SUBJECT: Resolution No. 36-2024, requesting and consenting to consolidation of
elections and setting specifications of the election order for the November
5, 2024, Municipal Election
BACKGROUND
A municipal election will be held in Danville on Tuesday, November 5, 2024, to elect three
(3) members to the Danville Town Council for four-year terms. The Contra Costa County
Elections Division traditionally administers Danville’s Municipal Elections. July 3, 2024, is
the deadline for submitting a formal request to the Contra Costa County Elections Division
to administer Danville's Election on November 5, 2024.
In addition to requesting consolidation, the Contra Costa County Elections Division requires
that the Town Council resolution include policies for candidate statements including: the
number of words the candidate statement can contain; who will pay for the candidate
statement; whether the fee for the candidate statement must be paid at the time of filing;
and, action to be taken in the case of a tie vote.
DISCUSSION
The practice established for previous Town Council elections has allowed for a 250-word
candidate statement and required the candidate to pay the cost of publishing the statement
in the Voter Guide. Contra Costa County Elections Division has determined that the cost to
print a 250-word candidate statement this year will be $789.

FISCAL IMPACT
Based on a current registered voter population of 32,251, and three Town Council at-large
seats on the ballot, the Contra Costa County Elections Division has provided an initial
estimate of $38,000 - $45,000. Final costs will be determined following the election, and
varies depending upon the number of agencies that consolidate and share in the election
costs. The Town has included $47,500 in the FY 2024/25 budget for election purposes.
All costs associated with the production of the candidate statements will be borne by the
candidate.
RECOMMENDATION
Adopt Resolution No. 36-2024, requesting and consenting to consolidation of elections and
setting specifications of the election order for the November 5, 2024, Municipal Election.

RESOLUTION NO. 36-2024
REQUESTING AND CONSENTING TO CONSOLIDATION OF ELECTIONS AND
SETTING SPECIFICATIONS OF THE ELECTION ORDER FOR THE
NOVEMBER 5, 2024, MUNICIPAL ELECTION
WHEREAS, the Town Council has ordered a Municipal Election to be held on Tuesday,
November 5, 2024, to fill certain municipal offices; and
WHEREAS, other elections may be held in whole or in part in the incorporated area of
the Town of Danville and it is to the advantage of the Town to consolidate pursuant to
Elections Code Section 10002; and
WHEREAS, Elections Code Section 10002 requires the Town to reimburse the County in
full for the services performed upon presentation of an invoice to the Town by the County
Elections Official; and
WHEREAS, Elections Code Section 13307 requires that before the nominating period
opens, the Town Council must determine whether a charge shall be levied against each
candidate submitting a candidate statement to be sent to the voters; may establish the
cost for the candidate statement; and, determine whether the cost be paid in advance; and
WHEREAS, Elections Code Section 12101 requires the publication of a notice of the
election once in a newspaper of general circulation in the Town; and
WHEREAS, tie votes shall be determined by lot unless the Town Council adopts the
provisions of Elections Code 15651(b) prior to conducting the election resulting in the tie
vote; now, therefore, be it
RESOLVED, by the Danville Town Council that an election be held in accordance with
the following specifications:
1. The Election shall be held on Tuesday, November 5, 2024. The purpose of the
election is to choose successors for three (3) at-large seats on the Danville Town
Council for four-year terms; and
2. The Town Council hereby requests and consents to the consolidation of this
election with other elections which may be held in whole or in part of the Town
of Danville, as provided in Elections Code Section 10002; and
3. The Town will reimburse Contra Costa County for the actual cost incurred in
conducting the election upon receipt of an invoice stating the amount due as
determined by the Elections Official; and

4. The candidate statement will be limited to 250 words; the candidate will pay
the cost of publishing the candidate statement; and, the candidate will pay the
fee at the time of filing nomination papers.
5. The Danville City Clerk is to publish the Notice of Election in the East Bay
Times, a newspaper of general circulation published daily in the Town of
Danville; and
6. In the event of a tie vote, the tie will be determined by lot. In the presence of
the Danville City Clerk, the tied candidates (or their authorized
representatives) will roll a multi-sided die and the candidate with the highest
number would be the successful candidate; and
7. The Town of Danville directs that a certified copy of this Resolution be
forwarded to the Registrar of Voters and to the Board of Supervisors of Contra
Costa County.
