.6Consider adoption of Resolution No. 6-2025, authorizing an amended professional services agreement for engineering services for Diablo Road Pedestrian Trail Project C-055 6.7Consider adoption of Resolution No. 7-2025, initiating formation of Danville Landscaping and Lighting Assessment District No. 2025-1 and ordering preparation of the required Engineer’s Report pursuant to the Landscaping and Lighting Act of 1972 and Section 4 of Article XIIID of the California Constitution MOTION BY COUNCILMEMBER STORER, SECOND BY VICE MAYOR ARNERICH, TO APPROVE THE CONSENT CALENDAR Councilmember Stepper expressed the importance of the Landscaping and Lighting Assessment District. MOTION CARRIED 5-0 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 4, 2025 7. TOWN MANAGER’S REPORT 7.1 Monthly Town Manager’s report by Joe Calabrigo Joe Calabrigo provided the report on the Landscaping and Lighting Assessment District. 8. COMMUNICATIONS 8.1Recruitment announcement by City Clerk Marie Sunseri for 20 positions open to Danville residents interested in volunteering City Clerk Marie Sunseri announced the following recruitments: a.Bicycle Advisory Commission: 2 regular members b.Heritage Resource Commission: 2 regular members; 1 licensed architect c.Parks, Recreation and Arts Commission: 4 regular members; 1 alternate d.Youth members: 1 Parks, Recreation and Arts Commission 1 Arts Advisory Board e.Senior Advisory Commission: 3 regular members f.Design Review Board: 1 regular member g.Danville Poet Laureate: 1 h.Youth Poet: 1 i.Contra Costa County Advisory Council on Aging: 1 representative j.Contra Costa Transportation Authority Citizens Advisory Committee: 1 representative 9. PUBLIC HEARINGS 9.1Consider adoption of Resolution No. 8-2025,approving the issuance of the California Municipal Finance Authority Exempt Facility Bonds in an aggregate principal amount not to exceed $30,000,000 for the purpose of financing or refinancing the acquisition, construction, improvement and equipping of Walnut Apartments and certain other matters relating thereto City Attorney Rob Ewing presented the staff report. Mayor Morgan opened the item to public comment. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 4, 2025 Ramon Amaral, NorCal Carpenters Union, expressed the importance of affordable housing and opposed the project in its current form due to pay and labor standards. Mayor Morgan closed the item to public comment. Vice Mayor Arnerich questioned whether prevailing wage applies to the Finance Authority. Mr. Ewing stated there was no condition of approval on this project and there is no Town requirement for prevailing wage. MOTION BY COUNCILMEMBER STORER, SECOND BY COUNCILMEMBER BELOTZ, TO ADOPT RESOLUTION NO. 8-2025, APPROVING THE ISSUANCE OF THE CALIFORNIA MUNICIPAL FINANCE AUTHORITY EXEMPT FACILITY BONDS IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $30,000,000 FOR THE PURPOSE OF FINANCING OR REFINANCING THE ACQUISITION, CONSTRUCTION, IMPROVEMENT AND EQUIPPING OF WALNUT APARTMENTS AND CERTAIN OTHER MATTERS RELATING THERETO MOTION CARRIED 5-0 10. ADMINISTRATIVE STAFF REPORTS 10.1Consider adoption of Resolution No. 9-2025, authorizing Community Events Support for Calendar Year 2025; and, Resolution No. 10-2025, authorizing Exemption from Danville Ordinance No. 96-10 for Veterans Memorial Building 100 Anniversary on March 30, 2025, Ridge Hike for th Prevention on April 27, 2025, Danville d’Elegance on September 21, 2025, and Oktoberfest Danville on October 5, 2025 Economic Development Specialist Melysa Vander Mel presented the staff report. MOTION BY COUNCILMEMBER STEPPER, SECOND BY VICE MAYOR ARNERICH, TO ADOPT RESOLUTION NO. 9-2025, AUTHORIZING COMMUNITY EVENTS SUPPORT FOR CALENDAR YEAR 2025; AND, RESOLUTION NO. 10-2025, AUTHORIZING EXEMPTION FROM DANVILLE ORDINANCE NO. 96-10 FOR VETERANS MEMORIAL BUILDING 100 ANNIVERSARY ON MARCH 30, 2025, TH RIDGE HIKE FOR PREVENTION ON APRIL 27, 2025, DANVILLE D’ELEGANCE ON SEPTEMBER 21, 2025, AND OKTOBERFEST DANVILLE ON OCTOBER 5, 2025 MOTION CARRIED 5-0 11. TOWN COUNCIL REPORTS 11.1Appoint Planning Commission representative to the Heritage Resource Commission MOTION BY COUNCILMEMBER STEPPER, SECOND BY VICE MAYOR ARNERICH, TO APPOINT IAN HALKER AS PLANNING COMMISSION REPRESENTATIVE TO THE HERITAGE RESOURCE COMMISSION TO FULFILL TERM ENDING DECEMBER 31, 2026 MOTION CARRIED 5-0 11.2Southwest Area Transportation report by Councilmember Stepper Councilmember Stepper provided the report. 11.3Tri Valley Transportation Council report by Mayor Morgan Mayor Morgan provided the report. 11.4Town Council updates Councilmembers provided updates on events and activities in Danville. 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 4, 2025 12. ADJOURN TO CLOSED SESSION The regular meeting of the Danville Town Council adjourned at 5:56 p.m. to a publicly noticed closed session. 13. CALL TO ORDER CLOSED SESSION The closed session was called to order at 5:57 p.m. 13.1Public comment There were no public comments. 13.2Closed Session - CONFERENCE WITH LEGAL COUNSEL-- ANTICIPATED LITIGATION - Initiation of litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: (One potential case) 13.3Report on Closed Session Mayor Morgan reported out of Closed Session that direction to initiate an action was given and the action, the defendants, and the other particulars shall, once formally commenced, be disclosed to any person upon inquiry. 14.
