HomeMy WebLinkAboutASRDRB20230413 5.1ADMINISTRATIVE STAFF REPORT 591 TO: Design Review Board Members April 13, 2023 SUBJECT: Review and approve the final building permit and landscape plans and details for a previously approved 50-unit senior condominium development at 375 West El Pintado Road (Project Planner: David Crompton). DISCUSSION This application is for a revised Final Development Plan consisting of two parcels located at 375 & 359 West El Pintado consisting of 1.9 acres. The project was previously reviewed by the Design Review Board in December 2021, and was approved by the Planning Commission in July 2022. The approval was for a 57-unit development and the applicant is now requesting to reduce the number of units to 50. This would not change the exterior of the buildings and would maintain a net density above 30 units per acre which is needed for Housing Element purposes. The proposed development consists of three buildings. The main building would consist of two residential stories over a parking garage. This building steps down from West El Pintado. The proposal includes a two-story building fronting West El Pintado south of the main building, and a three-story building on the west side of the site, abutting the parking lot for the office building fronting El Cerro Blvd. EVALUATION • The proposed three valley oak trees on the north west side of the parking garage should be an evergreen variety of oak, such as the coast live oak or pin oak. • The development appears to be consistent with the previous approval. • Colors and materials will be presented at the meeting. • Full size plans are available at the Town offices. RECOMMENDATION Review and approve the final building permit plans and landscape plans and details for a previously approved 50-unit senior condominium development at 375 West El Pintado Road. Per our discussion and the Town of Danville's Tree Preservation Ordinance Chapter 32-79, the scope of work includes: • Site visit to update the trunk measurements and conditions of all protected trees on or overhanging the property, within 50' of proposed improvements. Protected trees are defined as: n Any of the following native trees with a trunk 10" or greater in diameter measured at 4.5' above grade, or for a multi-trunked tree, a combination of trunks totaling 20" or greater in diameter: Canyon Live Oak (Quercus chrysolepis), Blue Oak (Q. douglasir), California Black Oak (Q. kelloggi), Interior Live Oak (Q. wislizenh), White Alder (Alnus rhombifolia), California Bay (Umbellularia cal#brnica), Coast Live Oak (Q. agrifolia), Valley Oak (Q. lobata), California Buckeye (Aesculus californice), California Sycamore (Platanusracemosa), Madrone (Arbutus menziesit), London Plane Tree (Platanus acerifolia) Any Heritage (> 36" diameter) or Memorial tree. Clarification of omitted trees Other projects were previously proposed for this site. In 2014, a tree inventory was completed and every tree on the site was tagged with a number tagged. Traverso Tree Service, Inc. was first involved in 2018; we adapted the same trees from the 2014 inventory. Since then discussions with Town staff about unrelated projects) clarified the arborist re ort ( p J ) P requirements -they only needed to address protected trees. Heritage tree status also does not apply to multi -stemmed trees. Both of these criteria have been used to refine the arborist requirements forthis site; non -protected trees are no longer included in this report. Tree tags were not removed or changed to maintain transparency with regards to the property's past. Arbonst Report 359 & 375 W EI Pint Raid February 17 2023 Project Background &r Summary The project site comprises two parcels on W EI Pintado Road, totaling 1.89 acres. The larger lot at 375 W El Pintado is undeveloped, with a swale running diagonally through the west half of the property (Figure 1). The far east side of the property drops sharply down to VV El Pintado Road, reaching elevations up to 10' above the road at the highest point. The smaller property at 359 W EI Pintado has a single-family home with a small Swale along its south property lime. Existing trees are largely concentrated along the perimeters of the two parcels and along the existing Swale. The proposed project will demolish the existing house on the smaller parcel and construct a high -density multi -level senior living facility across both parcels. The main building will occupy the majority of the site, with smaller buildings to the north) and southeast. Parking will be provided on the ground levels of the buildings. The area northwest of the existing Swale will be converted to a wetland mitigation area. Direction to reduce tree impact was provided to the design team along the way; the site itself proved to be challenging to the redesign process. It is my opinion that 14 trees will need to be removed to accommodate the proposed project_ An additional valley oak (tree tag 91) may atso need to be removed if root loss is high, as it is located above the wetland mitigation area. A fewtrees were not surveyed, s❑ I approximately located them on the tree protection plan. The health and structure of the trees were assessed visually from ground level, No drilling, root excavation, or aerial inspections were performed. Internal or non -detectable defects may exist and could lead to part or whole tree failures. Due to the dynamic nature of trees and their environment, it is not possible for arborists to guava ntee that trees will not fail in the future. Tree Inventory & Assessment Table #s: Each tree has a square metal tag with numbers between from #1-91 - most of the numbers are not included- Their locations are given in the tree protection plan - DBH {Diameter at Breast Height): Trunk diameters in inches were measured at 45 above average grade with a diameter tape, Height of measurement may deviate from the standard on atypical trunks; deviations are noted under the "Comments" section - Health Rating Dead: Dead or declining past chance of recovery. Poor (P): Stunted or declining canopy, sparsely foliated with poor foliar color. Possible disease or insect issues. Unreliable specimen for preservation. Would require significant maintenance, and a protection zone well beyond the drip line in order to retain. Acceptable to leave for nature f not a threat to property. Fair (Fj: Fair to moderate vigor, typical for the species. Will require an adequate protection zone, and supplemental maintenance such as: crown cleaning of mistletoe, dead, broken, or diseased branches. Theo en- rown trees have better form and p g structure than those in groves, where competition forces the understory trees to grow lopsided and asymmetrical. The single London planetree is still in fair health but shows symptoms of drought stress. Multiple design iterations have occurred with regards to tree preservation. In particular, the steep slope along the east property line presented a challenge - two of the best oak specimens (#9 & 11, Figure 2) are growing at the top of the knoll, well above the elevation of the road. A significant breadth, upwards of 25' radius in each direction, would be needed to s: preserve the trees. Additionally, most of the t , area northwest of the existing Swale has been set aside as a wetland mitigation area. Grading is anticipated throughout the. space, with the exception of two plateaus - Figure 2. 0ak#9 is the best specimenonthe property, but including one surrounding tree #1. Proposed grading for the mitigation area will come as close as 7' south of the oak, with a wider native area to the east and west. Under typical conditions, the oak is young & healthy enough to tolerate root loss at 7' from its trunk. However, the property to the north is largely covered by parking lot, which may result in more root growth to the south (into the proposed grading area). I recommend having an arborist on site during grading to review root impacts & prevent excess encroachment on the tree- If root loss is significant, the oak may need to be removed - Due to the large building footprints and grading requirements, it was not possible to provide enough space to retain the majority of the trees. Fourteen trees (#9, 11, 13, 14, 17, 22, 26, 27, 29, 31, 32, 35, 37, 38) m ust be rem oved due to high im pacts. The fate of tree #1 will be determined during construction. The last oak, tree #91, is found at the southernmost property line (of the small parcel). A retaining wall will be built 5' from the tree, at the top of the slope. As a young tree, its tolerance to root loss & stress is higher since it can easily replace lost foliage or roots. Tree Protection Recommendations (to be printed on site plans) Pre -Construction Phase ■ Remove trees #9, 11, 13, 14, 17, 22, 26, 27, 29, 31, 32, 35, 37 & 38 (14 trees). o Note: Tree #1 may also need to be removed if root loss is high (to be determined during grading)- ■ Prior to construction or grading, the contractor shall install chain -link fencing to construct a temporary Tree Protection zone (TPZ) around tree #1 & 91 as indicated on the tree protection plan. Other types of fencing shall not be used - they are easily removed or damaged, rendering them useless. Fencing shall not be adjusted or removed without consulting the project arborist. Foundation Grading,and Construction Phase The project arborist shall be on -site during grading within 15of tree #x1. If root loss is high, the tree may treed to be removed. If root loss is acceptable, the Tree Protection Zone (TPZ) fencing may need to be reinstalled after grading is completed around this tree (depending on what other work will occur around the tree). + The contractors shalt consult the project arborist if roots > 2" diameter are encountered by tree #91 during excavation for the retaining wall footing. If appropriate, the roots shall be cleanly pruned with a handsaw or sawzali, immediately covered, and kept moist till backf illed. • if needed, pruning shall be performed by personnel certified by the international Society of Arboriculture (ISA).
