SUBJECT: Resolution No. 15-2024, designating the District Engineer, directing
preparation of the annual report for fiscal year 2024/25 for the Danville
Street Lighting and Landscape Assessment District 1983-1 and approving
a contract extension with Francisco & Associates
BACKGROUND
The Danville Street Lighting and Landscape Assessment District 1983-1 (the “District”) was
authorized shortly after incorporation of the Town. The District consists of four zones:
Zones A and B pay towards roadside landscaping, Zone C pays towards street lighting and
Zone D pays a portion of park and facility maintenance. Property owners are assessed based
on the special benefit received from the improvements maintained by the District.
The District was created and operates pursuant to provisions of the Landscaping and
Lighting Act of 1972 (the “Act ”). Since 1996, the District also complies with the provisions
of Article XIIID, Section 4 of the California Constitution, adopted by Proposition 218. The
Act requires that every year the District retain an Engineer to prepare a report describing
the improvements maintained by the District and the assessments necessary to maintain the
improvements, even when there is no proposed change in assessment levels.
DISCUSSION
The Town has used the firm of Francisco & Associates as the District Engineer for more than
ten years. The principals in the firm have worked as the District Engineers for at least 15
years. Given the firm’s familiarity with the Town’s District, its existing databases with all
of the District’s information, and their excellent service record, it is recommended the firm
be designated as the District Engineer and that the firm’s contract be extended for
preparation of the Engineer’s report, submittal of all necessary information to the County
Auditor, and handling phone inquiries from property owners throughout the year.
The Preliminary Engineer’s report will be presented to the Town Council for consideration
in May. While there will be no change in the current assessments, the law still requires a
period for public comment prior to adoption of the Final Engineer’s report and submittal of
the assessments to the County.

FISCAL IMPACT
The contract with Francisco & Associates for services related to the LLAD is for $17,000, plus
up to $750 in reimbursable expenses such as County Assessor maps, etc.
RECOMMENDATION
Adopt Resolution No. 15-2024, designating the District Engineer, directing preparation of
the annual report for fiscal year 2024/25 for the Danville Street Lighting and Landscape
Assessment District 1983-1 and approving a contract extension with Francisco & Associates.

RESOLUTION NO. 15-2024
DESIGNATING THE DISTRICT ENGINEER, DIRECTING PREPARATION OF
THE ANNUAL REPORT FOR FISCAL YEAR 2024/25 FOR THE DANVILLE
STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT 1983-1 AND
APPROVING A CONTRACT EXTENSION WITH FRANCISCO & ASSOCIATES
WHEREAS, by its Resolution No. 72-83, the Danville Town Council ordered the
formation of, and levied the first assessment within the Danville Street Lighting and
Landscape Assessment District 1983-1 (the “District”) pursuant to the provisions of the
Landscaping and Lighting Act of 1972 (commencing at Section 22500 of the California
Streets and Highways Code), hereafter referred to as the “Act ”; and
WHEREAS, pursuant to Section 22622 of the Act, the Town Council must adopt a
resolution ordering the District Engineer to prepare the Engineer’s Report required by
the Act to establish the assessment rates for fiscal year 2024/25; and
WHEREAS, there are no substantial changes in the physical improvements maintained
by the District and no proposed changes in assessments to be levied; and
WHEREAS, the Town has previously contracted with the firm of Francisco & Associates
to serve as the District Engineer and desires to continue using the same District Engineer;
now, therefore, be it
RESOLVED, that the Danville Town Council designates Francisco & Associates as
District Engineer for purposes of preparing and filing with the City Clerk a written report
in accordance with Section 22565 of the Act. The District Engineer is directed to
apportion the District assessments in accordance with the benefits received from
improvements by the parcels of land within the District; and be it further
RESOLVED, that the Danville Town Council authorizes the Town Manager to execute a
contract extension with Francisco & Associates for the preparation of the District
Engineer’s report for fiscal year 2024/25.
