SUBJECT: Resolution No. 65-2024, authorizing an amended professional services
agreement with O’Dell Engineering for the Diablo Vista Park Play Area
Renovation CIP B-560 and Multi-Sport Skate Park B-616 projects
BACKGROUND
The Capital Improvement Program (CIP) currently includes projects to upgrade and
improve Diablo Vista Park. This includes plans to replace and upgrade the existing
children’s play area (CIP B-560) and develop a multi-sport skate park (CIP B-616).
On October 18, 2022, the Town Council adopted Resolution No. 90 -2022, awarding a
professional services agreement with O’Dell Engineering for the Diablo Vista Park Play
Area Renovation and Multi-Sport Skate Park, CIP No. B-560 and B-616.
The project was subsequently put out to bid, resulting in the Town receiving two bids.
After considering all the information presented, the Town Council acted to reject both
bids at their July 2, 2024, meeting.
At that time, the Town Council directed staff to return with options for how to move
forward under one of two scenarios: 1) re-bid the same project (combined play area and
skate park); or alternately, 2) bid two separate projects including a children’s play area
renovation (CIP B-560) and a multi-sport skate park (CIP B-616). After considering both
options at their August 13, 2024, Study Session, the Town Council directed staff to
proceed with the second option, to bid two separate projects: a children’s play area
renovation (CIP B-560); and a multi-sport skate park (CIP B-616).
DISCUSSION
The necessary revised scope of work will include a comprehensive review, revising the
current project construction documents to address or alleviate issues that were raised
through the previous bid process, and preparing two separate sets of plans specifications
and estimates for bidding – one set for the multi-sport skate park and one set for the
children’s play area. These revisions will require approximately eight weeks to complete.
O’Dell Engineering, a Westwood Company Inc., has been providing professional services
to the Town for this project. The cost to revise the project into two separate sets for

bidding is $54,860. This will include revised and updated construction estimates for both
projects.
The current balance for CIP B-560 playground renovation is $959,628 and CIP B-616
multi-sport skate park is $2,341,980. Once the separate bid packages are complete with
revised engineer’s estimates, the Town Council will direct staff to move forward with
bidding one or both projects.

FISCAL IMPACT
The amount for the amended professional services agreement is $54,860. An additional
10% design contingency in the amount of $5,486 will be reserved for a total design budget
of $60,346. Sufficient funds have been appropriated in the Town’s 2024-2025 Capital
Improvement Program to cover the cost of revised professional services.
RECOMMENDATION
Adopt Resolution No. 65-2024, authorizing an amended professional services agreement
with O’Dell Engineering for the Diablo Vista Park Play Area Renovation CIP B-560 and
Multi-Sport Skate Park B-616 projects.
