HomeMy WebLinkAbout121024-03.1 STUDY SESSION MEMORANDUM 3.1 TO: Mayor and Town Council December 10, 2024 SUBJECT: Status Update for CIP B-560 Diablo Vista Park - Capital Maintenance (Children’s Play Area) and CIP Project B-616 - Multi-Sport Skate Park BACKGROUND The Capital Improvement Program (CIP) includes projects to improve Diablo Vista Park. CIP Project B-560 would replace and upgrade the existing children’s play area, and CIP Project B-616 would construct a new multi-sport skatepark. In 2021, these two CIP projects were combined to proceed with design and construction. This approach (“the combined project”) was pursued because the children’s play area and skatepark sites are located adjacent to one another, and it presented an opportunity to achieve economies of scale and more favorable construction bids. Initial Bid Process After an extensive community engagement process, design work was completed for the combined project, and construction bids were solicited in spring 2024. Two bids were received and opened on June 4, 2024. The apparent low bid was for $2.92 million, with the second bid at $4.79 million. The engineer’s cost estimate for the combined project was $3.35 million. Town staff subsequently recommended awarding the construction contract to the apparent low bidder at the July 2, 2024 Town Council meeting. Prior to the award of the construction contract, the second bidder raised concerns regarding various aspects of the project bid documents, and both bidders submitted bid protests challenging aspects of each other’s bids. In light of concerns that were raised, the Town Council subsequently acted to reject both construction bids and directed Town staff to return with additional options to consider for moving forward. At their August 13, 2024 Study Session, the Town Council considered additional options including re-bidding the combined project or, alternately, separating the projects to allow them to be bid separately. At the conclusion of the meeting, the Town Council opted to proceed with revising the engineering design and bid documents to allow the children’s play area and the new multi-sport skatepark to potentially be bid and constructed separately. On September 3, 2024, the Town Council approved an amended professional services agreement with the project consultants to allow this to occur. Diablo Vista Park 2 December 10, 2024 DISCUSSION The revised plans, separate bid packages and revised engineer’s estimates for the two projects have now been completed to allow for further consideration of how to proceed. Timing of construction is critical for two reasons. First, the age and condition of the existing children’s play area continue to warrant prompt attention. Second, ARPA funds committed to the project include stringent performance deadlines. The combined updated engineer’s estimates for the base project alternates exceed the available construction budget by $410,903. Options to Proceed The Town is now prepared to move forward with soliciting construction bids as the next step in this process. Bids may be solicited for either or both projects. Further determination regarding whether and how to proceed with construction can occur once bids are received and opened. At that time, further consideration will be required to determine: • Funding - Adequacy of project funding available to fund both projects and potential additional bid alternates. • Construction Timing - The current project timeline could allow construction to begin as soon as spring 2025. Bidding both projects potentially allows one contractor to successfully bid both projects. Should two low bidders emerge from the process (one for each of the two projects) it may be preferable to stagger construction to avoid having both projects underway simultaneously, along with related staging requirements for two separate contractors.
