HomeMy WebLinkAbout070523-06.5 ADMINISTRATIVE STAFF REPORT 6.5 TO: Mayor and Town Council July 5, 2023 SUBJECT: Resolution No. 55-2023, authorizing the Town Manager to accept grant funds in the amount of $20,935.20 from the State of California for the Cannabis Tax Fund Grant Program administered by the California Highway Patrol and authorizing the Chief of Police or Town Manager to execute the Grant Program Agreement and to allocate the non-matching grant funds to train and deploy Police Department staff to reduce collisions due to impaired driving BACKGROUND In November 2016, California voters passed Proposition 64: The Adult Use of Marijuana Act. With the passage of Proposition 64, the California voters mandated the state set aside funding for the California Highway Patrol (CHP) to award grants to local governments and qualified nonprofit organizations. Pursuant to Revenue and Taxation Code Section 34019(F)(3)(B), funds will be disbursed, “To the Department of the California Highway Patrol to fund internal California Highway Patrol programs and grants to qualified nonprofit organizations and local governments for education, prevention and enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis; programs that help enforcement traffic laws, educate the public in traffic safety, provide varied and effective means of reducing fatalities, injuries and economic losses from collisions and for the purchase of equipment related to enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis.” Between January 2018 and January 2023, Danville Police have made 249 DUI arrests. Sixty- five (65) of those arrests were made after the impaired driver was involved in a traffic collision, and 10 of the 65 collisions resulted in injuries to an involved party. The Danville Police Department has received notice of a conditional approval for Grant funding. To be considered, the Town must adopt a Resolution accepting the award and execute the required documents. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. Cannabis Grant Acceptance Resolution 2 July 5, 2023 FISCAL IMPACT Positive. The $20,935.20 grant is a non-matching grant and no funds are required to accept and expend grant funding. RECOMMENDATION Adopt Resolution No. 55-2023, authorizing the Town Manager to accept grant funds in the amount of $20,935.20 from the State of California for the Cannabis Tax Fund Grant Program administered by the California Highway Patrol and authorizing the Chief of Police or Town Manager to execute the Grant Program Agreement and to allocate the non-matching grant funds to train and deploy Police Department staff to reduce collisions due to impaired driving. Prepared by: Kevin Escover Police Officer Reviewed by: Allan Shields Chief of Police Attachment: Resolution No. 55-2023 RESOLUTION NO. 55-2023 AUTHORIZING THE TOWN MANAGER TO ACCEPT GRANT FUNDS IN THE AMOUNT OF $20,935.20 FROM THE STATE OF CALIFORNIA FOR THE CANNABIS TAX FUND GRANT PROGRAM ADMINISTERED BY THE CALIFORNIA HIGHWAY PATROL AND AUTHORIZING THE CHIEF OF POLICE OR TOWN MANAGER TO EXECUTE THE GRANT PROGRAM AGREEMENT AND TO ALLOCATE THE NON-MATCHING GRANT FUNDS TO TRAIN AND DEPLOY POLICE DEPARTMENT STAFF TO REDUCE COLLISIONS DUE TO IMPAIRED DRIVING WHEREAS, the Town of Danville (Town) is interested in participating in the Cannabis Tax Fund Grant Program (the Grant Program), which is made available through the Control, Regulate and Tax Adult Use of Marijuana Act of 2016 (Proposition 64) and administered by the California Highway Patrol to support local law enforcement for education, prevention and enforcement of impaired driving laws in the Town; and WHEREAS, following the Town’s submittal of Grant Program application to the California Highway Patrol, the Town was awarded $20,935.20 in non-matching grant funds; and WHEREAS, the Town is familiar with and willing and able to comply with each of the terms, conditions and limitations imposed upon the Town pursuant to the Grant in implementing education, prevention and enforcement of impaired driving laws in the Town; and WHEREAS, to be eligible to receive Grant Program funding, the Town must adopt a Resolution accepting the award and execute the required documents in relation thereto; now, therefore, be it RESOLVED, by the Danville Town Council, that the Town Manager is hereby authorized to accept the award of grant funds in the amount of $20,935.20 from the State of California Cannabis Tax Fund Grant Program administered by the California Highway Patrol; and, be it further RESOLVED, by the Danville Town Council, that the Town Manager or Chief of Police is hereby authorized to execute the Grant Fund Agreement and allocate non-matching grant funds to train and deploy Police Department staff to reduce collisions due to impaired driving.
