SUBJECT: Mayor’s Installation and Certification of Election Results
BACKGROUND
Historically, the Town schedules the annual Mayor’s Installation and Community Service
Awards event on the first Tuesday in December. In election years, the Town also certifies
the election results and conducts the swearing-in of Councilmembers on the night of the
Mayor’s Installation.
This year, a municipal election will take place on November 5. The Town consolidates
the election process with Contra Costa County. While the County technically has 28 days
to certify a Council election, they have 30 days to certify the results of the election as a
whole when the Council election is consolidated with non-local races. Anticipating a
large voter turnout for the November election, the County has made it clear that they are
expecting to take the entire 28 days allotted to certify the results, with certified results
anticipated from the County by 5:00 p.m. on December 3.
DISCUSSION
As recently as 2022, the Town Council discussed the timing of the swearing
in/Community Service Awards and certification of election results because of the tight
schedule with receiving certified results. Danville is one of two cities in Contra Costa
County that schedule the swearing-in of Councilmembers on the first Tuesday in
December, along with the City of Walnut Creek. Most cities in the County conduct the
swearing-in on the second Tuesday, which avoids any issues with election results.
The California Elections Code requires the Town Council to adopt the election results at
the first regular meeting following the canvass, or a special meeting called for that
purpose. Since the election results will not be certified until December 3 at 5:00 p.m., it is
recommended that the Town Council consider modifying the meeting date to allow time
to finalize plans for the event.
Considering availability of Town facilities, it is recommended that the Town Council
consider moving the date of the Installation in the Village Theatre to either Thursday,
December 5, or Tuesday, December 17.
The Town Council may also want to consider making a permanent change in the
December meeting date for future election years in order to secure a facility and prevent
the need to revise the meeting schedule.
This item is for Council discussion and to provide staff direction. Any modifications to
the Town Council meeting schedule will be presented to the Town Council for action at
a future meeting.
