Town Council – Regular Meeting SUMMARY OF ACTIONS February 20, 2024 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Stepper at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Karen Stepper, Mayor Dave Fong, Vice Mayor Newell Arnerich, Councilmember Renee Morgan, Councilmember Robert Storer, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Jonas Aguiar. 3. CHANGES TO THE ORDER OF THE AGENDA Town Manager Joe Calabrigo stated that there was a minor edit to agenda item 6.1 which was distributed to the Town Council; item 6.4 will be removed from the consent calendar for a separate vote to address potential conflicts of interest; renderings for the artwork for item 6.8 were distributed to the Town Council; item 6.9 will be moved to follow item 9.1; and, there will be no report for item 7.1. 4. FOR THE GOOD OF THE TOWN Harriet Neely expressed opposition to the pickleball courts proposed for Osage Station Park. Chuck Preas expressed opposition to the pickleball courts proposed for Osage Station Park. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 20, 2024 Julie Philbert expressed opposition to the pickleball courts proposed for Osage Station Park. Ross Smith, San Ramon Valley Kiwanis Foundation, presented the Town a check in the amount of $8,299.42 for purchase, installation, and maintenance of four to five benches, including plaques, along the Camino Tassajara parkway. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation of a proclamation to Kay Wang, Bay Valley Chinese School, in recognition of celebrations of the Lunar New Year Mayor Stepper presented the proclamation. 5.2Presentation of a proclamation to Deputy Chief Jonas Aguiar, San Ramon Valley Fire Protection District, proclaiming February 2024 as American Heart Month Mayor Stepper presented the proclamation. 6. CONSENT CALENDAR A revision was made to item 6.1; item 6.4 was removed for a separate vote; and, item 6.9 was removed to follow item 9.1. 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of February 6, 2024 REVISED 6.2Consider approval of the Register of Demands 6.3Consider acceptance of the December 2023 Month End Treasurer’s Report 6.4Consider adoption of Ordinance No. 2024-01, approving Zoning Text Amendment ZTA 24-0001; and Ordinance No. 2024-02, approving Rezoning RZ 2024-0001 (Danville 2023-2031 General Plan Housing Element) REMOVED FOR SEPARATE VOTE 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 20, 2024 6.5Consider adoption of Resolution No. 9-2024, awarding a construction contract for the installation of speed lumps on Orange Blossom Way, CIP No. C-305 6.6Consider adoption of Resolution No. 10-2024, approving a Notice of Completion for the Front Street Creek Bank Stabilization, CIP Project C-593 6.7Consider adoption of Resolution No. 11-2024, authorizing the Contra Costa County Flood Control and Water Conservation District to adopt the Fiscal Year 2024/25 fee for the Town of Danville Stormwater Utility Area 6.8Consider adoption of Resolution No. 12-2024, authorizing the purchase of metal artwork from Metal Arts Foundry for the Downtown Master Plan Catalyst Project, CIP No. A-362 6.9Consider adoption of Resolution No. 14-2024, awarding a construction contract for the Downtown Master Plan Catalyst Project, CIP No. A-362 REMOVED TO FOLLOW ITEM 9.1 MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER STORER, TO APPROVE THE CONSENT CALENDAR WITH THE EXCEPTION OF ITEM 6.4 AND ITEM 6.9; INCLUDING REVISION TO ITEM 6.1 MOTION CARRIED 5-0 ITEM 6.4 - ORDINANCE NO. 2024-01, APPROVING ZONING TEXT AMENDMENT ZTA 24-0001; AND ORDINANCE NO. 2024-02, APPROVING REZONING RZ 2024- 0001 (DANVILLE 2023-2031 GENERAL PLAN HOUSING ELEMENT) REMOVED FOR SEPARATE VOTE Mayor Stepper stated that three separate votes are necessary for Ordinance No. 2024-01 to address conflicts of interest. City Attorney Rob Ewing stated that Councilmember Arnerich has a conflict of interest because his residence is located within 1,000 feet of the following three sites in DBD 13: R1 (the Wells Fargo Bank at the corner of San Ramon Valley Blvd and Town and Country Drive), R2 (the Town and Country Shopping Center) and S (the Village Shopping Center). The ordinance would amend DBD 13 to 1) increase FAR and 2) allow for emergency shelters. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 20, 2024 Mayor Stepper opened the item to public comment. There were no speakers. Mayor Stepper closed the item to public comment. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER STORER, TO APPROVE SECOND READING AND ADOPTION OF ORDINANCE NO. 2024-01 FOR SITES R1, R2 AND S. MOTION CARRIED 4-0-1-0; COUNCILMEMBER ARNERICH ABSTAINED Mr. Ewing stated that Councilmember Storer has a conflict of interest because he has an ownership interest in the apartment building at 1011 Hartz Way, which is within 500 feet of Site N (the Crossroads Shopping Center, 480 and 486 San Ramon Valley Blvd.) The ordinance would amend DBD 13 to increase FAR and would amend DBD 9 and 13 to allow for emergency shelters. Mayor Stepper opened the item to public comment. There were no speakers. Mayor Stepper closed the item to public comment. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO APPROVE SECOND READING AND ADOPTION OF ORDINANCE NO. 2024-01 FOR SITE N AND FOR ALL PROPERTIES IN DBD 9 MOTION CARRIED 4-0-1-0; COUNCILMEMBER STORER ABSTAINED Mayor Stepper opened the item to public comment on any of the other properties proposed for rezoning in the ordinance. There were no speakers. Mayor Stepper closed the item to public comment. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 20, 2024 MOTION BY COUNCILMEMBER STORER, SECOND BY VICE MAYOR FONG, TO APPROVE SECOND READING AND ADOPTION OF ORDINANCE NO. 2024-01, INCLUDING THE PROPERTIES ALREADY VOTED ON MOTION CARRIED 5-0 MOTION BY COUNCILMEMBER STORER, SECOND BY VICE MAYOR FONG, TO APPROVE SECOND READING AND ADOPTION OF ORDINANCE NO. 2024-02, APPROVING REZONING RZ 2024-0001 (DANVILLE 2023-2031 GENERAL PLAN HOUSING ELEMENT) MOTION CARRIED 5-0 7. TOWN MANAGER’S REPORT 7.1 Monthly Town Manager’s report by Joe Calabrigo - Tabled to March 6, 2024 8. COMMUNICATIONS 8.1Bicycle Advisory Commission report by Chair Bruce Bilodeau Bruce Bilodeau provided the report. 9. ADMINISTRATIVE STAFF REPORTS 9.1Consider adoption of Resolution No. 13-2024, accepting the mid-year Financial Report, approving mid-year adjustments to the Fiscal Year 2023/24 Operating Budget and Capital Improvement Program Town Manager Joe Calabrigo and Finance Director/Treasurer Lani Ha presented the staff report and answered questions from the Town Council. Mayor Stepper closed the item to public comment. 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS FEBRUARY 20, 2024 MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO ADOPT RESOLUTION NO. 13-2024, ACCEPTING THE MID-YEAR FINANCIAL REPORT, APPROVING MID-YEAR ADJUSTMENTS TO THE FISCAL YEAR 2023/24 OPERATING BUDGET AND CAPITAL IMPROVEMENT PROGRAM MOTION CARRIED 5-0 ITEM 6.9 - CONSIDER ADOPTION OF RESOLUTION NO. 14-2024, AWARDING A CONSTRUCTION CONTRACT FOR THE DOWNTOWN MASTER PLAN CATALYST PROJECT, CIP NO.
