SUBJECT: Resolution No. 16-2024, awarding a professional services agreement for
engineering design services for the Diablo Trail Project, CIP Project C-
055
BACKGROUND
The Town's Capital Improvement Program (CIP) includes the Diablo Road Trail from
Alameda Diablo to Tank Access Road, CIP Project C-055. This project consists of the
construction of a paved 0.9 -mile Class I pedestrian/ bicycle path located adjacent to the
south side of Diablo Road from Fairway Drive to the west of the tank access road (1,200
feet west of Mt. Diablo Scenic/Blackhawk intersection) to the east.
Once complete, the path would provide the final missing trail connection between the
existing Barbara Haile Trail to the west and a new 0.7 -mile Class I path to the east that
has been constructed as part of the Magee Preserve Development.
DISCUSSION
The environmental assessment and preliminary design phases of the Diablo Road Trail
have been successfully completed. In spring 2023, the Town submitted applications for
environmental permits to both state and regional regulatory agencies, such as the
California Department of Fish & Wildlife (CDFW) and Regional Water Quality Control
Board (RWQCB).
Unfortunately, the winter storms of 2023 not only led to the collapse of the Diablo Road
culvert but also led to considerable erosion of the creek embankment designated for the
trail alignment. In fall 2023, CDFW issued the Town an extensive list of conditions of
permit approval. Beyond significantly increasing the project's scope and corresponding
costs, the Town believes that these conditions appear to be disproportionate to the
project's limited environmental impact.
To advance the project expeditiously, it has become necessary to engage an engineering
design firm with the expertise available to re -survey the affected area, update the design
of the trail's retaining wall system to accommodate the creek bank erosion and develop
a detailed response that addresses CDFW concerns.
ENGEO, Inc. was previously contracted to complete a geohazard analysis and structural
design associated with the retaining walls required to complete the western portion of
the trail. The Town now desires to extend ENGEO, Inc. services to assist in completing
the remaining civil engineering design and environmental mitigation plan, finalizing the
California Department of Fish and Wildlife and Regional Water Quality Control Board
permits, and production of the construction bid documents.

FISCAL IMPACT
The amount for the engineering design services contract is $317,000. An additional 10%
contingency in the amount of $31,700 will be reserved for a total engineering design
services budget of $348,700. Sufficient funds to cover the engineering design services
contract and contingency are contained in the Diablo Road Trail Project, CIP No. C-055
(Attachment B).

RESOLUTION NO. 16-2024
AWARDING A PROFESSIONAL SERVICES AGREEMENT FOR ENGINEERING
DESIGN SERVICES FOR THE DIABLO TRAIL PROJECT, CIP PROJECT C-055
WHEREAS, the Danville Town Council previously appropriated funding for the Diablo
Road Trail Project, CIP No. C-055, in the adopted 2023/24 Capital Improvement Program;
and
WHEREAS, per the California Environmental Quality Act (CEQA) requires that state and
local agencies disclose and evaluate the significant environmental impacts of proposed
projects; and
WHEREAS, the Town desires to hire ENGEO Incorporated of San Ramon, CA to perform
engineering design services for the Diablo Road Trail project, CIP No. C-055; now,
therefore, be it
RESOLVED, by the Danville Town Council that the Town Manager be and hereby is
authorized to execute on behalf of the Town, the Professional Services Agreement with
ENGEO, Inc of San Ramon, CA with a not -to -exceed budget of $317,000, and that the
Town Manager be authorized to establish and utilize a 10% design contingency in the
amount of $31,700 for additional work that may be subsequently approved by contract
amendment.

PROJECT DESCRIPTION AND LOCATION:
Project is part of the North East Roadway Improvement Assessment
District (NERIAD) and consists of construction of a paved 0.9 -mile Class I
pedestrian/bicycle path located adjacent to the south side of Diablo Road
from Fairway Drive to the west to the tank access road (1,200 feet west of
Mt. Diablo Scenic/Blackhawk intersection) to the east. Path will connect to
exisitng 0.5 -mile Diablo Road (aka Barbara Haile) Trail to the west and a
new 0.7 -mile Class I path to the east that will be constructed as part of the
Magee Preserve Development.
Funding plan is completed with reallocation of Measure J program funds
from C-578, C-598, C-600 and C-602.
A TDA grant ($150,000) was awarded for FY22 cycle for the construction
of the crossing improvements (HAWK signal) at the intersection of Diablo
Road/Fairway Drive.
