Town Council – Regular Meeting SUMMARY OF ACTIONS June 18, 2024 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Stepper at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Karen Stepper, Mayor Dave Fong, Vice Mayor Newell Arnerich, Councilmember Renee Morgan, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance was led by Chris Trujillo. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. Town Manager Joe Calabrigo stated that the Town Council has concluded interviews and will take action on July 2, 2024, to appoint members to the Bicycle Advisory Commission and the County Connection Citizen Advisory Committee. 4. FOR THE GOOD OF THE TOWN Aydin Yeckovan expressed concern regarding water quality, contaminants and water treatment solutions. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 18, 2024 5. PRESENTATIONS AND PROCLAMATIONS 5.1Reading of a proclamation by Mayor Stepper recognizing Juneteenth on June 19, 2024 Mayor Stepper read the proclamation. Aydin Yeckovan addressed the Town Council regarding the abolition of slavery. 5.2Presentation of a proclamation to Candace Hendra, Senior Advisory Commissioner, proclaiming June 2024 as Alzheimer’s & Brain Awareness Month Mayor Stepper presented the proclamation. 6. CONSENT CALENDAR City Attorney Rob Ewing referred to agenda item 6.9 and stated that there are no proposed changes in the salary or benefits of the Town Manager. 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of June 4, 2024 6.2Consider approval of the Register of Demands 6.3Consider acceptance of the April 2024 Month End Treasurer’s Report 6.4Consider adoption of Resolution No. 36-2024, requesting and consenting to consolidation of elections and setting specifications of the election order for the November 5, 2024, Municipal Election 6.5Consider adoption of Resolution No. 37-2024, authorizing the Town Manager to execute a contract amendment with Casey Printing for Recreation Services for Fiscal Year 2023/24 6.6Consider adoption of Resolution No. 38-2024, authorizing the purchase of one GPS equipped Total Station Surveying System for use by the Police 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 18, 2024 Department’s Traffic Unit to document evidence and reconstruct serious injury and fatal collision scenes 6.7Consider adoption of Resolution No. 39-2024, approving Minor Subdivision Map and Subdivision Improvement Agreement for Minor Subdivision 853-2019, located at 1610 Lawrence Road 6.8Consider adoption of Resolution No. 40-2024, authorizing the Town Manager to execute a Regulatory Agreement and Declaration of Restrictive Covenants for the below-market rate units associated with the 600 Hartz Avenue development 6.9Consider adoption of Resolution No. 41-2024, extending the employment agreement of the Town Manager 6.10Consider adoption of Resolution No. 42-2024, awarding a professional services agreement for inspection, and laboratory and field testing services during construction of San Ramon Valley Boulevard Improvements, CIP Project C-600 and Pavement Management, CIP Project C-610 6.11Consider adoption of Resolution No. 43-2024, awarding a construction contract for the 2023/24 Pavement Rehabilitation Project, Contract No. C- 610G MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 7. COMMUNICATIONS 7.1Quarterly Police Department Report by Police Chief Allan Shields Allan Shields provided the report. 7.2Senior Advisory Commission report by Chair Roxanne Foster Roxanne Foster provided the report. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 18, 2024 7.3Legislative Update by Management Analyst Cat Bravo Cat Bravo provided the report. 8. ADMINISTRATIVE STAFF REPORTS 8.1Consider adoption of Resolution No. 44-2024, denying an appeal by Clark Morrison on behalf of Ido Adler of the Town’s determination that Major Subdivision–Vesting Tentative Map application SD 9673 is incomplete. The application seeks to develop a 30-lot subdivision on a 47-acre parcel identified as Parcel B of SD 6196. The site is located on the hillside above and north of the Anderson Ranch subdivision Mayor Stepper stated that the Town Council received numerous emails in opposition to the appeal, not all of which have been included in the packet. Chief of Planning David Crompton presented the staff report and responded to questions from the Town Council. City Attorney Rob Ewing responded to questions from the Town Council and provided information on the Subdivision Map Act. Clark Morrison, speaking on behalf of appellant Ido Adler, provided information on the application, submittal process, Application Requirements checklist, the issues that staff has raised, and requested that the Town deem the application complete. Allan Moore, representing the Anderson Ranch Homeowners Association, provided information as to the incompleteness of the development application and lack of easements to the property, and requested that the appeal be denied by the Town. Mayor Stepper opened the item to public comment. Mr. Morisson responded to comments made by Mr. Moore and the speakers and provided clarification regarding the application submittal. He stated that everything that the Town has requested has been provided. Mr. Crompton and Mr. Ewing responded to questions from the Town Council. 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS JUNE 18, 2024 The Town Council expressed support for denying the appeal due to an incomplete development application. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER STORER, TO ADOPT RESOLUTION NO. 44-2024, DENYING AN APPEAL BY CLARK MORRISON ON BEHALF OF IDO ADLER OF THE TOWN’S DETERMINATION THAT MAJOR SUBDIVISION–VESTING TENTATIVE MAP APPLICATION SD 9673 IS INCOMPLETE. THE APPLICATION SEEKS TO DEVELOP A 30-LOT SUBDIVISION ON A 47-ACRE PARCEL IDENTIFIED AS PARCEL B OF SD 6196. THE SITE IS LOCATED ON THE HILLSIDE ABOVE AND NORTH OF THE ANDERSON RANCH SUBDIVISION MOTION CARRIED 5-0 9.
