Town Council - Regular Meeting
SUMMARY OF ACTIONS
May 21, 2024 - DRAFT
1. CALL TO ORDER
The regular meeting of the Danville Town Council was called to order by Mayor
Stepper at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA.
Present: Karen Stepper, Mayor
Dave Fong, Vice Mayor
Newell Arnerich, Councilmember
Renee Morgan, Councilmember
Robert Storer, Councilmember arrived at 5:28 p.m.
2. PLEDGE OF ALLEGIANCE TO THE FLAG
The pledge of allegiance was led by Boy Scout Troop 1630, Kristin Johnson, leader.
3. CHANGES TO THE ORDER OF THE AGENDA
There were no changes to the order of the agenda.
Mayor Stepper announced that item 7.1 will be deferred to a later date.
4. FOR THE GOOD OF THE TOWN
Pete Brown expressed support for the skatepark soon to be under construction at
Diablo Vista Park.
Mark Seller expressed concern for signage at sport courts and the lack of
enforcement of failure to stop at stop signs.

5. PRESENTATIONS AND PROCLAMATIONS
5.1 Presentation of a proclamation to Sumita Bhandari, Executive Director,
Discovery Counseling Center proclaiming May 2024 as Mental Health
Awareness Month
Mayor Stepper presented the proclamation.
5.2 Presentation of a proclamation to Rabbi Raitman and Mushky Raitman,
Chabad Jewish Center of Danville and San Ramon, proclaiming May 2024
as Jewish American Heritage Month
Mayor Stepper presented the proclamation.
Councilmember Storer arrived at 5:28 p.m.
6. CONSENT CALENDAR
6.1 Consider approval of the Summary of Actions from the regular Town
Council meeting of May 7, 2024
6.2 Consider approval of the Register of Demands
6.3 Consider acceptance of the March 2024 Month End Treasurer's Report
6.4 Consider adoption of Resolution No. 27-2024, approving the display of the
Rainbow Flag during the month of June 2024
6.5 Consider adoption of Ordinance No. 2024-04, amending provisions of
Chapter 20 of the Danville Municipal Code regarding stormwater
management and discharge control
6.6 Consider adoption of Ordinance No. 2024-05, repealing Sections 8-6 and 8-
7 of the Danville Municipal Code relating to traffic regulations
6.7 Consider adoption of Ordinance No. 2024-06, adding Sections 32-22.4.5
and 32-23.4.5 to the Danville Municipal Code prohibiting short term
rentals in single family and two-family zoning districts (ZTA 24-0001)

6.8 Consider adoption of Resolution No. 28-2024, authorizing Use of Public
Right of Way for 2024 Music in the Park on Town Green

7. COMMUNICATIONS
7.1 Legislative Update by Management Analyst Cat Bravo DEFERRED TO A
LATER DATE
8. PUBLIC HEARINGS
8.1 Consider adoption of Resolution No. 29-2024, adopting a Mitigated
Negative Declaration of Environmental Significance and approving the
addition of Six New Pickleball Courts with Associated Seating at Osage
Station Park
Each member of the Town Council acknowledged the large number of
emails received and stated that they were reviewed.
Recreation, Arts and Community Services Director Henry Perezalonso
presented the staff report.
City Attorney Rob Ewing provided information on the process leading to
the noise study and the Mitigated Negative Declaration of Environmental
Significance.
Josh Carman, Rincon Consultants, provided information regarding the
noise study and the quantitative criteria.
Staff and the consultant responded to questions from the Town Council.
Mayor Stepper opened the item to public comment.

Stuart Flashman, attorney for the appellant, presented background and
information supporting the appeal. He stated further study needs to be
done on noise and transportation impacts, and presented illustrations on
sound impacts, measurements and absorption.

Mr. Flashman provided a rebuttal and additional comments regarding
noise and the need for further study. He expressed concern regarding the
increased traffic and safety issues that would accompany additional courts.
He suggested mitigating the current two courts and locating additional
courts in other parks.

Mayor Stepper closed the item to public comment.
Staff and Mr. Carman responded to questions from the Town Council.
Councilmember Arnerich stated that he is not supportive of placing the
courts at Osage Station Park and suggested that consideration be made to
placing courts at Sycamore Valley Park or Diablo Vista Park.
Councilmember Morgan recognized the desire for more courts and stated
that too many courts are being proposed for Osage Station Park.
Councilmember Storer recognized the need for more pickleball courts and
does not feel the proposed mitigations are sufficient. He suggested
implementing mitigation measures for the current courts at Osage Station
Park.
Mayor Stepper suggested options to pause and consider options for moving
forward.
Vice Mayor Fong suggested taking a pause to implement mitigation
opportunities for the current courts and then determine how to move
forward while considering other park locations.

TEST FOR NOISE WITH THE APPROPRIATE STANDARDS
