HomeMy WebLinkAbout041624-06.4ADMINISTRATIVE STAFF REPORT 6.4 TO: Mayor and Town Council April 16, 2024 SUBJECT: Resolution No. 24-2024, approving a Notice of Completion for the Various Storm Drainage Improvements Project, CIP Projects A-608, A-613, and A- 614 BACKGROUND The Various Storm Drainage Improvements Project, CIP Projects A-608, A-613, and A-614, was located on Starview Drive, Loch Lomond Way, and Westridge Avenue. The Various Storm Drainage Improvements Project consisted of mitigation measures that upgraded the existing storm drainage systems to reduce the impacts of sediment and debris during flood events. DISCUSSION The project is now complete and ready for acceptance by the Town. All work was performed in accordance with the approved plans and specifications. The original contract amount of $747,000 was increased by $112,990.83 as a result of four Contract Change Orders. The change orders consisted of a potable water line relocation, storm drain channel adjustment, weatherization of the project area, and a bid item adjustment. The final contract amount of $859,990.83 (contract plus change orders) is within the authorized construction budget and contingency for this project. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT None. Friedman Development Services Director Attachments: A - Resolution No. 24-2024 B - Notice of Completion C - Resolution No. 25-2023 Notice of Completion Various Storm 2 April 16, 2024 Drainage Improvements Projects, CIP No. A-608, A-613, and A-614 DocuSign Envelope ID: CDCD5D49-9819-403B-878C-F64ADB8B283A RESOLUTION NO. 24-2024 APPROVING A NOTICE OF COMPLETION FOR THE VARIOUS STORM DRAINAGE IMPROVEMENTS PROJECT, CIP PROJECTS A-608, A-613, AND A- 614 WHEREAS, on April 18, 2023, the Town of Danville awarded a construction contract to Ella for the Various Storm Drainage Improvements Project, CIP Projects A-608, A-613, and A-614; and WHEREAS, the City Engineer has determined that the work under this project has been completed as of February 2, 2024, in accordance with the plans and specifications thereof; and WHEREAS, California Civil Code section 9204 specifies the requirements for recordation of a Notice of Completion; and WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice of Completion is recorded the Town must release all undisputed retention payments to the contractor; now, therefore, be it RESOLVED, by the Danville Town Council that said work by and with Ella is hereby accepted as complete; and, be it further RESOLVED, that the City Clerk is hereby authorized and directed to file with the County Recorder of the County of Contra Costa, a Notice of Completion for said project within fifteen (15) days from the date hereof; and, be it further RESOLVED, that undisputed retention payments be released in accordance with Sections 8812 and 9356 of the California Civil Code. A-330 TOWN -WIDE STORM DRAIN SYSTEM MANAGEMENT TO CIP NO. A-614 WESTRIDGE TRASH RACK MODIFICATION WHEREAS, the Danville Town Council has previously approved funding in the Capital Improvement Program for Starview Drive Storm Drain Trash Rack, Loch Lomond Way Trash Rack, and Westridge Trash Rack Modification, CIP Nos. A-608, A-613, and A-614 respectively; and WHEREAS, the funding includes a grant from the Hazard Mitigation Grant Program (HGMP), a federal grant program administered by FEMA; and WHEREAS, CalOES, acting on behalf of the Town, has determined that the project is Categorically Excluded from requirements of the California Environmental Quality Act (CEQA); and WHEREAS, bids were solicited from contractors for the project; and WHEREAS, the City Clerk of this Town did, in open session on the 28th day of March, 2023, publicly open and read aloud the sealed bids received as required by law; and WHEREAS, of the five bids received, the lowest responsive bid was submitted by Ella of Alamo, California, and the City Engineer recommends awarding a construction contract for the project to said contractor; now, therefore, be it RESOLVED, by the Danville Town Council, that funds in the amount of $165,000 be transferred from Town -Wide Storm Drain System Management (CIP No. A-330) to Westridge Trash Rack Modification (CIP A-614) to fund construction of the project; and, be it further RESOLVED, by the Danville Town Council, that the Town award a construction contract for Starview Drive Storm Drain Trash Rack, Loch Lomond Way Trash Rack, and Westridge Trash Rack Modification, CIP Nos.
