Town Council – Regular Meeting SUMMARY OF ACTIONS May 7, 2024 – DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Stepper at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Karen Stepper, Mayor Dave Fong, Vice Mayor Renee Morgan, Councilmember Robert Storer, Councilmember Absent: Newell Arnerich, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Susanna Ordway. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. Assistant Town Manager Tai Williams stated that there was a revision to agenda item 6.3 and the date for public hearing is set for June 4, 2024. 4. FOR THE GOOD OF THE TOWN Anthony Romanelli expressed opposition to the pickleball courts proposed for Osage Station Park. Luz Gomez, EBMUD, introduced herself as the new Ward 2 representative and provided information on her background. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 7, 2024 Don Reid expressed concern regarding weeds in the creek along Sycamore Valley Road between Park Hill and Morninghome Road. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation of a proclamation to Susanna Ordway, President Asian Pacific Islander American Public Affairs, proclaiming May 2024 as Asian American and Pacific Islander Heritage Month Mayor Stepper presented the proclamation. 5.2Presentation of a proclamation to Marie Sunseri, City Clerk, proclaiming May 5 through May 11, 2024, as the 55 annual Professional Municipal th Clerks Week Mayor Stepper presented the proclamation. 6. CONSENT CALENDAR 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of April 16, 2024 6.2Consider approval of the Register of Demands 6.3Consider adoption of Resolution No. 25-2024, approving the preliminary Engineer’s Report, declaring intent to levy and collect assessments for Fiscal Year 2024/25 and setting June 4, 2024, as the date for the public hearing for Danville Street Lighting and Landscape Assessment District No. 1983-1 6.4Consider adoption of Resolution No. 26-2024, establishing the Danville Youth Poet position MOTION BY COUNCILMEMBER STORER, SECOND BY COUNCILMEMBER MORGAN, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 4-0-0-1; COUNCILMEMBER ARNERICH ABSENT 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 7, 2024 7. COMMUNICATIONS 7.1Maintenance Department Report by Director Dave Casteel Dave Casteel provided the report. 7.2Diablo Road Trail Project status update by Assistant Town Manager Tai Williams Tai Williams introduced Jonathan Buck, ENGEO, and they provided the update. 8. PUBLIC HEARINGS 8.1Consider introduction of Ordinance No. 2024-03, repealing existing Chapter 2-16 of the Danville Municipal Code and adding a new Chapter 2- 16 to create a Bicycle Advisory Board MOTION BY MAYOR STEPPER, SECOND BY VICE MAYOR FONG, FOR THE CURRENT BICYCLE ADVISORY COMMISSION TO CONTINUE TO EXECUTE ITS CALENDAR OF SCHEDULED MEETINGS DURING 2024 IN ORDER TO ADVISE THE TOWN ON A NUMBER OF TIME-SENSITIVE BICYCLE SAFETY ISSUES THAT ARE BEING ADDRESSED CURRENTLY BY THIS COMMISSION AND IT REMAINS CRUCIAL TO THE TOWN’S FUTURE SUCCESS IN MEETING ITS SAFETY GOALS There were Town Council questions regarding the motion and the process for Town Council action. Mayor Stepper and Vice Mayor Fong provided background in support of the motion. City Attorney Rob Ewing provided procedural guidance and described options for the Town Council to take action at this meeting. He reviewed the direction the Town Council provided to staff at the April 9, 2024, study session and stated that the Town Council can vote on the motion on the floor after the public hearing is opened. Councilmember Morgan stated that she would like to hear a presentation on the Administrative Staff Report as directed by Town Council at the April 9, 2024, study session. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 7, 2024 Mr. Ewing presented the staff report and stated that the ordinance was modeled after the Town’s Arts Advisory Board, as directed by the Town Council at the study session on April 9, 2024. Councilmember Morgan referred to the correspondence provided to the Town Council by Bruce Bilodeau and Alan Kalin and stated that she has not had a chance to thoroughly review it. She summarized three options to move forward and asked Mr. Ewing to describe how an Ad Hoc Committee would function. Mr. Ewing described how an Ad Hoc Committee would be selected and function. Mayor Stepper opened the item to public comment. Bruce Bilodeau, Chair of the Bicycle Advisory Commission, encouraged the Town Council to postpone making a decision on the future of the Commission until the end of the year, and highlighted the accomplishments of the Commission. Mayor Stepper closed the item to public comment. Mayor Stepper stated that Bruce Bilodeau and Alan Kalin voluntarily worked on bicycle safety issues from 2017 to 2022, before the Bicycle Advisory Commission was formed. There was Town Council discussion regarding the events and conversations that have taken place in Town Council meetings, and with individuals on the Commission, leading up to this public hearing. Mr. Ewing clarified the process and stated that the motion on the floor would first need to be voted on. If the motion passes to keep the Bicycle Advisory Commission through the end of the year, the Town Council would discuss this again later this year. Three votes are needed to disband the Commission. Another motion could be voted upon if the current motion does not pass. Mayor Stepper restated the motion and requested a roll call vote. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 7, 2024 MOTION BY MAYOR STEPPER, SECOND BY VICE MAYOR FONG, FOR THE CURRENT BICYCLE ADVISORY COMMISSION TO CONTINUE TO EXECUTE ITS CALENDAR OF SCHEDULED MEETINGS DURING 2024 IN ORDER TO ADVISE THE TOWN ON A NUMBER OF TIME-SENSITIVE BICYCLE SAFETY ISSUES THAT ARE BEING ADDRESSED CURRENTLY BY THIS COMMISSION AND IT REMAINS CRUCIAL TO THE TOWN’S FUTURE SUCCESS IN MEETING ITS SAFETY GOALS MOTION CARRIED 3-1-0-1; COUNCILMEMBER STORER OPPOSED; COUNCILMEMBER ARNERICH ABSENT Mayor Stepper requested that future study sessions occur in the Town Meeting Hall and be broadcast live. Mr. Ewing stated that the Town Council would need to vote on moving the study sessions to the Town Meeting Hall. 8.2Consider introduction of Ordinance No. 2024-04, amending provisions of Chapter 20 of the Danville Municipal Code regarding stormwater management and discharge control City Attorney Rob Ewing presented the staff report. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER STORER, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2024-04, AMENDING PROVISIONS OF CHAPTER 20 OF THE DANVILLE MUNICIPAL CODE REGARDING STORMWATER MANAGEMENT AND DISCHARGE CONTROL, AND RETURN FOR SECOND READING ON MAY 21, 2024 MOTION CARRIED 4-0-0-1; COUNCILMEMBER ARNERICH ABSENT 8.3Consider introduction of Ordinance No. 2024-05, repealing Sections 8-6 and 8-7 of the Danville Municipal Code relating to traffic regulations City Attorney Rob Ewing presented the staff report. 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 7, 2024 Mayor Stepper opened the item to public comment. MOTION BY COUNCILMEMBER MORGAN, SECOND BY VICE MAYOR FONG, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2024-05, REPEALING SECTIONS 8-6 AND 8-7 OF THE DANVILLE MUNICIPAL CODE RELATING TO TRAFFIC REGULATIONS, AND RETURN FOR SECOND READING ON MAY 21, 2024 MOTION CARRIED 4-0-0-1; COUNCILMEMBER ARNERICH ABSENT 8.4Consider introduction of Ordinance No. 2024-06, adding Sections 32-22.4.5 and 32-23.4.5 to the Danville Municipal Code prohibiting short term rentals in single family and two-family zoning districts (ZTA 24-0001) City Attorney Rob Ewing presented the staff report. ADJOURN TO DANVILLE DISASTER COUNCIL The regular meeting of the Danville Town Council was adjourned to the Danville Disaster Council at 7:29 p.m. 11. CALL TO ORDER DANVILLE DISASTER COUNCIL The Danville Disaster Council was called to order at 7:30 p.m. 11.1Report on emergency preparedness activities/events and discussion of Draft 2024 Hazard Mitigation Plan Nate McCormack, Emergency Services Manager, provided the report. 12.
