Town Council – Regular Meeting SUMMARY OF ACTIONS August 15, 2023 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Robert Storer, Mayor Karen Stepper, Vice Mayor Newell Arnerich, Councilmember Dave Fong, Councilmember Excused: Renee Morgan, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by San Ramon Valley Fire Chief Aguiar and Assistant Chief Duggan. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes. 4. FOR THE GOOD OF THE TOWN San Ramon Valley Fire Chief Aguiar and Assistant Chief Duggan invited the community to a fundraising event for the Muscular Dystrophy Association on September 9, 2023, at Primo’s Pizza. Dick Heron, Walnut Creek Watershed Council, provided an update and distributed the 2022 Achievement Report. Alan Kalin invited the community to attend an event at the Veterans Memorial Building on August 25, 2023. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 15, 2023 Chuck Preas expressed opposition to pickleball courts proposed for Osage Station Park. Tony Lukaszewski expressed appreciation to Councilmember Arnerich for his compassion after Mr. Lukaszewski’s son was held at gunpoint in Walnut Creek last year. The following individuals expressed opposition to Danville adopting an ordinance for gun storage: Terry Thompson Lee Halverson Pat Fernwood Mark Fernwood Brian Cameron Greg Marvel Janet Crowle D. Yuers, Major U.S. Air Force, Retired Harold Stoner Rob Baker Ben Wagner Bill Baker The following individuals submitted speaker cards in opposition to Danville adopting an ordinance for gun storage and did not address the Town Council: Chuck Lamb Steve and Sheri Kicherer 5. PRESENTATIONS AND PROCLAMATIONS 5.1Reading of a proclamation by Mayor Storer proclaiming August 31, 2023, as International Overdose Awareness Day Mayor Storer presented the proclamation. 2 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 15, 2023 6. CONSENT CALENDAR Vice Mayor Stepper removed item 4 for a separate vote. 6.1Consider approval of the Summary of Actions from the regular Town Council meeting of July 18, 2023 6.2Consider approval of the Register of Demands 6.3Consider acceptance of the June 2023 Month End Treasurer’s Report 6.4Consider adoption of Resolution No. 59-2023, authorizing the installation of two on-street Americans with Disabilities Act (“ADA”) accessible parking spaces along the frontage of 400 Hartz Avenue REMOVED 6.5Consider adoption of Resolution No. 60-2023, approving Quitclaim Lack of Abutters Rights located at 24 Noble Oaks Lane, APN 206-160-032 MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER FONG, TO APPROVE THE CONSENT CALENDAR WITH THE EXCEPTION OF ITEM 6.4 MOTION CARRIED 4-0-0-1; COUNCILMEMBER MORGAN ABSENT ITEM 6.4 - CONSIDER ADOPTION OF RESOLUTION NO. 59-2023, AUTHORIZING THE INSTALLATION OF TWO ON-STREET AMERICANS WITH DISABILITIES ACT (“ADA”) ACCESSIBLE PARKING SPACES ALONG THE FRONTAGE OF 400 HARTZ AVENUE - REMOVED Transportation Manager Andrew Dillard presented an overview of the proposed Resolution. Vice Mayor Stepper made suggestions for alternative locations for the ADA parking spots proposed to be located proximate to the Veterans Memorial Building and suggested that Town staff get input from the veterans’ organizations who occupy the Veterans Memorial Building. Councilmember Arnerich made further suggestions for alternative locations. 3 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 15, 2023 Councilmember Fong suggested reviewing all parking spots assigned to the building to determine the parking needs for the veterans. Mayor Storer expressed support for the Resolution as presented. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY MAYOR STORER, TO ADOPT RESOLUTION NO. 59-2023, AUTHORIZING THE INSTALLATION OF TWO ON-STREET AMERICANS WITH DISABILITIES ACT (“ADA”) ACCESSIBLE PARKING SPACES ALONG THE FRONTAGE OF 400 HARTZ AVENUE Mayor Storer requested a roll call vote: MOTION FAILED 2-2-0-1; COUNCILMEMBER FONG AND VICE MAYOR STEPPER OPPOSED; COUNCILMEMBER MORGAN ABSENT There was Town Council consensus to continue the item to September 5, 2023, to allow staff time to get input from the veterans. 7. TOWN MANAGER’S REPORT 7.1 Monthly Town Manager’s report by Joe Calabrigo Joe Calabrigo provided the report. 8. COMMUNICATIONS 8.1Legislative update by Management Analyst Cat Bravo Cat Bravo provided the report. 9. ADMINISTRATIVE STAFF REPORT 9.1 FY 2023/24 Business Promotion Funds – Funding Allocation Plan Public Information Officer Jenn Starnes presented the report. Mayor Storer opened the item to public comment. 4 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 15, 2023 There were no speakers. Mayor Storer closed the item to public comment. MOTION BY VICE MAYOR STEPPER, SECOND BY COUNCILMEMBER ARNERICH TO DIRECT STAFF TO CONTINUE THE BUSINESS PROMOTION PROGRAM AS IMPLEMENTED IN FY 2022-23, DESIGNATING $25,000 FOR THE HOLIDAY MARKETING CAMPAIGN AND $25,000 TO FUND THE BUSINESS PROMOTION GRANT PROGRAM MOTION CARRED 4-0-0-1; COUNCILMEMBER MORGAN ABSENT 10. TOWN COUNCIL REPORTS 10.1Appoint one Danville representative to the Iron Horse Corridor Management Program Advisory Committee for a four-year term MOTION BY VICE MAYOR STEPPER TO APPOINT CHARLIE NEARY, MEMBER OF THE PARKS, RECREATION AND ARTS COMMISSION TO THE IRON HORSE CORRIDOR MANAGEMENT PROGRAM ADVISORY COMMITTEE FOR A FOUR- YEAR TERM Vice Mayor Stepper suggested that future recommendations for appointments be made by the Bicycle Advisory Commission instead of the Parks, Recreation and Arts Commission. MOTION CARRIED 4-0-0-1; COUNCILMEMBER MORGAN ABSENT 10.2Appoint one Councilmember as Voting Delegate and one Councilmember as Alternate Voting Delegate for the League of California Cities Annual Conference and Expo in Sacramento, September 20-22, 2023 MOTION BY MAYOR STORER TO APPOINT COUNCILMEMBER ARNERICH AS VOTING DELEGATE, NO ALTERNATE, FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE AND EXPO IN SACRAMENTO, SEPTEMBER 20-22, 2023 MOTION CARRIED 4-0-0-1; COUNCILMEMBER MORGAN ABSENT 5 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 15, 2023 10.3Southwest Area Transportation Committee report by Vice Mayor Stepper Vice Mayor Stepper provided the report. 10.4Tri-Valley Transportation Council report by Councilmember Arnerich Councilmember Arnerich provided the report. 10.5Town Council updates Councilmembers provided updates on events and activities in Danville. 11. ADJOURN TO CLOSED SESSION The regular meeting of the Danville Town Council was adjourned to a Closed Session at 6:37 p.m. in memory of Mike Kalfos, Danville Maintenance Services Supervisor. 12. CALL TO ORDER CLOSED SESSION The Closed Session was called to order at 6:40 p.m. 12.1Public comment There was no public comment. 12.2Closed Session - Existing Litigation, Government Code Section 54956.9(a). Name of Case: Town of Danville v. Contra Costa County, et al., Contra Costa County Superior Court, Case No. MSN21-1525 12.3Closed Session - Conference with Legal Counsel-Anticipated Litigation Significant exposure to litigation pursuant to Government Code Section 54956.9(b)-one case 12.4Report on Closed Session Mayor Storer reported out of Closed Session that no action was taken. 6 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS AUGUST 15, 2023 13.
