SUBJECT: Resolution No. 79-2023, awarding a construction contract and transferring
funds from CIP No. C-610 to the El Pintado Road Paving and Drainage
Improvements project, CIP No. C402
BACKGROUND
The Town's Capital Improvement Program includes the El Pintado Road Paving and
Drainage Improvements project. This project will construct drainage and paving
improvements on El Pintado Road from El Cerro Boulevard to La Gonda Way.
DISCUSSION
Eleven bids were received and opened on October 26, 2023. The lowest responsive bid
was submitted by McGuire and Hester of Alameda, California, with a bid of $1,367,684.
Bid results are summarized in Attachment C. The Engineer's estimate was $1,287,892.
The work is scheduled to begin in winter 2023 and be completed in early 2024, weather
permitting.
PUBLIC CONTACT
Posting of the meeting agenda serves as notice to the general public. Before construction
begins, residents and businesses within close proximity to the project will be notified by
the contractor in writing. In addition, project identification signs will be posted.
FISCAL IMPACT
The low bid amount of $1,367,684, plus a 15% contingency amount of $205,200, yields a
total construction budget of $1,572,884. A transfer from CIP No. C-610 Pavement
Management in the amount of $230,000 is needed to fully fund the project.
RECOMMENDATION
Adopt Resolution No. 79-2023, awarding a construction contract and transferring funds
from CIP No. C-610 to the El Pintado Road Paving and Drainage Improvements project,
CIP No. C-402.

RESOLUTION NO. 79-2023
AWARDING A CONSTRUCTION CONTRACT AND TRANSFERRING FUNDS
FROM CIP NO. C-610 TO THE EL PINTADO ROAD PAVING AND DRAINAGE
IMPROVEMENTS PROJECT, CIP NO. C402
WHEREAS, the Danville Town Council has previously approved funding in the Capital
Improvement Program for El Pintado Overlay - El Cerro Blvd. to I-680, CIP No. C-402;
and
WHEREAS, the projects include paving and drainage improvements on El Pintado Road
from El Cerro Boulevard to La Gonda Way; and
WHEREAS, bids were solicited from contractors for the project; and
WHEREAS, the City Clerk of this Town did, in open session on the 26th day of October,
2023, publicly open and read aloud the sealed bids received as required by law; and
WHEREAS, of the eleven bids received, the lowest responsive bid was submitted by
McGuire and Hester of Alameda, California, and the City Engineer recommends
awarding a construction contract for the project to said contractor; now, therefore, be it
RESOLVED, by the Danville Town Council, that funds in the amount of $230,000 be
transferred from Pavement Management (CIP No. C-610) to El Pintado Road Paving and
Drainage Improvements (CIP C-402) to fund construction of the project; and, be it further
RESOLVED, by the Danville Town Council, that the Town award a construction contract
for the El Pintado Road Paving and Drainage Improvements, CIP No. C-402, to McGuire
and Hester of Alameda, California; and, be it further
RESOLVED, by the Danville Town Council, that the Town Manager be and hereby is
authorized to execute, on behalf of the Town, a written contract with McGuire and Hester
of Alameda, California for $1,367,684 and authorize use of a 15% contingency not -to -
exceed $205,200, for a total construction budget of $1,572,884, for work in connection
therewith, and the City Clerk is hereby directed to attest same and affix thereto the official
seal of the Town; and, be it further
RESOLVED, that staff shall within five (5) days of the adoption of this resolution,
transmit an Extract of Public Works contract award to the Department of Industrial
Relations, Division of Apprenticeship Standards, P.O. Box 420603, San Francisco, CA
94142. (Note: Should a finding of any discrepancy regarding this ratio of apprentices to
journeymen be made, the Town shall notify the Division of Apprenticeship Standards of
such findings.)

PROJECT DESCRIPTION AND LOCATION:
This project includes asphalt dig -out and repairs, an overlay with
reinforcing fabric and some shoulder backing.
Funding for a portion of this project is proposed to come from deferred
improvement agreements.
The deferred improvement agreement funding has not been collected
from the property owners.
A portion of this project was completed in April of 2011, spending all of the
CIP General Purpose Revenue and Measure J Return to Source funds.
Construction phase to begin in summer 2023
