HomeMy WebLinkAbout060623-06.6ADMINISTRATIVE STAFF REPORT 6.6 TO: Mayor and Town Council June 6, 2023 SUBJECT: Resolution No. 44-2023, accepting public and private improvements and dedications for Subdivision 9544, located at 134 El Dorado Avenue BACKGROUND On July 6, 2021, the Town Council approved the subdivision map for this 5-lot single- family residential development. Construction of the subdivision improvements is now complete. Action by the Town Council is necessary to accept the improvements and dedications. The private improvements consist of pervious pavers, curb and gutter, storm drainage and treatment facilities, common area landscaping, and traffic signs. The public improvements consist of new curb, gutter and sidewalk along El Dorado Avenue. The subdivision map (Attachment B) includes the following offers of dedications and relinquishments: 1.Emergency Vehicle Access Easement (EVAE) over the private court 2.Public Utility Easement (PUE) over the private court The recommended resolution (Attachment A) accepts all these dedications and relinquishments on behalf of the Town. Once accepted, the subdivider will have the option of replacing the current performance security with a one-year guarantee. Upon adoption of Resolution No. 44-2023, the City Clerk may release the performance security and legal security. The payment security may be released in three months if no claims are filed with the City Clerk. PUBLIC CONTACT Posting of the meeting agenda serves as notice to the general public. A copy of this Administrative Staff Report has been sent to the subdivider and Surety Company. RECOMMENDATION Adopt Resolution No. 44-2023, accepting public and private improvements and dedications for Subdivision 9544, located 134 El Dorado Avenue. Williams Assistant Town Manager Attachments: A - Resolution No. 44-2023 B - Location Map c: Subdivider: HD El Dorado, LLC, 696 San Ramon Valley Blvd, #416 Danville, CA 94526 Maintenance Department: Dave Casteel, Jim Parke; File No. 203-03/9544 RESOLUTION NO. 44-2023 ACCEPTING PUBLIC AND PRIVATE IMPROVEMENTS AND DEDICATIONS FOR SUBDIVISION 9544, LOCATED AT 134 EL DORADO AVENUE WHEREAS, HD El Dorado, LLC, is the subdivider of said subdivision; and WHEREAS, the subdivider has requested the Town of Danville accept said subdivision improvements as complete and accept the dedications offered to the Town of Danville on the recorded subdivision map of Subdivision 9544, (548M35); and WHEREAS, the City Engineer has advised that the improvements required as a condition of that subdivision agreement between the Town of Danville and said subdivider has been satisfactorily completed; and WHEREAS, said subdivision lies within the corporate limits of the Town of Danville; and WHEREAS, it is now in the interest of the Town of Danville to accept those dedications on said subdivision map for the benefit and use of the general public; and WHEREAS, the Danville Town Council must act affirmatively in order for the subdivision improvements and dedications to be accepted; now, therefore, be it RESOLVED, that the Danville Town Council accepts the following dedications offered for the public benefit within this subdivision: 1.Emergency Vehicle Access Easement (EVAE) over the private court 2.Public Utility Easement (PUE) over the private court RESOLVED, that the Town of Danville hereby accepts those public and private improvements installed as a condition of this subdivision agreement; and be it further RESOLVED, that Town staff is authorized and directed to release those securities required as a condition of this subdivision in accordance with the Danville Municipal Code.
