SUBJECT: Resolution No. 1-2025, awarding a construction contract for tree removal
for Diablo Road Trail, CIP C-055
BACKGROUND
The Town’s Capital Improvement Program (CIP) includes the Diablo Road Trail from
Alameda Diablo to Tank Access Road, CIP Project C-055. The proposed project is
envisioned as a 0.9-mile mixed-use path for pedestrians and cyclists that will connect the
Diablo Road/Green Valley Road corridor to the west with the Blackhawk Road/Mt.
Diablo State Park south access to the east. The project, initially identified in the Town’s
1989 Townwide Trails Master Plan, supports policies contained in the Town of Danville
2030 General Plan, 2021 Townwide Bicycle Plan, and the 2017 Parks, Arts and Recreation
Strategic Plan. The project will complete a gap between the Barbara Haile Trail and the
new 0.7-mile Diablo Road Trail constructed as part of the Magee Preserve development.
The preliminary design of the new trail segment component is complete and is currently
in the environmental review phase. In preparation for the bidding and construction of the
trail project, there are trees within the trail alignment that must be removed before the
start of protected birds nesting period and before the project will be ready to bid.
DISCUSSION
Eight (8) bids were received and opened on December 19, 2024. The lowest bid was
submitted by Julian Tree Care, Inc. of Richmond, California, with a bid of $48,850.00. Bid
results are summarized in Attachment C. The Engineer’s estimate was $200,000. The
work is scheduled to begin in February 2025 and be completed later in March 2025.

FISCAL IMPACT
The low bid amount of $48,850, plus a 20% contingency amount of $10,000 yields a total
construction budget of $58,850.

RESOLUTION NO. 1-2025
AWARDING A CONSTRUCTION CONTRACT FOR TREE REMOVAL
FOR DIABLO ROAD TRAIL, CIP C-055
WHEREAS, the Danville Town Council previously appropriated funding for the Diablo
Road Trail, CIP No. C-055 in the adopted 2021/22 Capital Improvement Program; and
WHEREAS, the Diablo Road Trail Crossing Improvements (project) is a component of
the Diablo Road Trail, CIP C-055; and
WHEREAS, the project will consist of the design and construction of an at-grade
pedestrian and bicycle roadway crossing facility on Diablo Road in the vicinity of
Fairway Drive; and
WHEREAS, bids were solicited from contractors for this project; and
WHEREAS, the City Clerk of this Town did, in open session on the 19th day of December,
2024, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, sufficient funds have been budgeted in the Capital Improvement Program
for Diablo Road Trail Crossing Improvements as part of Diablo Road Trail, CIP C-055;
now, therefore, be it
RESOLVED, that the Town Manager be and hereby is authorized to execute, on behalf
of the Town, a written contract with Julian Tree Care, Inc. of Richmond, California for
$48,850 and authorize use of a 20% contingency not-to-exceed $10,000 for a total
construction budget of $58,850 for work in connection therewith, and the City Clerk is
hereby directed to attest same and affix thereto the official seal of the Town; and, be it
further
RESOLVED, that staff shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)

PROJECT COST ESTIMATE
This project has been modified from the previous year.
PROJECT APPROPRIATION AND FUNDING
Project is part of the North East Roadway Improvement Assessment
District (NERIAD) and consists of construction of a paved 0.9-mile Class I
pedestrian/bicycle path located adjacent to the south side of Diablo Road
from Fairway Drive to the west to the tank access road (1,200 feet west of
Mt. Diablo Scenic/Blackhawk intersection) to the east. Path will connect to
exisitng 0.5-mile Diablo Road (aka Barbara Haile) Trail to the west and a
new 0.7-mile Class I path to the east that will be constructed as part of the
Magee Preserve Development.
Funding plan is completed with reallocation of Measure J program funds
from C-578, C-598, C-600 and C-602.
A TDA grant ($150,000) was awarded for FY22 cycle for the construction
of the crossing improvements (HAWK signal) at the intersection of Diablo
Road/Fairway Drive.
