Danville Planning Commission – Regular Meeting Summary of Actions - Draft September 12, 2023 1. CALL TO ORDER The regular meeting of the Danville Planning Commission was called to order by Chair Radich at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Paul Radich, Chair Mark Graham, Vice Chair Archie Bowles, Commissioner Robert Combs, Commissioner Ken Mintz, Commissioner Lou Palandrani, Commissioner Chris Trujillo, Chair Excused: Mary Grace Houlihan, Commissioner 2. CHANGES TO THE ORDER OF THE AGENDA There were no changes to the order of the agenda. 3. FOR THE GOOD OF THE TOWN There were no public comments. 4. CONSENT CALENDAR 4.1 Consider approval of the Summary of Actions from the regular Planning Commission meeting of August 8, 2023 4.2 Consider approval of Resolution No. 2023-10, approving Land Use Permit request LUP23-0023 reapproving expired Land Use Permit DEV11-0055 authorizing the continued operation of an unmanned wireless Danville Planning Commission – Regular Meeting Summary of Actions - Draft September 12, 2023 2 telecommunication facility at 3500 Blackhawk Road, which is located within a Town-identified Scenic Hillside area (APN: 215-080-023 MOTION BY VICE CHAIR GRAHAM, SECOND BY COMMISSIONER COMBS TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 7-0-0-1; COMMISSIONER HOULIHAN EXCUSED 5. PUBLIC HEARINGS 5.1 Consider approval of Resolution No. 2023-11, denying an appeal by Marc and Michelle Collopy of the Town’s denial of Land Use Permit request LUP23-25 to allow a special event for Auburn Lounge on August 10, 2023, including an expanded outdoor use area in the adjacent courtyard and live amplified outdoor music. The site is located at 321 Hartz Avenue David Crompton, Chief of Planning, presented the staff report and answered the Commissioner’s questions. Michelle Collopy, applicant, owner of Auburn Lounge presented her request of four special events per year to be held outside of their private patio outside of their lounge. She also spoke on the violations and complaints that have been filed against Auburn Lounge. A slideshow presentation was given to show other establishment's events with amplified music. Ms. Collopy answered the Commissioner's questions. Chair Radich opened the item to public comment. Mr. Crompton and Robert Ewing, City Attorney answered the Commissioner's questions. MOTION BY COMMISSIONER BOWLES, SECOND BY COMMISSIONER COMBS TO UPHOLD THE APPEAL BY MARC AND MICHELLE COLLOPY OF THE TOWN’S DENIAL OF LAND USE PERMIT REQUEST LUP23-0025 AND TO ALLOW THE NEXT REQUESTED SPECIAL EVENT FOR AUBURN LOUNGE WITH THE ALLOWANCE OF OUTDOOR AMPLIFIED MUSIC WITH THE FOLLOWING CONDITION: • FUTURE ADDITIONAL LAND USE PERMITS MAY BE APPROVED DEPENDING UPON AN EVALUATION OF THE FIRST EVENT RELATED TO COMPLIANCE WITH CONDITIONS OF APPROVAL AND IMPACTS ON OTHER BUSINESSES IN THE VICINITY MOTION CARRIED 7-0-0-1; COMMISSIONER HOULIHAN EXCUSED 6. COMMUNICATIONS 6.1 Update regarding the status of the Town’s 2023-2031 Housing Element Mr. Crompton updated the Commission on the edits that have been made to the Housing Element. We will re-submit the Housing Element to the state in the next few weeks and the state has 60 days to review and get back to us. 7. COMMISSIONER REPORTS 7.1 Commissioner updates Vice Chair Graham expressed the need for reviewing and possibly changing the Town of Danville’s Noice Ordinance. 8.
