Town Council – Regular Meeting and Closed Session SUMMARY OF ACTIONS November 7, 2023 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Robert Storer, Mayor Karen Stepper, Vice Mayor Newell Arnerich, Councilmember Dave Fong, Councilmember Renee Morgan, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Cub Scouts Webelos Den, Montair and Baldwin Elementary Schools, Pack 809, leaders Dr. Jeff and Lydia Abreu. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. Town Manager Joe Calabrigo stated that item 6.1 was revised and changes were distributed to the Town Council. 4. FOR THE GOOD OF THE TOWN There were no speakers. 5. PRESENTATIONS AND PROCLAMATIONS 5.1Presentation of a proclamation to Marie Sunseri, City Clerk, proclaiming the week of November 12-18, 2023, as United Against Hate Week Mayor Storer presented the proclamation. CONSENT CALENDAR 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of October 17, 2023 REVISED 6.2Consider approval of the Register of Demands 6.3Consider adoption of Resolution No. 77-2023, appropriating funds and authorizing the purchase of two vehicles to replace two existing vehicles that have reached the end of their useful life in the Police Department’s Abandoned Vehicle Abatement Program 6.4Consider adoption of Resolution No. 78-2023, approving a Notice of Completion for the Camino Ramon Improvements Project, CIP No. C-601 6.5Consider adoption of Resolution No. 79-2023, awarding a construction contract and transferring funds from CIP No. C-610 to the El Pintado Road Paving and Drainage Improvements Project, CIP No. C-402 6.6Consider adoption of Resolution No. 80-2023, approving a Notice of Completion for the Park and Ride Improvements Project, CIP No. C-598 MOTION BY VICE MAYOR STEPPER, SECOND BY COUNCILMEMBER ARNERICH, TO APPROVE THE CONSENT CALENDAR; INCLUDING REVISIONS TO ITEM 6.1 MOTION CARRIED 5-0 7. TOWN MANAGER’S REPORT 7.1 Monthly Town Manager’s report by Joe Calabrigo Joe Calabrigo stated that a written report was distributed to the Town Council in advance of this meeting and he will not be providing a verbal report. 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 7, 2023 8. COMMUNICATIONS 8.1Contra Costa County Library Commission report by Danville representative Nicole Gemmer Nicole Gemmer provided the report. 8.2Maintenance Department Report by Director Dave Casteel Dave Casteel provided the report. 9. PUBLIC HEARINGS 9.1Consider introduction of Ordinance No. 2023-09, amending Section 32-94.5 of the Danville Municipal Code relating to retail delivery of medical cannabis City Attorney Rob Ewing presented the staff report. Mayor Storer opened the item to public comment. There were no speakers. Mayor Storer closed the item to public comment. MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2023- 09, AMENDING SECTION 32-94.5 OF THE DANVILLE MUNICIPAL CODE RELATING TO RETAIL DELIVERY OF MEDICAL CANNABIS AND RETURN FOR SECOND READING ON NOVEMBER 21, 2023 MOTION CARRIED 5-0 9.2Consider introduction of Ordinance No. 2023-10, amending Section 2-1.3b of the Danville Municipal Code relating to Town Council compensation City Attorney Rob Ewing presented the staff report. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 7, 2023 Mayor Storer opened the item to public comment. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO INTRODUCE AND READ BY TITLE ONLY ORDINANCE NO. 2023-10, AMENDING SECTION 2-1.3B OF THE DANVILLE MUNICIPAL CODE RELATING TO TOWN COUNCIL COMPENSATION AND RETURN FOR SECOND READING ON NOVEMBER 21, 2023 MOTION CARRIED 5-0 10. ADMINISTRATIVE STAFF REPORTS (Public comment invited) 10.1Consider adoption of Resolution No. 81-2023, authorizing execution of a site host agreement with EV Charging Solutions, Inc. to provide third-party electric vehicle charging equipment and services Transportation Program Specialist Adam Cleary presented the staff report. Mayor Storer opened the item to public comment. There were no speakers. Mayor Storer closed the item to public comment. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY VICE MAYOR STEPPER, TO ADOPT RESOLUTION NO. 81-2023, AUTHORIZING EXECUTION OF A SITE HOST AGREEMENT WITH EV CHARGING SOLUTIONS, INC. TO PROVIDE THIRD- PARTY ELECTRIC VEHICLE CHARGING EQUIPMENT AND SERVICES MOTION CARRIED 5-0 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 7, 2023 11. TOWN COUNCIL REPORTS 11.1Appoint Design Review Board member to the Historic Design Review Committee for a four-year term MOTION BY COUNCILMEMBER FONG TO APPOINT DESIGN REVIEW BOARD MEMBER KEVIN WONG TO THE HISTORIC DESIGN REVIEW COMMITTEE FOR A FOUR-YEAR TERM MOTION CARRIED 5-0 11.2Town Council updates Councilmembers provided updates on events and activities in Danville. 12. ADJOURN TO CLOSED SESSION The regular meeting of the Danville Town Council adjourned to a publicly noticed closed session at 6:09 p.m. 13. CALL TO ORDER CLOSED SESSION Mayor Storer called the closed session to order at 6:12 p.m. 13.1Public comment There were no speakers. 13.2Closed Session pursuant to Government Code Section 54957, Public Employee Performance Evaluation, Title: Town Manager 13.3Closed Session pursuant to Government Code Section 54957.6, Conference with Labor Negotiator Agency Designated Representative: Mayor Robert Storer; Unrepresented Employee: Town Manager 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS NOVEMBER 7, 2023 13.4Report on Closed Session Mayor Storer reported that no action was taken. 14. ADJOURN - No further business will be conducted.
