HomeMy WebLinkAbout091724-06.5ADMINISTRATIVE STAFF REPORT 6.5 TO: Mayor and Town Council September 17, 2024 SUBJECT: Resolution No. 67-2024, accepting private improvements for Minor Subdivision MS 855-2015, located at 775 Kirkcrest Road BACKGROUND On August 10, 2021, the Town Council approved the subdivision map for this 2-lot single- family residential development. Construction of the subdivision improvements is now complete. Action by the Town Council is necessary to accept the improvements. The private improvements consist of private road paving, concrete curb and valley gutter, storm drain improvements and stormwater treatment facility and all other appurtenances. Upon adoption of Resolution No. 67-2024, the City Clerk may release the performance security and legal security. The payment security may be released in three months if no claims are filed with the City Clerk. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. A copy of this Administrative Staff Report has been sent to the subdivider and Surety Company. FISCAL IMPACT None, all improvements are private. RECOMMENDATION Adopt Resolution No. 67-2024, accepting private improvements for Minor Subdivision MS 855-2015, located at 775 Kirkcrest Road. Friedmann Development Services Director Attachments: A - Resolution No. 67-2024 B - Location Map c: Subdivider: Philip and Karen Burkart 775 Kirkcrest Road Danville, CA 94526 File No. 203-04/855-2015 RESOLUTION NO. 67-2024 ACCEPTING PRIVATE IMPROVEMENTS FOR MINOR SUBDIVISION MS 855-2015, LOCATED AT 775 KIRKCREST ROAD WHEREAS, Philip and Karen Burkart are the subdividers of said subdivision; and WHEREAS, the subdividers have requested the Town of Danville accept said subdivision improvements as complete; and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider has been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements to be accepted now, therefore, be it RESOLVED, that the Town of Danville hereby accepts those private improvements installed as a condition of this subdivision agreement; and, be it further RESOLVED, that Town staff is authorized and directed to release those securities required as a condition of this subdivision in accordance with the Danville Municipal Code.
