HomeMy WebLinkAbout091724-06.6 ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council September 17, 2024 SUBJECT: Resolution No. 68-2024, accepting private improvements and dedications Minor Subdivision MS 852-2021, located at 932 La Gonda Way BACKGROUND On August 10, 2021, the Town Council approved the subdivision map for this 4-lot single- family residential development. Construction of the subdivision improvements is now complete. Action by the Town Council is necessary to accept the improvements. The private improvements consist of private street paving, concrete curb and valley gutter, storm drain improvements and stormwater treatment facility and all other appurtenances. The subdivision map (Attachment C) includes the following offers of dedications: 1. Public Utility Easement (PUE) over the private street (Nelson Lane) The recommended resolution (Attachment A) accepts all these dedications and relinquishments on behalf of the Town. Upon adoption of Resolution No. 68-2024, the City Clerk may release the performance security and legal security. The payment security may be released in three months if no claims are filed with the City Clerk. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. A copy of this Administrative Staff Report has been sent to the subdivider and Surety Company. FISCAL IMPACT None, all improvements are private. Friedmann Development Services Director Attachments: A - Resolution No. 68-2024 B - Location Map C – Parcel Map MS 852-2021 c: Subdivider: David Waite 1355 Willow Way, #250 Concord, CA 94520 File No. 203-04/852-2021 RESOLUTION NO. 68-2024 ACCEPTING PRIVATE IMPROVEMENTS AND DEDICATIONS FOR MINOR SUBDIVISION MS 852-2021, LOCATED AT 932 LA GONDA WAY WHEREAS, David Waite, partner of JBD Investments, is the subdivider of said subdivision; and WHEREAS, the subdivider has requested the Town of Danville accept said subdivision improvements as complete; and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider has been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements to be accepted; now, therefore, be it WHEREAS, it is now in the interest of the Town of Danville to accept the dedications on said subdivision map for the benefit and use of the general public; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements and dedications to be accepted; now, therefore, be it RESOLVED, that the Danville Town Council accepts the following dedication offered for the public benefit within this subdivision: 1.Public Utility Easement (PUE) over the private street (Nelson Lane) RESOLVED, that the Town of Danville hereby accepts those private improvements installed as a condition of this subdivision agreement; and be it further RESOLVED, that Town staff is authorized and directed to release those securities required as a condition of this subdivision in accordance with the Danville Municipal Code.
