HomeMy WebLinkAbout020425-06.4 ADMINISTRATIVE STAFF REPORT 6.4 TO: Mayor and Town Council February 4, 2025 SUBJECT: Resolution No. 4-2025, accepting a Grant of Public Trail Access Easement for Public Trail Access located at 2434 Tassajara Lane BACKGROUND On October 26, 2021, the Planning Commission approved Minor Subdivision MS 852- 2019, a two lot Minor Subdivision allowing for one additional parcel located at 2434 Tassajara Lane. Approval of the final subdivision map is contained in a separate item on this agenda. Conditions of approval required the applicant to construct and extend the existing Sycamore Creek Pedestrian Trail along the creek through the subdivision and connecting to Tassajara Lane. In order to connect to Tassajara Lane, the trail must cross a portion of a parcel owned by the Tamarind Homeowners Association. The Tamarind Homeowners Association has graciously offered an easement to allow for the completion of this segment of the trail. The Town of Danville must accept the easement to allow the construction of the public trail to allow public access. DISCUSSION The Grant of Public Trail Access Easement has been executed by Robert Culin, board member of the Tamarind Homeowners Association. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT The Town will be responsible for approximately 250 linear feet of public trail maintenance at a fiscal impact of $145.00. Friedmann Development Services Director Attachments: A – Resolution No. 4-2025 B – Grant of Public Trail Access Easement C – Location Map RESOLUTION NO. 4-2025 ACCEPTING A GRANT OF PUBLIC TRAIL ACCESS EASEMENT FOR PUBLIC TRAIL ACCESS LOCATED AT 2434 TASSAJARA LANE WHEREAS, the Town’s General Plan encourages the extension and completion of the Sycamore Creek Trail; and WHEREAS, the Tamarind Homeowners Association has executed a Grant of Public Trail Access Easement offered to the Town allowing for construction of an extension of the Sycamore Creek Trail and memorializing the public’s right to utilize the public trail; and WHEREAS, action by the Town Council is necessary to accept the easement; now, therefore, be it RESOLVED, that the Danville Town Council accepts the Grant of Easement of Public Trail Access Easement, as executed by the Tamarind Homeowners Association; and, be it further RESOLVED, that the City Clerk is hereby directed to attach a Certificate of Acceptance to the easement document and have it recorded at the Contra Costa County Recorder’s Office.
