Town Council – Regular Meeting SUMMARY OF ACTIONS December 17, 2024 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Morgan at 5:00 p.m. at the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Renee Morgan, Mayor Newell Arnerich, Vice Mayor Mark Belotz, Councilmember Karen Stepper, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance was led by Police Chief Allan Shields. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. Town Manager Joseph Calabrigo stated corrections were made to items 6.1 and 6.3 and distributed to Town Council. 4. FOR THE GOOD OF THE TOWN There were no speakers. 5. PRESENTATIONS 5.1Recognition of retiring Police Chief Allan Shields for his service to the Danville community DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 17, 2024 A resolution was presented from Contra Costa County Supervisor Candace Andersen recognizing Chief Shields on his retirement and appreciation of his service. Mayor Morgan presented Chief Shields with a plaque recognizing his dedication, commitment, and leadership as Danville's Chief of Police. 6. CONSENT CALENDAR 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of November 19, 2024 REVISED 6.2Consider approval of the Summary of Actions from the regular Town Council meeting of December 4, 2024 6.3Consider approval of the Register of Demands REVISED 6.4Consider acceptance of the October 2024 Month End Treasurer’s Report 6.5Consider adoption of Resolution No. 78-2024, awarding a construction contract and transferring funds from CIP No. C-621 Town-wide Bicycle Facilities Improvements to CIP No. A-620 Fiber Optic Cable Interconnect 6.6Consider adoption of Resolution No. 79-2024, approving the Town’s inventory of owned and leased properties pursuant to Government Code Section 50569 and identifying any surplus land pursuant to Government Code Section 5423 6.7Consider adoption of Resolution No. 80-2024, approving out-of-state travel to attend the 2025 U.S. Conference of Mayors' Annual Winter Meeting in Washington, D.C., January 17-19, 2025 MOTION BY VICE MAYOR ARNERICH, SECOND BY COUNCILMEMBER STEPPER, TO APPROVE THE CONSENT CALENDAR, INCLUDING REVISIONS TO ITEMS 6.1 AND 6.3 MOTION CARRIED 5-0 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 17, 2024 7. COMMUNICATIONS 7.1Police Department Report by Danville Police Chief Allan Shields Chief of Police Allan Shields provided the report. 8. PUBLIC HEARINGS 8.1Consider adoption of Resolution No. 81-2024, denying two appeals of the Planning Commission approval and approving Development Plan request DP24-0008, Vesting Tentative Map for Condominium Purposes request MS861-24, and Tree Removal request TR24-0042 allowing the development of a 99-unit senior condominium project on a 3.17 acre site located at 425 El Pintado Road Chief of Planning David Crompton presented the staff report and responded to questions from the Town Council. Brian Griggs, applicant and member of the development team, reported that they have met with the appellants, are supportive of many of the suggestions that have been made, and described how they have addressed the neighbors’ concerns. Jeff Stone, real estate developer and CEO of Diamond Construction, spoke about the alternative methods to the normal standards for fire suppression. Ben Hui, Traffic Consultant with Kimely-Horn, addressed the concerns involving traffic. Paul Ferro, designer, discussed the project architecture. Tristan Munday, appellant, spoke of his concerns with the project. Glen Novotny, on behalf of several appellants, spoke of his concerns with the project. Linda Egbert Holman read a letter written by her mother, appellant Betty Egbert, expressing her concerns with the project. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 17, 2024 Mayor Morgan opened the item to public comment. The following individuals spoke in favor of the appeal and in opposition of the proposed project: Kevin Webber David Blaer Scot Campbell Dave Curto Michael Whisler Pete Solomon Duey Duncan The following speaker cards were submitted in favor of the appeal and in opposition of the proposed project: James Hanson Steve Sidore James and Gail Clarke The following speaker cards were submitted and did not indicate opposition or favor: Sarah Scudder Dr. Paul Mirkarimi David Havlik Mayor Morgan closed the item to public comment. Brian Griggs, Jeff Stone, and Ben Hui , applicants, answered questions from the public. Mayor Morgan requested that Jeff Stone reach out to Caltrans requesting permission to landscape the on-ramp as depicted in the renditions presented. Mr. Stone agreed to reach out to Caltrans. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS DECEMBER 17, 2024 Chief of Planning David Crompton, City Attorney Rob Ewing and Town Manager Joseph Calabrigo, answered questions from the public and the Town Council. MOTION BY COUNCILMEMBER STORER, SECOND BY COUNCILMEMBER STEPPER, TO ADOPT RESOLUTION NO. 81-2024 DENYING TWO APPEALS OF THE PLANNING COMMISSION APPROVAL AND APPROVING DEVELOPMENT PLAN REQUEST DP24-0008, VESTING TENTATIVE MAP FOR CONDOMINIUM PURPOSES REQUEST MS861-24, AND TREE REMOVAL REQUEST TR24-0042 ALLOWING THE DEVELOPMENT OF A 99-UNIT SENIOR CONDOMINIUM PROJECT ON A 3.17 ACRE SITE LOCATED AT 425 EL PINTADO ROAD, WITH THE FOLLOWING ADDITIONAL CONDITIONS: 1.INCLUDE REFERENCE TO THE REVISED TRAFFIC STUDY; AND 2.REFLECT THE APPLICANT’S AGREEMENTS WITH THE PROPERTY OWNERS OF 447 AND 471 EL RIO ROAD RELATED TO SURVEY STAKES, FENCE CONSTRUCTION, MITIGATION TREE PLANTINGS, IRRIGATION, RETAINING WALL RECONFIGURATION, AND MEASURES TO ATTEMPT TO SAVE TREE NUMBER 331. MOTION CARRIED 5-0 9. ADMINISTRATIVE STAFF REPORTS 9.1Consider proposed Solid Waste and Recycling rates for 2025 (Rate Year 11) and forward a recommendation for an 8% rate increase to the RecycleSmart Joint Powers Authority Management Analyst Cat Bravo presented the staff report. Mayor Morgan opened the item to public comment. There were no speakers. Mayor Morgan closed the item to public comment.
