Honorable Councilmember Newell Arnerich:
Good morning and I hope all is well. As the applicant, we wanted to
send a personalized note that supports the opinion of Staff regarding the Agenda Item.
Per PUD23-001 1065 Westridge and 1069 Westridge Ave Rezoning,
our family has applied to rezone our property at 1069 Westridge Ave.
Danville CA from A-2 General Agriculture to P-1 Planned Unit Development. Upon applying, the Town requested we approach our
neighbors at 1065 Westridge Ave. to see if they also wanted to rezone
their A-2 property so both properties could be rezoned together and
consistent with the neighborhood. Our neighbors at 1065 Westridge Ave. were in agreement.
Our intention is to match all the properties in the neighborhood that have
residential zoning making us consistent with the surrounding properties.
Rezoning the subject site would grant us the same development standards allowable uses and ability to subdivide under SB 9 that our current neighboring properties have and we currently do not have being
zoned A-2.
I personally moved to the valley in 1981 and was educated by the SRVUSD at Country Club Elementary, Pine Valley Middle School and
graduated from California High School in 1987. In 1998, I purchased a
home on El Pintado Road in Danville. I have a deep interest in the
community and applied for and was appointed to serve the Town of
Danville Planning Commission for four years. I served my term with gratitude, respect and honor to the community and Town. Shortly after I
relocated my business to Livermore to shorten the commute for my
employees. I also moved to Livermore to be closer to the business.
Fast forward a couple years I was married and had two young
children. Livermore is a great community but with a young family ready to start school, I knew of no better place than Danville to raise my

family. Our family purchased our Danville home, 1069 Westridge Ave., in
2017. We now have three children who all attend Montair Elementary and
are active with Mustang Soccer and Crow Canyon Sharks Swim Team.
Our property has never been used for the uses allowed per the A-2
zoning, only for a single family dwelling. These uses, provided by American Legal Publishing are as follows: a.
General Provisions. All of the land lying within an A-2 general agricultural district may be used for any of the following uses, under the following regulations set forth in this section. 1. 32-37.2 Uses. a. Uses Permitted. Uses permitted in the A-2 district shall be as follows: 1. All types of agriculture, including general farming, horticulture, floriculture, nurseries and greenhouses, mushroom rooms, dairying, livestock production, fur farms, poultry raising, animal breeding, aviaries, apiaries, forestry, and similar agricultural uses; 2. Other agricultural uses, including the erection and maintenance of sheds, warehouses, granaries, dehydration plants, hullers, fruit and vegetable packing plants, and buildings for the storage of agricultural products and equipment; 3. A stand not exceeding two hundred (200) square feet for sale of agricultural products grown on the premises. The stand shall be set back at least twenty-five (25') feet from the front property line; 4. A detached single family dwelling on each parcel and the accessory structures and uses normally auxiliary to it; 5. Foster home or family care home operated by a public agency, or by a private agency which has obtained State or local approval (license) for the proposed operation, where not more than
six (6) minors reside on the premises with not more than two (2) supervisory persons.
As currently zoned A-2, our property has uses (foster home, livestock, fruit stand, aviary, apiary, vegetable packing plant etc.) that could dramatically impact the residential zoned properties that surround us with smell, noise, equipment and visual impact. By rezoning our property to P-1 our property would eliminate the potential of these uses to be consistent with the surrounding neighborhood.
In summary, our family wants to rezone the property to be consistent with the established zoning of the surrounding neighborhood and have the same development standards, allowable uses and ability to subdivide under Senate Bill 9 that all our neighbors currently have.
