HomeMy WebLinkAbout100323-06.8 ADMINISTRATIVE STAFF REPORT 6.8 TO: Mayor and Town Council October 3, 2023 SUBJECT: Resolution No. 73-2023, appropriating funding and authorizing execution of a contract with Francisco and Associates to perform a benefit analysis related to Street Lighting and Landscape Assessment District No. 1983-1 Improvements BACKGROUND Since the Town’s incorporation in 1982, a portion of the Town’s maintenance budget has been funded through assessments levied by the Danville Street Lighting and Landscape Assessment District No. 1983-1 (the “LLAD”). In 1997, property owners in Town ratified the assessments existing at that time with more than 87% support. In 2003, property owners approved an increase in assessments to the current levels. The rates did not include any annual CPI or escalator, and the Town has not proposed any additional increases in assessments during the past 20 years. While the rates have not increased, maintenance costs have. DISCUSSION At their August 15, 2023 study session, the Town Council discussed the LLAD budget, including a review of both substantive and procedural issues that would arise should the Town wish to propose an increase in the assessment rates and other potential options available to assist in funding some or all of these maintenance functions. Town staff was subsequently directed to work with Francisco and Associates, the Town’s District Engineer for over 20 years, to perform a benefit analysis of the LLAD and proposed assessment methodology. To that end, Francisco and Associates has developed a detailed project scope with a time and materials fee not to exceed $30,000. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. FISCAL IMPACT The contract with Francisco and Associates for services related to the LLAD benefit analysis is $30,000. It is recommended that the Town Council appropriates $30,000 from the General Fund Contingency Fund. Calabrigo Town Manager Attachment: Resolution No. 73-2023 RESOLUTION NO. 73-2023 APPROPRIATING FUNDING AND AUTHORIZING EXECUTION OF A CONTRACT WITH FRANCISCO AND ASSOCIATES TO PERFORM A BENEFIT ANALYSIS RELATED TO STREET LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT NO. 1983-1 IMPROVEMENTS WHEREAS, by its Resolution No. 72-83, the Danville Town Council ordered the formation of, and levied the first assessment within the Danville Street Lighting and Landscape Assessment District 1983-1 (the “District”) pursuant to the provisions of the Landscaping and Lighting Act of 1972 (commencing at Section 22500 of the California Streets and Highways Code), hereafter referred to as the “Act ”; and WHEREAS, assessment rates for the District were last increased in 2003; and WHEREAS, at their August 15, 2023, study session, the Town Council discussed the Lighting and Landscape Assessment District budget, including a review of both substantive and procedural issues that would arise should the Town wish to propose an increase in the assessment rates and other potential options available to assist in funding some or all of these maintenance functions; and WHEREAS, Francisco and Associates, the Town’s longtime District Engineer, has prepared a project scope to perform said benefit analysis; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town award the contract to Francisco and Associates for Lighting and Landscape Assessment District benefit analysis, appropriating $30,000 from the General Fund Contingency Fund; and be it further RESOLVED, that the Danville Town Council authorizes the Town Manager to execute a contract with Francisco and Associates for the preparation of the Lighting and Landscape Assessment District benefit analysis.
