Town Council – Regular Meeting SUMMARY OF ACTIONS November 6, 2024 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Stepper at 5:00 p.m. at the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Karen Stepper, Mayor Dave Fong, Vice Mayor Newell Arnerich, Councilmember Renee Morgan, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance was led by Tom Rossberg. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 4. FOR THE GOOD OF THE TOWN There were no speakers. 4.A PRESENTATION Introduction of Incoming Danville Police Chief Thomas Rossberg Town Manager Joe Calabrigo introduced Thomas Rossberg. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 6, 2024 5. CONSENT CALENDAR 5.1Consider approval of the Summary of Actions from the regular Town Council meeting of October 15, 2024 5.2Consider approval of the Register of Demands 5.3Consider adoption of Resolution No. 74-2024, awarding a construction contract for the Camino Tassajara Pkwy/Sycamore Valley Road Sound Wall Maintenance Project, CIP No. A-513F MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 6. TOWN MANAGER’S REPORT 6.1 Monthly Town Manager’s report by Joe Calabrigo Town Manager Joe Calabrigo provided the report. 7. COMMUNICATIONS 7.1Development Services Department Report by Diane Friedmann Development Services Director Diane Friedmann provided the report. 8. PUBLIC HEARINGS 8.1Consider introduction of Ordinance No. 2024-09, extending the expiration date of Ordinance No. 2022-05 allowing expanded outdoor restaurant seating, establishing development standards, design guidelines and fee schedule related to the establishment of parklets, allowing specific street closures and allowing the consumption of alcohol within those street closures pursuant to Danville Municipal Code Section 4-14.2b (D. Crompton) City Attorney Rob Ewing presented the staff report. 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 6, 2024 Mayor Stepper stated that a three-year extension would be very beneficial. Mayor Stepper opened the item to public comment. Ron Abbes, Pete’s Brass Rail, expressed support for any extra time allowed to keep the parklet, but would be satisfied with two-years. Jill Rebiejo, Pete’s Brass Rail, could justify spending the money to improve the looks of the parklet if it was permanent, and would like the street paving to take place in January 2025 when business is typically slower. Mayor Stepper closed the item to public comment. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER STORER, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2024-09, EXTENDING THE EXPIRATION DATE OF ORDINANCE NO. 2022-05 ALLOWING EXPANDED OUTDOOR RESTAURANT SEATING, ESTABLISHING DEVELOPMENT STANDARDS, DESIGN GUIDELINES AND FEE SCHEDULE RELATED TO THE ESTABLISHMENT OF PARKLETS, ALLOWING SPECIFIC STREET CLOSURES AND ALLOWING THE CONSUMPTION OF ALCOHOL WITHIN THOSE STREET CLOSURES PURSUANT TO DANVILLE MUNICIPAL CODE SECTION 4-14.2B, AND RETURN FOR SECOND READING ON NOVEMBER 19, 2024 MOTION CARRIED 4-1; VICE MAYOR STEPPER OPPOSED 8.2Consider introduction of Ordinance No. 2024-10, repealing the existing Chapter 13 of the Danville Municipal Code and adding a new Chapter 13 regarding Parks and Community Facilities City Attorney Rob Ewing presented the staff report and provided suggestions for a minor edit to clarify that bicycles are prohibited from being ridden within the playground. Mayor Stepper opened the item to public comment. There were no speakers. Mayor Stepper closed the item to public comment. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 6, 2024 MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2024- 10, REPEALING THE EXISTING CHAPTER 13 OF THE DANVILLE MUNICIPAL CODE AND ADDING A NEW CHAPTER 13 REGARDING PARKS AND COMMUNITY FACILITIES, AND RETURN FOR SECOND READING ON NOVEMBER 19, 2024, INCLUDING PROPOSED EDIT MOTION CARRIED 5-0 9.
