David, As we previously discussed, the 425 El Pintado Project will have a significant impact on my mom's quality of life and property values. Can you please submit the following for comment at the Design Review Meeting this evening. Please send confirmation that you have received this email. Re: Betty Egbert 447 El Rio Road We are respectfully requesting that the Height Waiver/Variance not be approved for the 425 El Pintado Project. Please reference: Title Sheet A001. ZONING INFO. HEIGHT 1 3 stories/37 feet maximum PROPOSED: 4 stories of residential type on top of below grade garage Building height to Penthouse Roof - 52.9" measured from AVERAGE grade plane WAIVER REQUESTED FOR HEIGHT Please reference: Title Sheet A001. PROJECT DESCRIPTION: It states "The maximum height calculation per the City standards shows a maximum building height of 52' 9". However, the nearest neighbors (at the North property line) are at a much higher elevation on a hill. For them the building will appear to be 33' at the West Wing and 29' at the East Wing making the height less of a factor. On A003, Height Analysis, it shows that my mom's residence is 408 feet above sea level (AVERAGE Grade Plan Diagram). Initially it read "Neighbors uphill with their main floor about one story higher than the proposed project." Totally False and Misleading Information. After several calls to the Town, we see that it's been revised to show the building height at 29 FEET ABOVE her residence. (Height Analysis Section). However, if the highest grade is used it could possibly end up being 37.9 feet above her home. The project, as proposed, would be approximately 3 stories higher than my mom's main floor (her only floor). This project will loom over her home, taking away all of her view, her privacy and, literally, the sunshine from her windows. We respectfully request that NO HEIGHT WAIVER/VARIANCE be allowed so that my mom, along with the other adjacent neighbors, can attempt to coexist with this project. As currently proposed, the project amounts to "A Taking". My mom's quality of life and property values will be destroyed. Even if she chose to sell her property now, the proposed project would need to be disclosed. You have effectively TAKEN away value from her with no compensation. Finally, it's particularly distressing that, to date, NO correspondence has been received from the Town of Danville notifying us that the project was even proposed. It only came to our attention when the developer/builder/?? showed up at my 92 year old mom's door asking if she would sell him a portion of her property and asking if she would give him an easement for landscaping This is concerning on so many levels.
