July 2, 2024 – DRAFT
1. CALL TO ORDER
The regular meeting of the Danville Town Council was called to order by Mayor
Stepper at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA.

The pledge of allegiance was led by Steven Jones.

5.1Presentation of a proclamation to Jessica Wallner, Recreation

ARNERICH, TO APPROVE THE CONSENT CALENDAR, WITH THE EXCEPTION OF
ITEM 6.8

ITEM 6.8 - CONSIDER ADOPTION OF RESOLUTION NO. 50-2024, AWARDING A
CONSTRUCTION CONTRACT FOR DIABLO VISTA PARK PLAY AREA
RENOVATION AND MULTI-SPORT SKATE PARK, CIPS B-560 & B-616 REMOVED
FOR PUBLIC COMMENT
Town Manager Joe Calabrigo provided background on the project and stated that the
Town received bid protests from both bidders.
City Attorney Rob Ewing stated that the Town determined that the protest against the
GradeTech bid was without merit and it is recommended that the contract be awarded
to GradeTech. He responded to questions from the Town Council.
Mayor Stepper opened the item to public comment.
Supplemental correspondence was received from Mike Vila.
Mike Vila, MVP Construction, expressed concern regarding the bid process and
requested that the Town Council not award the contract based on the information he
provided.
Mayor Stepper closed the item to public comment.
The majority of the Town Council expressed concern regarding the bids received,
requested that the bids be rejected, and suggested future discussion at a study session.
Mayor Stepper stated that she is not in favor of rejecting the bids, citing unfounded
accusations by the unsuccessful bidder and that awarding the contract is time sensitive
due to the funding source.
Mr. Ewing stated that the Town Council has the option to award the contract tonight,
modify the bid documents and re-bid the project, or re-bid the project as is.

7. TOWN MANAGER’S REPORT
7.1 Monthly Town Manager’s report by Joe Calabrigo
Joe Calabrigo presented the report.
8. PUBLIC HEARINGS
8.1Consider introduction of Ordinance No. 2024-07, adding Chapter 4-19 to
the Danville Municipal Code prohibiting riding electric bicycles and
motorized scooters on sidewalks in business districts within the Town of
Danville
City Attorney Rob Ewing presented the staff report and stated that, at a
recent Town Council study session, staff was directed to remove regular
non-powered bicycles from the ordinance. He stated that the title of
Chapter 4-19 can be amended to refer to “Electric Bicycles and Scooters.”
He responded to questions from the Town Council.
Danville Police Chief Allan Shields responded to questions from the Town
Council and provided information regarding complaints and age and gear
requirements for the different types of e-bikes and various motor-driven
cycles.
Mayor Stepper opened the item to public comment.

INTRODUCE ORDINANCE NO. 2024-07, ADDING CHAPTER 4-19 TO THE
DANVILLE MUNICIPAL CODE PROHIBITING RIDING ELECTRIC BICYCLES AND
MOTORIZED SCOOTERS ON SIDEWALKS IN BUSINESS DISTRICTS WITHIN THE
TOWN OF DANVILLE, AND RETURN FOR SECOND READING ON JULY 16, 2024;
INCLUDING THE AMENDMENT TO ADD E-BIKES AND E-SCOOTERS TO THE
TITLE OF CHAPTER 4-19
