Danville Planning Commission – Special Meeting Summary of Actions - Draft January 17, 2024 1. CALL TO ORDER The regular meeting of the Danville Planning Commission was called to order by Chair Radich at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Paul Radich, Chair Mark Graham, Vice Chair Archie Bowles, Commissioner Robert Combs, Commissioner Mary Grace Houlihan, Commissioner Ken Mintz, Alternate Commissioner Lou Palandrani, Commissioner Chris Trujillo, Commissioner 2. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 3. FOR THE GOOD OF THE TOWN There were no public comments. 4. CONSENT CALENDAR 4.1 Consider approval of the Summary of Actions from the regular Planning Commission meeting of October 10, 2023 MOTION BY COMMISSIONER COMBS, SECOND BY VICE CHAIR GRAHAM TO APPROVE THE SUMMARY OF ACTIONS FROM THE REGULAR PLANNING COMMISSION MEETING OF OCTOBER 10, 2023 Danville Planning Commission – Special Meeting Summary of Actions - Draft January 17, 2024 2 MOTION CARRIED 7-0-0-0 5. PUBLIC HEARINGS 5.1 Consider approval of Resolution No. 2024-01, recommending the Town Council adopt the Danville 2023-2031 General Plan Housing Element GPA24-0001, approve General Plan Land Use Amendment GPA24-0002, Rezoning RZ2024-01, and Zoning Text Amendment ZTA24-0001 Chair Radich noted that three members of the Commission have conflicts of interest on some of the potential sites and zoning amendments. How to proceed with the hearing will be addressed during that portion of the meeting. Chief of Planning David Crompton presented the staff report. Mr. Crompton summarized what the Housing Element is, reviewed the work that has been done, and discussed where the Town is currently in the process. Chair Radich opened the item to the Commission for questions. Mr. Crompton answered the Commissioner’s questions. City Attorney Rob Ewing addressed the issue of the Commissioners that have conflicts of interest on some of the potential housing sites and zoning amendments. Mr. Ewing reviewed the conflict of interest segmentation process established by the Fair Political Practices Commission. The public hearing would proceed following that segmentation process. Commissioner Bowles recused himself due to proximity of his home to properties on El Dorado zoned M-30 and left the meeting room. Mr. Crompton gave a brief description of the El Dorado properties which are zoned M-30. Chair Radich opened the public hearing to the public. There were no public comments. There were no questions from the commission. Danville Planning Commission – Special Meeting Summary of Actions - Draft January 17, 2024 3 MOTION BY COMMISSIONER COMBS, SECOND BY VICE CHAIR GRAHAM TO APPROVE ZONING TEXT AMENDMENT ZTA24-01 AMENDING THE M-30 ZONING AS SET FORTH IN ATTACHMENT 4 FOR THE PROPERTIES LOCATED AT 102-201 EL DORADO AVENUE MOTION CARRIED 7-0-1-0; COMMISSIONER BOWLES ABSTAINED Commissioner Bowles re-entered the meeting at 5:31 p.m. Vice Chair Graham recused himself due to proximity of his home to properties zoned M-8 and left the meeting room. Mr. Crompton gave a brief summary of the properties zoned M-8 and answered questions from the Commission. Chair Radich opened the public hearing to the public. There were no public comments. MOTION BY COMMISSIONER COMBS, SECOND BY COMMISSIONER HOULIHAN TO APPROVE ZONING TEXT AMENDMENT ZTA24-01 AMENDING THE M-8 ZONING AS SET FORTH IN ATTACHMENT 4 FOR THE PROPERTIES LOCATED AT 822-830, 852 AND 866 PODVA ROAD, 855-918 PADVA LANE AND ALL OF WESTFIELD CIRCLE MOTION CARRIED 7-0-1-0; VICE CHAIR GRAHAM ABSTAINED Vice Chair Graham re-entered the meeting at 5:34 p.m. City Attorney Rob Ewing explained that Commissioner Mintz was the third Commissioner with conflicts but because his property is directly impacted several of the changes, under FPPC rules, he would recuse himself from the remaining disucssion. Under FPPC rules, he would be allowed to sit with the audience. Commissioner Mintz recused himself to sit with the public. Chair Radich opened the public hearing to any other items that have not been covered or approved to the public. There were two public speakers. Danville Planning Commission – Special Meeting Summary of Actions - Draft January 17, 2024 4 Charles Peladrall, Danville resident expressed concerns over the Land Use Amendment (GPA24-0002). He is concerned that his quality of life and his property value will be impacted. He requested that any members of the Commission associated with the Community Presbyterian Church be excused from the vote. Carole Velasques, Danville resident in the Walnut Forest complex is concerned about the adjoining property changes. She expressed concern over what input local residents will have on new development plans when they are submitted. She is concerned about height, setbacks, easements, and the possibility of her whole development being re-developed. Chair Radich closed public comment and brought it back to staff. Chief of Planning David Crompton and Danville’s City Attorney Rob Ewing addressed the questions from the public and Commissioner questions. MOTION BY COMMISSIONER COMBS, SECOND BY VICE CHAIR GRAHAM TO APPROVE RESOLUTION NO. 2024-01, RECOMMENDING THE TOWN COUNCIL ADOPT THE DANVILLE 2023-2031 GENERAL PLAN HOUSING ELEMENT GPA24-0001, APPROVE GENERAL PLAN LAND USE AMENDMENT GPA24-0002, REZONING RZ2024-01, AND ZONING TEXT AMENDMENT ZTA24-0001 MOTION CARRIED 7-0-0-0 6. SELECTION OF CHAIR AND VICE CHAIR FOR 2024 6.1 Nominations for Chair of the Planning Commission for 2024 MOTION BY COMMISSIONER PALANDRANI, SECOND BY COMMISSIONER HOULIHAN TO NOMINATE VICE CHAIR GRAHAM AS THE 2024 PLANNING COMMISSION CHAIR MOTION CARRIED 7-0-0-0 Chair Graham assumed the Chair’s responsibilities. 6.2 Nominations for Vice Chair of the Planning Commission for 2024 MOTION BY COMMISSIONER COMBS, SECOND BY COMMISSIONER Danville Planning Commission – Special Meeting Summary of Actions - Draft January 17, 2024 5 RADICH TO NOMINATE COMMISSIONER PALANDRANI AS THE 2024 PLANNING COMMISSION VICE CHAIR MOTION CARRIED 7-0-0-0 7. COMMUNICATIONS 7.1 Planning update by Chief of Planning David Crompton Chief of Planning David Crompton gave updates on the Darby project on El Pintado and the Misson project between Camino Tassajara and Sherburne Hills Road. The Commissioners were made aware of the Planning Commissioners Academy coming up in March. 8. COMMISSIONER REPORTS 8.1 Commissioner updates There were no updates. 9.
