Town Council – Regular Meeting SUMMARY OF ACTIONS May 16, 2023 - DRAFT 1. CALL TO ORDER The regular meeting of the Danville Town Council was called to order by Mayor Storer at 5:00 p.m. in the Town Meeting Hall, 201 Front Street, Danville, CA. Present: Robert Storer, Mayor Karen Stepper, Vice Mayor Newell Arnerich, Councilmember Dave Fong, Councilmember Renee Morgan, Councilmember 2. PLEDGE OF ALLEGIANCE TO THE FLAG The pledge of allegiance to the flag was led by Paige Meyer. 3. CHANGES TO THE ORDER OF THE AGENDA There were no changes. 4. FOR THE GOOD OF THE TOWN Paige Meyer, Fire Chief, San Ramon Valley Fire Protection District, introduced new Assistant Chief Jonas Aguiar. 5. PRESENTATIONS AND PROCLAMATIONS 5.1 Reading of a proclamation by Mayor Storer proclaiming May 2023 as Jewish American Heritage Month Mayor Storer read the proclamation. CONSENT CALENDAR 6.1 Consider approval of the Summary of Actions from the regular Town Council meeting of May 2, 2023 6.2 Consider approval of the Register of Demands 6.3 Consider acceptance of the March 2023 Month End Treasurer’s Report 6.4 Consider adoption of Resolution No. 36-2023, approving the Fiscal Year 2023/24 project list funded by Senate Bill 1: the Road Repair and Accountability Act of 2017 6.5 Consider adoption of Resolution No. 37-2023, approving the display of the Rainbow Flag during the month of June 2023 MOTION BY COUNCILMEMBER MORGAN, SECOND BY COUNCILMEMBER ARNERICH, TO APPROVE THE CONSENT CALENDAR MOTION CARRIED 5-0 7. COMMUNICATIONS 7.1 Recreation, Arts and Community Services Department report by Director Henry Perezalonso Henry Perezalonso presented the report. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 16, 2023 3 7.2 Legislative update by Management Analyst Cat Bravo Cat Bravo provided the update. 8. PUBLIC HEARINGS 8.1 Consider introduction of Ordinance No. 2023-04, approving Rezoning request PUD23-0001 to rezone two parcels located at 1065 and 1069 Westridge Avenue with a General Plan Land Use Designation of Residential - Rural Residential from A-2; General Agricultural District to P- 1; Planned Unit Development District to allow for the establishment of zoning standards that are consistent with the surrounding neighborhood Assistant Planner Riley Anderson-Barrett presented the staff report. Chief of Planning David Crompton responded to questions from the Town Council regarding the number of possible units allowed on each parcel under SB9 or different zoning scenarios, and drainage concerns in the neighborhood. Bob Legg, applicant, provided additional information regarding drainage and expressed support for the staff report and recommendation. Mayor Storer stated that the Town Council received correspondence in opposition to this item in advance of the meeting, and he opened the item to public comment. The following individuals expressed opposition to the proposed Ordinance: Maria Yancich Gordon Fischer Larry Scharg DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 16, 2023 4 The following individuals submitted cards in opposition to the proposed Ordinance and did not address the Town Council: John and Marianne Exline Kevin and Janice Tamaki Chris and Jami Turner Dave Eggers James and Janine Miller Mayor Storer closed the item to public comment. Mr. Legg addressed items of concern expressed by the Town Council and previous speakers. The Town Council discussed the proposed ordinance and unanimously opposed the recommendation. MOTION BY COUNCILMEMBER MORGAN, SECOND BY VICE MAYOR STEPPER, TO OPPOSE ORDINANCE NO. 2023-04, DENYING REQUEST PUD23-0001 TO REZONE TWO PARCELS LOCATED AT 1065 AND 1069 WESTRIDGE AVENUE WITH A GENERAL PLAN LAND USE DESIGNATION OF RESIDENTIAL - RURAL RESIDENTIAL FROM A-2; GENERAL AGRICULTURAL DISTRICT TO P-1; PLANNED UNIT DEVELOPMENT DISTRICT MOTION CARRIED 5-0 8.2 Consider introduction of Ordinance Nos. 2023-05, 2023-06 and 2023-07 approving Zoning Text Amendment ZTA23-0001 amending the Town’s Single Family Residential District, Two Family Residential District, and Multifamily Residential District Ordinances as necessary to comply with State law and to provide other minor revisions Assistant Planner Riley Anderson-Barrett presented the staff report. Mayor Storer opened the item to public comment. There were no speakers. DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 16, 2023 5 Mayor Storer closed the item to public comment. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO ADOPT ORDINANCE NOS. 2023-05, 2023-06 AND 2023-07 APPROVING ZONING TEXT AMENDMENT ZTA23-0001 AMENDING THE TOWN’S SINGLE FAMILY RESIDENTIAL DISTRICT, TWO FAMILY RESIDENTIAL DISTRICT, AND MULTIFAMILY RESIDENTIAL DISTRICT ORDINANCES AS NECESSARY TO COMPLY WITH STATE LAW AND TO PROVIDE OTHER MINOR REVISIONS, AND RETURN FOR SECOND READING ON JUNE 6, 2023 MOTION CARRIED 5-0 8.3 Consider introduction of Ordinance No. 2023-08, approving Zoning Text Amendment ZTA23-0002 to amend the Town’s Accessory Dwelling Unit Ordinance as necessary to comply with State law Assistant Planner Riley Anderson-Barrett presented the staff report. Mayor Storer opened the item to public comment. There were no speakers. Mayor Storer closed the item to public comment. MOTION BY COUNCILMEMBER ARNERICH, SECOND BY COUNCILMEMBER MORGAN, TO ADOPT ORDINANCE NO. 2023-08, APPROVING ZONING TEXT AMENDMENT ZTA23-0002 TO AMEND THE TOWN’S ACCESSORY DWELLING UNIT ORDINANCE AS NECESSARY TO COMPLY WITH STATE LAW, AND RETURN FOR SECOND READING ON JUNE 6, 2023 MOTION CARRIED 5-0 DANVILLE TOWN COUNCIL SUMMARY OF ACTIONS MAY 16, 2023 6 9. ADMINISTRATIVE STAFF REPORTS (Public comment invited) 9.1 Consider adoption of Resolution No. 38-2023, authorizing the installation of traffic calming measures consisting of three (3) speed lumps and two (2) advanced warning signs on Paraiso Drive between Camino Ramon and Brookside Drive Transportation Program Specialist Adam Cleary presented the staff report. Mayor Storer stated that the Town Council received correspondence for this item in advance of the meeting, and he opened the item to public comment. Randall Hagen expressed support for the Resolution. The following individuals submitted cards in favor of the recommendation but did not request to address the Town Council: Margot Eastwood Jean Sasaki Brent Seuis Mayor Storer closed the item to public comment.
