SUBJECT: Resolution No. 78-2023, approving a Notice of Completion for the Camino
Ramon Improvements Project, CIP No. C-601
BACKGROUND
The Camino Ramon Improvements Project, CIP No. C-601 is located on Camino Ramon
from Kelley Lane to Fostoria Way. The Camino Ramon Improvements Project consists of
roadway paving improvements, sidewalks at bus stop locations, pedestrian crossing
improvements, high -visibility bike lane and crosswalk striping marking upgrades, and
traffic signal video detection and pedestrian signal upgrades.
DISCUSSION
The project is now complete and ready for acceptance by the Town. All work was performed
in accordance with the approved plans and specifications.
The original contract amount of $2,012,133.50 was increased by $131,474 as a result of three
Contract Change Orders. The change orders consisted of a bid item adjustment, installing
four new pedestrian push buttons at four locations, and restoring damaged pavement due
to a water main break.
The final contract amount of $2,143,607.50 (contract plus change orders) is within the
authorized construction budget for this project.

RESOLUTION NO. 78-2023
APPROVING A NOTICE OF COMPLETION FOR THE CAMINO RAMON
IMPROVEMENTS PROJECT, CIP NO. C-601
WHEREAS, on March 7, 2023, the Town of Danville awarded a construction contract to
MCK Services, Inc. for the Camino Ramon Improvements Project, CIP No. C-601; and
WHEREAS, the City Engineer has determined that the work under this project has been
completed as of October 13, 2023, in accordance with the plans and specifications thereof;
and
WHEREAS, California Civil Code section 9204 specifies the requirements for recordation
of a Notice of Completion; and
WHEREAS, not less than thirty days (30) nor more than forty-five (45) days after a Notice
of Completion is recorded the Town must release all undisputed retention payments to
the contractor; now, therefore, be it
RESOLVED, by the Danville Town Council that said work by and with MCK Services,
Inc. is hereby accepted as complete; and, be it further
RESOLVED, that the City Clerk is hereby authorized and directed to file with the County
Recorder of County of Contra Costa, a Notice of Completion for said project within fifteen
(15) days from the date hereof; and, be it further
RESOLVED, that undisputed retention payments be released in accordance with
Sections 8812 and 9356 of the California Civil Code.

RESOLUTION NO. 21-2023
AWARDING A CONSTRUCTION CONTRACT AND TRANSFERRING FUNDS
FROM CIP NO. C-610 PAVEMENT MANAGEMENT TO CIP NO. C-601 CAMINO
RAMON IMPROVEMENTS
WHEREAS, the Danville Town Council has previously approved funding in the Capital
Improvement Program for Camino Ramon Improvements, CIP No. C-601; and
WHEREAS, the funding includes a grant from the One Bay Area Grant II (OBAG II), a
federal grant program administered by Caltrans; and
WHEREAS, Caltrans, acting on behalf of the Town, has determined that the project is
Categorically Exempt from requirements of the California Environmental Quality Act
(CEQA); and
WHEREAS, bids were solicited from contractors for the project; and
WHEREAS, the City Clerk of this Town did, in open session on the 23rd day of February,
2023, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, of the 7 bids received, the lowest responsive bid was submitted by MCK
Services of Martinez, California, and the City Engineer recommends awarding a
construction contract for the project to said contractor; now, therefore, be it
RESOLVED, by the Danville Town Council, that funds in the amount of $520,000 be
transferred from Pavement Management (CIP No. C-610) to Camino Ramon
Improvements (CIP C-601) to fund construction of the project; and, be it further
RESOLVED, by the Danville Town Council, that the Town award a construction contract
for Camino Ramon Improvements, CIP No. C-601, to MCK Services of Martinez,
California; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with MCK Services of
Martinez, California for $2,012,133.50 and authorize use of a 15% contingency not -to -
exceed $305,000 for a total construction budget of $2,317,133.50 for work in connection
therewith, and the City Clerk is hereby directed to attest same and affix thereto the official
seal of the Town; and, be it further
RESOLVED, that staff shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to

journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)
