HomeMy WebLinkAbout020425-06.6 ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council February 4, 2025 SUBJECT: Resolution No. 6-2025, authorizing an amended professional services agreement for engineering services for Diablo Road Pedestrian Trail Project C-055 BACKGROUND The Town’s Capital Improvement Program (CIP) includes the Diablo Road Trail from Alameda Diablo to Tank Access Road, CIP Project C-055. This project consists of the construction of a paved 0.9-mile Class I pedestrian/bicycle path located adjacent to the south side of Diablo Road from Fairway Drive to the west of the tank access road (1,200 feet west of Mt. Diablo Scenic/Blackhawk intersection) to the east. The environmental assessment and preliminary design phases of the Diablo Road Trail have been successfully completed. In Spring 2023, the Town submitted applications for environmental permits to both state and regional regulatory agencies, such as the California Department of Fish & Wildlife (CDFW) and Regional Water Quality Control Board (RWQCB). To advance the project expeditiously, it has become necessary to engage an engineering design firm with the expertise available to re-survey the affected area, update the design of the trail’s retaining wall system to accommodate the creek bank erosion and develop a detailed response that addresses CDFW concerns. ENGEO, Inc. was previously contracted to complete a geohazard analysis and structural design associated with the retaining walls required to complete the western portion of the trail. The Town extends ENGEO, Inc. services to assist in completing the remaining civil engineering design and environmental mitigation plan, finalizing the California Department of Fish & Wildlife and Regional Water Quality Control Board permits, and production of the construction bid documents. The preliminary design of the new trail segment component is complete and is currently in the environmental review phase. In preparation for the bidding and construction of the trail project, there are trees within the trail alignment that must be removed before the start of protected birds nesting period and before the project will be ready to bid. Diablo Road Pedestrian Trail CIP C-055 2 February 4, 2025 DISCUSSION ENGEO, Inc. has been providing professional services to the Town for this project. To proceed with tree removal along Diablo Road, and to complete the proposed trail improvements design, it will be necessary to revise the scope of work for the project. The revised scope of work will include required contractor training, pre-construction surveys and biological monitoring in conformance with the project Lake and Streambed Alteration Agreement (LSAA) for the tree removal contract. Additionally, the consultant will prepare information describing the geotechnical constraints for ADA compliance and final wall plans that will provide value engineering to several sections of the walls to maximum extent possible. ENGEO, Inc. has been providing professional services to the Town for this project. The cost to revise the professional services agreement is $107,950. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT The amount for the amended professional services agreement is $107,950. An additional 10% design contingency in the amount of $10,795 will be reserved for a total design budget of $118,745. Sufficient funds have been appropriated in the Town’s 2024-2025 Capital Improvement Program to cover the cost of revised professional services. FOR THE DIABLO ROAD PEDESTRIAN TRAIL CIP C-055 PROJECT WHEREAS, the Town previously entered into a professional services agreement with ENGEO, Inc., for projects Diablo Road Pedestrian Trail, CIP C-055 project; and WHEREAS, the Danville Town Council previously appropriated funding for Diablo Road Pedestrian Trail, CIP C-055 project, in the adopted 2023/24 Capital Improvement Program; and WHEREAS, the Town submitted applications for environmental permits to both state and regional regulatory agencies, such as the California Department of Fish & Wildlife (CDFW) and Regional Water Quality Control Board (RWQCB); and WHEREAS, it has become necessary to engage an engineering design firm with the expertise available to re-survey the affected area, update the design of the trail’s retaining wall system to accommodate the creek bank erosion and develop a detailed response that addresses CDFW concerns; and WHEREAS, the Town desires to continue professional services with ENGEO Inc., of San Ramon, CA to continue with the design documents for the Diablo Road Pedestrian Trail, CIP C-055 project; now, therefore, be it RESOLVED, by the Danville Town Council that the Town Manager be and hereby is authorized to execute on behalf of the Town, the Professional Services Agreement with ENGEO Inc., of San Ramon, CA, with a not-to-exceed budget of $107,950, and that the Town Manager be authorized to establish and utilize a 10% design contingency in the amount of $10,795 for additional work that may be subsequently approved by contract amendment, for a total of $118,745. PROJECT APPROPRIATION AND FUNDING Project is part of the North East Roadway Improvement Assessment District (NERIAD) and consists of construction of a paved 0.9-mile Class I pedestrian/bicycle path located adjacent to the south side of Diablo Road from Fairway Drive to the west to the tank access road (1,200 feet west of Mt. Diablo Scenic/Blackhawk intersection) to the east. Path will connect to exisitng 0.5-mile Diablo Road (aka Barbara Haile) Trail to the west and a new 0.7-mile Class I path to the east that will be constructed as part of the Magee Preserve Development. Funding plan is completed with reallocation of Measure J program funds from C-578, C-598, C-600 and C-602.
